AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANGER, DENTON
COUNTY, TEXAS, CANVASSING THE RESULTS OF A GENERAL ELECTION
HELD ON MAY 3,2025,FOR THE PURPOSE OF ELECTING CANDIDATES TO THE
OFFICE OF CITY COUNCIL IN THE CITY OF SANGER,TEXAS,DECLARING THE
RESULTS OF THAT ELECTION AND PROVIDING FOR AN EFFECTIVE DATE
WHEREAS, the City of Sanger (the "City") is a home rule municipality regulated by
state law and Charter, and
WHEREAS,the General Election for the City of Sanger as set for by the Texas Election Code,
was held on May 3,2025,for the purpose of electmg Councilmembers for Place 1, Place 3,and Place
5,for a two-year terms,and
WHEREAS, the City Council passed Ordinance No 01-01-25, Calling and Ordering
the General Election on May 6, 2023, and
WHEREAS, the City Council authorized the Mayor to enter into a Joint Election
contract with Denton County to conduct the General Election, and
WHEREAS,it is hereby found and determined that notice of the election was duly given
in the form,manner, and time required by law, and said election was in all respects legally held
and conducted in accordance with applicable laws of the State of Texas and proceedings
governing the hold of such election, and
WHEREAS,the City Council finds that the passage of this Ordinance is in the best interest
of the citizens of Sanger
NOW,THEREFORE,BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
SANGER, TEXAS
SECTION 1 That the City Council of the City of Sanger, Texas has determined that the election
officials of the votmg district of the City,have in compliance with the law m such cases made and
provided returns to the City Council m the time and manner required, and the City Council,having
canvassed the votes does find that the total number of ballots cast and that the total number of
votes cast for each candidate is as follows

SECTION 2 That the election,having been duly called, and that notice of the election was given
in accordance with the law, and the following persons were elected to the following positions as
provided hereof and in Exhibit A attached hereto
Councilmember Place 1 Marissa Barrett May 2025 -May 2027
Councilmember Place 3 Josh Burrus May 2025 -May 2027
Councilmember Place 5 Victor Gann May 2025 -May 2027
SECTION 3 That all matters stated in the preamble are found to be true and correct
and are incorporated herein as if copied in their entirety
SECTION 4 It is hereby declared to be the intention of the City Council that the sections,
paragraphs, sentences, clauses, phrases and words of this Ordinance are severable and, if any
word, phrase, clause, sentence, paragraph, or section of this Ordinance shall be declared
unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such
unconstitutionality shall not affect any of the remaining portions of this Ordmance,since the same
would have been enacted by the City Council without the incorporation in this Ordinance of any
such unconstitutional word,phrase, clause, sentence,paragraph, or section
SECTION 5 That this Ordinance shall be cumulative of all other City Ordinances and all other
provisions of other Ordinances adopted by the City which are inconsistent with the terms or
provisions of this Ordinance are hereby repealed

SECTION 6. This Ordinance will take effect immediately from and after its passage and the
publication of the caption, as the law and Charter in such case provides.

UNA ORDENANZA DEL CONCEJO MUNICIPAL DE LA CIUDAD DE SANGER,
CONDADO DE DENTON, TEXAS, QUE REALIZA EL ESCRUTINIO DE LOS
RESULTADOS DE UNA ELECCION GENERAL CELEBRADA EL 3 DE MAYO DE
2025, CON EL PROPOSITO DE ELEGIR CANDIDATOS PARA EL CARGO DE
CONCEJO MUNICIPAL EN LA CIUDAD DE SANGER,TEXAS,DECLARANDO LOS
RESULTADOS DE ESA ELECCION Y PROPORCIONANDO UNA FECHA DE
VIGENCIA
CONSIDERANDO QUE,la Ciudad de Sanger(la"Ciudad")es un mumcipio autonomo
regulado por la ley estatal y la Carta Constrtutiva,y
CONSIDERANDO QUE, la Eleccion General para la Ciudad de Sanger, segun to
establecido por el Codigo Electoral de Texas,se llevo a cabo el 3 de mayo de 2025,con el proposito de
elegir a los Concejales para el Lugar 1,el Lugar 3 y el Lugar 5,por un penodo de dos anos,y
CONSIDERANDO QUE, el Concejo Municipal aprobo la Ordenanza No 01-01-25,
Convocando y Ordenando las Elecciones Generales el 6 de mayo de 2023, y
CONSIDERANDO QUE, el Concejo Municipal autonzo al Alcalde a celebrar un
contrato de Eleccion Conjunta con el Condado de Denton para llevar a cabo la Eleccion General,
y
CONSIDERANDO QUE, por la presente se determina y se determina que la
notificacion de la eleccion se dio debidamente en la forma, manera y tiempo requendos por la
ley, y que dicha eleccion se llevo a cabo legalmente en todos los aspectos de acuerdo con las
leyes aplicables del Estado de Texas y los procedimientos que ngen la celebracion de dicha
eleccion,y
CONSIDERANDO QUE, el Concejo Municipal considera que la aprobacion de esta
Ordenanza es en el mejor mteres de los ciudadanos de Sanger
AHORA,POR LO TANTO, SEA ORDENADO POR EL CONSEJO DE LA CIUDAD DE
SANGER,TEXAS
SECCION 1 Que el Concejo Municipal de la Ciudad de Sanger, Texas ha determinado que los
funcionanos electorales del distrrto electoral de la Ciudad,en cumpluruento de la ley en tales casos,
han hecho y proporcionado declaraciones al Concejo Municipal en el tiempo y la forma requendos,
y el Concejo Municipal, habiendo escrutado los votos, encuentra que el numero total de boletas
emitidas y que el numero total de votos emitidos para cada candidato es como sigue

SECCION 2 Que la eleccion, habiendo sido debidamente convocada, y que la notificacion de la
eleccion se dio de acuerdo con la ley, y las siguientes personas fueron elegidas para los siguientes
cargos segun to dispuesto en el presente y en el Anexo A adjunto al presente

SECCION 3 Que todos los asuntos declarados en el preambulo se consideran verdaderos y
correctos y se mcorporan aqui como si estuvieran copiados en su totandad
SECCION 4 Por la presente se declara que es la intension del Concejo Municipal que las
secciones, parrafos, oraciones, clausulas, frases y palabras de esta Ordenanza sean separables y,
si alguna palabra, frase, clausula, oracion, parrafo o seccion de esta Ordenanza fuera declarada
inconstitucional por la sentencia o decreto vando de cualquier tribunal de jurisdiccion

competente, dicha inconstitucionalidad no afectara ninguna de las partes restantes de esta
Ordenanza, ya que la misma habria sido promulgada por el Concejo Municipal sin la
incorporaciOn en esta Ordenanza de ninguna palabra, frase, clausula, oracion, parrafo o seccion
inconstitucional.
SECCION 5. Que esta Ordenanza sera acumulativa de todas las demas Ordenanzas de la
Ciudad y todas las demas disposiciones de otras Ordenanzas adoptadas por la Ciudad que sean
inconsistentes con los terminos o disposiciones de esta Ordenanza quedan derogadas por la
presente.
SECCION 6. La presente Ordenanza entrara en vigor inmediatamente despues de su aprobacion
y de la publicacion del titulo, segun to disponga la ley y la Carta en tal caso.
