J Y J J Administrative Comments - January 14 , 1986 2 Minutes The minutes of the two previous meetings are attached 3 Preliminary Plat for L R Gray Mr Gray resides at 901 Pecan Street (Previous home of Mr Charlie Willis) Mr Gray is requesting your approval to allow him to subdivide one lot into two lots There is an existing house on Lot 1 The lot size and setbacks on Lot 2 meet city specifications Staff recommends its approval A copy of the preliminary plat is attached 4 Indian Springs Preliminary Plat Phase II In 1978 the City Council relinquished subdivision control over the Indian Springs Subdivision to Denton County This was an action that could not legally be taken The Phase I of the subdivision however was finalized and recorded Benny Parrent is now continuing with Phase II and plans to complete the development Since the city was in error by relinquishing its rights we must act on the plats for the Phase II Any questions regarding this action will and can be answered by the City Manager at the meeting The major areas you should consider regarding the approval of this plat are 1) Hard Surface Streets 2) Street Stub outs to other potential subdivisions 3) Review Water Structures in Subdivision for future tie ons 4) Flush Valves for filling fire trucks (It is my understand- ing that it takes a 6" water line in order to have enough pressure for a fire hydrant Bolivar Water serves this area and no 6" mains are allowed If they would use flush valves in the area it would give the capability for at least being able to fill up a fire truck) 5) Drainage capacity underneath Duck Creek Road 5 Proposed Subdivision for Frank Millar Attached is a copy of a survey with the proposed division of property shown and placement of the existing and proposed dwellings Since this property is undersized by City Code and requires several variances Mr Millar requested time to discuss his plans with the commission before he went to the expense of platting the property A f 1 f Administrative Comments January 14 , 1986 Page 2 The total square footage of the entire lot is 139 X 65 2 X142 5 X 65 Millar wants to subdivide the lot into two lots There is an existing apartment on Lot 1 This lot will become 65 2 X 69 89 for an approximate sq footage of 4557 Lot 2 will be approximately 4493 sq ft which would also be below city code However , the property is in the old part of town and undersized lots have been approved in the past in order to utilized the property and allow for more tax base Millar has drawn in a proposed house size that will fit on the lot The setbacks for the front and back lots will need a variance which he would show on the preliminary plat when it is processed He wants your input on this and would like tentative ap- proval before he plats the property The property is located at the corner of Locust and 7th Streets Please remember no action to be taken He wants only to pole P & Z members regarding its possible approval before he plats the property See you Tuesday 1 S I z rt r MINUTES Planning & Zoning Commission December 10 , 1985 MEMBERS PRESENT Chairperson Billye Hollingsworth, Tommy Kincaid, Bill Enlow, Fred Yeatts, Joe S Waide, and Georgia Royal MEMBERS ABSENT Eileen Brittian OTHERS PRESENT.Mary Jo Stover, Steve Shutt, Faye Marshall , Bill Marshall, and Joann Holson 1. The meeting was called to order by Chairperson Billye Hollingsworth. 2 The minutes of the November 26 , 1985 meeting were approved as printed 3 . Motion was made by Bill Enlow to approve the preliminary sub- division replat of Lots 6B and 7B, Block 15 , Burgess Addition. Tommy Kincaid gave the second. Voted unan 4 Other Such Matters : A) Joe Waide discussed the Snider-Chevrolet zoning stating that Snider had poured a slab before the zoning had been approved. He questioned why the city had allowed the Cart before the Horse " The City Manager stated there is no provision in our present ordinance for a penalty for this type thing and no building permit had been issued He stated that plans for the future includes raising the permits considerably and providing for a penalty of those who proceed before they have permission. He stated the city is trying to set up orderly provisions of how things are to be done. Waide stated that he wanted everyone to be treated the same that no favoritism should be shown B) Joann Holson requested to talk with P. & Z . about Phase II of her Choctaw Ridge Development. This development is in the city' s E T.J. and comes under the subdivision ordinance. Since changes had been made in the final plat she wanted to know if it was necessary to present a preliminary plat again P. & Z . advised Mrs Holson that she would have to present the preliminary plat and since their next meeting was on Christmas Eve that if she got the revised plats to the city staff before Christmas that they would try and call a meeting to speed up the process . She asked if she could present both the preliminary and final at the same time. Shutt told her she could Mrs . Holson was advised to show drainage plans (i.e. show culverts, Planning & Zoning Commission Minutes December 10 , 1985 i. Page 2 sizes , and how water will get to the creek) Need to show water lines and show at least two fire hydrants . Shutt stated that the roads were substandard. The city requires paved, curbed, and guttered streets Stated he would not recommend the curb and guttering, but would recommend a two course chip seal on the road A letter of credit for one (1) year to be furnished to the city. Shutt read from the subdivision ordinance and its requirements for developments in the E T J Discussion. P & Z members stated that in the past the city manager had advised them on developments outside the city They were not aware that the sub- division ordinance applied Motion was made by Joe Waide to adjourn the meeting. Georgia Royal gave the second. Voted unan Minutes Planning & Zoning Commission Special Called Meeting December 16 , 1985 Members Present Chairperson Billye Hollingsworth, Fred Yeatts , Joe S Waide, Georgia Royal and Bill Enlow Members Absent Eileen Brittian and Tommy Kincaid Others Present Steve Shutt, Mary Jo Stover, and Jerry Jenkins 1 The meeting was called to order by Chairperson Billye Hollingsworth 2 & 3 Since the Final Subdivision Plat of Choctaw Ridge Phase II and the Indian Springs Subdivision Phase II was being con- sidered for basically the same circumstance they were discus- sed together City Manager Steve Shutt explained to the P & Z members that these plats had been approved by the county The city had in 1978_ relinquished its rights and exempted Indian Springs Subdivision These two plats are identical in that they are both in the city' s E T J, The county takes the position that if they are going to have to maintain the roads that they will be in control The city' s subdivison ordinance says the city will enforce the regulations At the present time there is no provision for a variance, however, there is an amendment before council to allow for variances Steve stated that he wanted to take action from the P & Z stating that the commis- sion had passed on these plats with the stipulation that a variance be granted on the streets , the water line to be a minimum of 6" in order to afford a minimum of 2 fire hydrants The drainage to be noted on the plat He stated that country estates would not require curb and guttering He emphasized that the city needed to take responsibility in their E T J regarding their subdivision ordinance Discussion Motion was made by Joe Waide that Planning and Zoning accept the final plats of Choctaw Ridge Phase II and Indian Springs Subdivision Phast II with the stipulation that a minimum 6" water line run into the subdivisions and be properly spaced, include 2 fire plugs , that drainage be shown on the plat , that a letter of credit be give to the city for 1 year plus 10% and 1 year or whenever 60% of the land is sold or which- ever comes first the streets will be paved Fred Yeatts gave the second Voted unan Minutes Planning & Zoning Special Called Meeting December 16 , 1985 Page 2 4 Steve Shutt explained the variance request from Karen and Gary Lake The Lakes are requesting a 15 ' backlot setback a in lieu of the 25 ' setback requirement Discussion Motion was made by Georgia Royal made the motion to grant the variance request allowing for the 15 ' setback Joe Waide gave the second Voted unan 5 With no other matters to come before the commission Fred Yeatts made the motion to adjourn the meeting Bill Enlow gave the second Voted unan 1- 1 i.1 t 1 I I I 1 oV c JACKI,E D CJ L coy p/K Y 4 TE FEE 1 r-N L IA01u f 88,/45 Z 83 9 1-,\‘ O N 5 07 40 Jr!
