IMPORTANT NOTICE: MEETING HELD BY TELECONFERENCE
Meetings will temporarily be held via teleconference and will not be held at Sanger City
Hall. Effective March 16, 2020 Texas Governor Abbott suspended certain Open Meeting rules to
allow telephonic or videoconference meetings of government bodies that are accessible to the
public to decrease large groups of people from assembling in order to advance the public health
goal of limiting facetoface meetings to slow the spread of the Coronavirus (COVID19). The
suspension temporarily removes the requirement that government officials and members of the
public be physically present at a meeting location. A recording of the telephone conference will be
made available to the public in accordance with the Open Meetings Act, upon written request for
up to 90 days after the official minutes of the meeting are approved.
If you plan to speak or provide public comments during the meeting please email
citysecretary@sangertexas.org and indicate which item you would like to comment on. You will
need to provide the City Secretary your name, address, and the name, and/or number you are
calling into the conference with for recognition purposes to allow you to speak during the item. In
order to facilitate Public Hearings during the meeting, each name on the speaking list will be
called in the order they were received and will be provided an opportunity to comment. You may
also provide comments to the City Secretary (citysecretary@sangertexas.org) regarding an item if

1. The SUP will expire at the time of development of Stephens Towne Crossing or 5 years after going into effect,
whichever is less.
2. The SUP will expire upon abandonment of the quick service food and beverage shop for a period of ninety (90) days.
3. No vehicle parking will be permitted within thirty (30) feet of the rightofway of Chapman Drive.
4. No night time operation of the business is permitted without adequate lighting.
5. The site must fully mitigate the effects of traffic and parking on the site, maintaining the site in day one conditions
throughout life of the SUP.
6. Maximum building site of 128 square feet.
7. Minimum setback between building and parking area of fifteen (15) feet.
8. A wooden walkway or other approval surface must be provided between building and parking area.

Case Overview
The subject property is zoned as I-1 (Industrial District). This district allows the proposed use of
a Quick Services Food and Beverage Shop only with a Specific Use Permit (SUP). The site
currently has a SUP for the same use which was approved two years ago on February 5 th, 2018
through Ordinance # 02-04-18, with an expiration date of February 5th, 2020. The applicant is
requesting a new SUP to be approved for the same use to allow them to continue their use.
The property is approximately 4.9461 acres and is not platted. The existing development meets
City of Sanger’s requirements and conditions mentioned in Ordinance # 02-04-18. No
improvements are necessary for the continuation of the proposed use. The project site is a potential
site for future Stephens Towne Crossing Commercial Development. According to the preliminary
plans, Stephens Towne Crossing Commercial Development will have a designated Food Truck
Park and will be able to accommodate the existing Food Truck into the potential food truck park.

Issues for Consideration
In granting a Specific Use Permit (SUP), the City Council may impose conditions which shall be
complied with by the owner or grantee before a certificate of occupancy may be issued by the
building inspector for use of the building on such property pursuant to such SUP; and such
conditions precedent to the granting of the certificate of occupancy.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANGER, DENTON
COUNTY, TEXAS, AMENDING THE COMPREHENSIVE ZONING ORDINANCE AND
THE OFFICIAL ZONING MAP ESTABLISHED THROUGH CHAPTER 14 “PLANNING
AND ZONING” OF THE CODE OF ORDINANCES, EXHIBIT A “ZONING ORDINANCE
OF THE CITY OF SANGER, TEXAS”, AND SECTION 4 “ZONING DISTRICT MAP”, TO
GRANT A SPECIFIC USE PERMIT (SUP) TO ALLOW A QUICK SERVICES FOOD AND
BEVERAGE SHOP LOCATED AT 203 EAST CHAPMAN DRIVE AT APPROXIMATELY
4.9461 ACRES OF LAND ZONED AS INDUSTRIAL DISTRICT (I-1); PROVIDING FOR
THE REPEAL OF ALL ORDINANCES IN CONFLICT; PROVIDING FOR A

WHEREAS, all Requests for A Specific Use Permit (SUP) were duly filed with the City
of Sanger, Texas, concerning the hereinafter described properties;
WHEREAS, due notice of hearings were made in the time and manner prescribed by law
and the Planning and Zoning Commission of the City of Sanger, Texas, duly covered and
conducted public hearing for the purpose of assessing a request for a Specific Use Permit (SUP)
on the hereinafter described properties located in the City of Sanger, Texas;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
SANGER, TEXAS:
SECTION 1. That a Specific Use Permit (SUP) to allow a Quick Services Food and
Beverage Shop use is hereby granted for a period of five (5) years starting from the date of approval
of the SUP by City Council. This is an approximately 4.946-acre site, described as A0029A
R.BEEBE, TR 66(PT), 4.946 Acres, OLD DCAD SHT 4, TR 2 and shown in Exhibit A, generally
located north of the intersection of FM 455 and Sable Creek Blvd, with the following conditions:
1. The SUP will expire at the time of development of Stephens Towne Crossing or 5 years
after going into effect, whichever is less.
2. The SUP will expire upon abandonment of the quick service food and beverage shop for a
period of ninety (90) days.
3. No vehicles parking will be permitted within thirty (30) feet of the right -of-way of
Chapman Drive.
4. No night time operation of the business is permitted without adequate lighting.
5. The site must fully mitigate the effects of traffic and parking on the site, maintaining the
site in day one conditions throughout life of the SUP.
6. Maximum building site of 128 square feet.
7. Minimum setback between building and parking area of fifteen (15) feet.

8. A wooden walkway or other approval surface must be provided between building and
parking area.
SECTION 2. All ordinances or parts of ordinances in conflict herewith are, to the extent
of such conflict, hereby repealed.
SECTION 3. It is hereby declared to be the intention of the City Council that the sections,
paragraphs, sentences, clauses, phrases and words of this Ordinance are severable and, if any
word, phrase, clause, sentence, paragraph, or section of this Ordinance shall be declared
unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such
unconstitutionality shall not affect any of the remaining portions of this Ordinance, since the same
would have been enacted by the City Council without the incorporation in this Ordinance of any
such unconstitutional word, phrase, clause, sentence, paragraph, or section.
SECTION 4. Any person, firm or corporation who shall violate any of the provisions of
this article shall be guilty of a misdemeanor and upon conviction shall be fined in accordance
with the general penalty provision found in The Code of Ordinances, Section 1.109 General
Penalty for Violations of Code.
SECTION 5. This ordinance will take effect immediately from and after its passage and
the publication of the caption, as the law and Charter in such cases provide.

Dear Muzaib:
Attached are revised copies of the above referenced project. The following is a summary of the revisions that were made
to the Minor Plat document to address staff comments.
ENGINEERING
Comment: Plat previously received on 1/7/20 dated 12-12-19, had 13 improvement statements on it. The current plat
has 7 general notes. The platting process goes through the City but needs to meet both City & County requirements.
Please ensure all applicable Denton County notes are shown on plat. See Denton County Subdivision Rules and
Regulations and most current County plat checklists.
Response: All applicable Sanger and Denton County notes are on the plat now.
Comment: An accurate location of at least two (2) corners of the subdivision with reference to original corners of the
original survey of which the subdivision is a part or an existing permanent monument to an approved and recorded plat or
permanent markers established by and approved by the City Engineer.
Response: A tie to the Southwest corner of the Wal-Mart Distribution Center plat has been added. Location of the plat is
based on monuments found in the field.
Comment: “Bearings are based on the State Plane Coordinate System, Texas North Central Zone (4202),
North American Datum of 1983 (NAD ‘83)” Are bearings shown are based on deed or previous survey? City requires that
the bearings on plat be tied to State Plane coordinate system. Provide justification for bearings shown.

“All surface drainage easements shall be kept clear of fences, buildings, foundation, plantings and other obstructions to
the operation and maintenance of the drainage facility.”
• “Blocking the flow of water or constructing improvements in surface drainage easements, and filling or obstructing the
floodway is prohibited.”
• “Denton County will not be responsible for any damage, personal injury or loss of life or property occasioned by flooding
or flooding conditions.”
• “The existing creeks or drainage channels traversing along or across the addition will remain as open channels and will
be maintained by the individual property owners of the lot or lots that are traversed by or adjacent to the drainage courses
along or across the lots.”
• “Construction not complete within two years of the City of Sanger approval shall be subject to current City of Sanger and
County Subdivision Rules and Regulations.”
• “A driveway culvert permit must be obtained from the Road and Bridge Department by the owner of each lot prior to the
construction, installation or placement of any driveway access improvements within the dedicated right-of-way.”
• “No construction, without written approval from Denton County shall be allowed within an identified “FIRM” floodplain
area, and then only after a detailed floodplain development permit including engineering plans and studies show that no
rise in the Base Flood Elevation (BFE) will result, that no flooding will result, that no obstruction to the natural flow of
water will result; and subject to all owners of the property affected by such construction becoming a party to the request.
Where construction is permitted, all finished floor elevations shall be a minimum of two feet above the 100-year flood
elevation.”
• “Denton County shall not be responsible for maintenance of private streets, drives, emergency access easements,
recreation areas and open spaces; and the owners shall be responsible for the maintenance of private streets, drives,
emergency access easements, recreation areas and open spaces, and said owners agree to indemnify and hold
harmless Denton County from all claims, damages and losses arising out of or resulting from performance of the
obligations of said owners set forth in this paragraph.”
Response: All these notes were added as “DENTON COUNTY NOTES” on the plat.
Comment: 30’ building line is required to be provided along north side of Lot 1/Lot 2 common lot line.
Response: A 30’ Building line has been added to the plat as specified.
Comment: Variance request will need to be granted from the City of Sanger regarding lot shape.
Response: Variance request for the lot shape has already been submitted to Sanger. A second Variance Request for
lots facing residential streets is being submitted along with this resubmission.
Comment: Prior to allowing plat to be filed, Applicant will need to provide an engineered plan showing the
existing drainage swale along street frontage, existing driveway culverts, proposed re-grading of swale if needed and
proposed size & slope of driveway culvert for lot 2 meeting Denton County standards. Plan may also need to show
existing water main and utilities crossing development.
Response: A Civil Engineer has been contracted by the property owner to address this comment. Engineered Plans will
be submitted to Sanger as requested as soon as they are completed.
Comment: As topography has not yet been submitted, and the limits of the drainage swale is not known, additional
drainage easement may be required along street frontage. 16’ Utility Easement may need to be a 16’ drainage & utility
easement.
Response: Comment noted.

a. Subject property is located as the northwest quadrant of the View Rd / Metz Rd intersection, which is
generally located west of Interstate 35, approximately 2.5 miles north of FM 455 (Chapman Rd).
b. Total size of property prior to platting = 18.019acres
c. Total Proposed Lots = 15 (phase 2 only)
d. Lots shall be served by a public water system (Bolivar WSC) and private on-site septic facilities
(permits for septic systems shall be submitted/approved by Denton County). Power service appears to
be within the CoServ Electric service area.
e. Minimum Lot size shall be one (1) acre.
6) The vast majority of the overall property appears to be within the Extraterritorial Jurisdiction (ETJ) of the City of
Sanger, with a small portion in the City of Denton Division II ETJ, and a small portion within Denton County.
Prior coordination between all three entities have led us to believe that platting authority shall run completely
through the City of Sanger, and as such, we are requesting that this plat be reviewed and considered by the City
of Sanger, the appropriate approval body.

Sanger, with a small portion in the City of Denton Division II ETJ, and a small portion within Denton County.
Prior coordination between all three entities have led us to believe that platting authority shall run completely
through the City of Sanger, and as such, we are requesting that this plat be reviewed and considered by the City
of Sanger, the appropriate approval body.

EASEMENT WITHIN THE LIMITS OF THIS ADDITION, WILL REMAIN OPEN AT ALL TIMES AND WILL BE
MAINTAINED IN A SAFE AND SANITARY CONDITION BY THE OWNERS OF THE LOT OR LOTS THAT
ARE TRAVERSED BY OR ADJACENT TO THE DRAINAGE AND DETENTION EASEMENT. NEITHER THE

FOR THE CITY OR COUNTY TO ERECT OF CONSIDER ERECTING ANY TYPE OF DRAINAGE STRUCTURE

NECESSARY FOR DRAINAGE PURPOSES. EACH PROPERTY OWNER SHALL KEEP THE DRAINAGE AND
DETENTION EASEMENT CLEAN AND FREE OF DEBRIS, SILT, AND ANY SUBSTANCE WHICH WOULD
RESULT IN UNSANITARY CONDITIONS OR OBSTRUCT THE FLOW OF WATER, AND THE TOWN SHALL
HAVE THE RIGHT OF INGRESS AND EGRESS FOR THE PURPOSE OF INSPECTION AND SUPERVISION OF

15) SANITARY SEWER FOR EACH LOT TO BE PROVIDED BY PRIVATE SEPTIC SYSTEMS WHICH SHALL BE
APPROVED AND PERMITTED BY THE DENTON COUNTY PUBLIC HEALTH DEPARTMENT.
16) THE MAINTENANCE OF PAVING, GRADING AND DRAINAGE IMPROVEMENTS AND/OR EASEMENTS
SHOWN ON THIS PLAT ARE THE RESPONSIBILITY OF THE INDIVIDUAL PROPERTY OWNERS AND DO
NOT CONSTITUTE ACCEPTANCE OF SAME FOR MAINTENANCE PURPOSES BY DENTON COUNTY.

18) BLOCKING THE FLOW OF WATER OR CONSTRUCTING IMPROVEMENTS IN SURFACE DRAINAGE
EASEMENTS, AND FILLING OR OBSTRUCTING THE FLOODWAY IS PROHIBITED. DENTON COUNTY
WILL NOT BE RESPONSIBLE FOR ANY DAMAGE, PERSONAL INJURY OR LOSS OF LIFE OR PROPERTY
OCCASIONED BY FLOODING OR FLOODING CONDITIONS.
19) THE EXISTING CREEKS OR DRAINAGE CHANNELS TRAVERSING ALONG OR ACROSS THE ADDITION
WILL REMAIN AS OPEN CHANNELS AND WILL BE MAINTAINED BY THE INDIVIDUAL PROPERTY
OWNERS OF THE LOT OR LOTS THAT ARE TRAVERSED BY OR ADJACENT TO THE DRAINAGE
COURSES ALONG OR ACROSS THE LOTS.
20) CONSTRUCTION NOT COMPLETE WITHIN TWO YEARS OF THE CITY OF SANGER APPROVAL SHALL
BE SUBJECT TO CURRENT CITY OF SANGER CODE OF ORDINANCES AND DENTON COUNTY

1st REVIEW COMMENTS – Final Plat (Sanger Meadows Addition Phase 3 Final Plat)
Request is for a Final Plat of Sanger Meadow Addition Phase 3, being approximately 127.473
acres of land into 101 residential lots prepared by Texas Surveying submitted on 02/12/2020.
Below are the comments that should be addressed prior to recommendation to City Council for
approval. Resubmit the revised plat along with a response letter addressing all comments.
Planning
1. Add all Denton County notes under General Notes. NOTES COMBINED
2. A Parkland Dedication fee in lieu of land is required to be paid for all residential
development within the ETJ and City limits before filing of the final plat. The fee is
calculated as $274.00 per dwelling unit. DEVELOPER NOTIFIED. NOT A PLAT DOCUMENT CONCERN.
3. Along Lot 1, Block B, show the dimension of proposed View Road right-of-way on both
sides of the centerline. DIMENSION SHOWN
4. Dimension the drainage easement on Lot 1, Block B. DIMENSION SHOWN AS “103.0 DRAINAGE EASEMENT”
5. Add a 30’x30’ visibility easement on all corner lots. ADDED (SEE NOTE # 24)
6. Add 30’ building line and 16’ drainage and utility easement along all road frontages. ADDED PER NOTE # 25
7. According to Denton County subdivision regulations, all lots must have a minimum width
of 60 feet. Provide lot widths of Lots 35, 36, 37, 41, 42, & 62, Block A; and Lots 9, 10, 19,
20, 21, & 22, Block B. DIMENSIONS ADDED PER CURVE DATA TABLE. ALL LOTS ARE MINIMUM OF 60’ AT BUILDING LINE
8. Revise the faded Phase 1 lots to match the updated configuration. REVISED
Informational Comments
9. The preliminary plat of Sanger Meadows Addition Phase 3 was approved by the City
Council on 12/02/2019 with the following variances:
a. Section 10.105.6.B. Where no existing subdivision controls, the blocks shall not
exceed 1000 feet in length not to be less than 500 feet in length, except in certain
instances where topographical features warrant special consideration;
b. Section 10.105.4.D Residential lots shall front on residential class streets
c. Section 10.105.4.C Lots should be rectangular where practicable. Sharp angles
between lot lines should be avoided. The ratio of depth to width should not
ordinarily exceed two and one-half to one (2.5:1)
d. All engineering comments addressed with the final plat
10. The property is located in the City of Sanger ETJ.
11. Final Plat will be scheduled for P&Z Commission on March 9, 2020 and for City Council
on April 6, 2020.

Request is for a Final Plat of Sanger Meadow Addition Phase 2, being approximately 18.019 acres of land
into 15 residential lots prepared by Texas Surveying submitted on 02/12/2020. Below are the comments
that should be addressed prior to recommendation to City Council for approval. Resubmit the revised
plat along with a response letter addressing all comments.
• Combine notes into 1 list rather than 2 separate. See Final Plat Phase 1 Corrected. NOTES COMBINED
• Provide a 16’ (minimum) wide utility easement along all street frontages. Underground utility
lines may be permitted to cross County right-of-way, but will not be permitted longitudinally in
the right-of-way. ADDED PER NOTE #25
• Per DCSRR pg 40 add following note to plat “Drainage easements adjacent to roadways may not
be fenced and must be left so that access can be obtained for maintenance purposes.” NOTE ADDED (SEE NOTE #11)

• Per DCSRR pg 43 Drainage Easements: It is to be clearly understood that all drainage easements
must be a minimum of sixteen feet (16′) in width and shall be on a single lot and not split by lot
lines. If on multiple lots as shown, provisions will need to made restricting fencing in drainage
easement and permitting maintenance access. If not already shown provide note stating
drainage easements may not be fenced and must be left clear so that access can be obtained for
maintenance purposes. SEE NOTE #11
• 30’ sight visibility is required at all intersections by City code. ADDED (SEE NOTE #24)
