AN ORDINANCE OF THE CITY OF SANGER, TEXAS AUTHORIZING
A PERMIT FEE FOR PREMISES AUTHORIZED TO SELL BEER AND WINE
FOR OFF PREMISE CONSUMPTION AND FOR PREMISES TO SELL MIXED
BEVERAGES FOR ON PREMISE CONSUMPTION IN RESTAURANTS, AND A
PROCESSING FEE; AND PROVIDING AN EFFECTIVE DATE. -
WHEREAS, a local option election has been conducted to authorize the legal sale of beer
and wine for off premise consumption; and
WHEREAS, a local option election has been conducted to authorize the legal sale of
Mixed Beverages in Restaurants by Food and Beverage Certificate holders only; and
WHEREAS, each application for a permit for off premise wine and beer and/or Sales of
Mixed Beverages to the Alcoholic Beverage Commission must be accompanied by a cashier's
check or money order for the amount of the state fee; and
WHEREAS, section 11.38 ofthe Alcoholic Beverage Code authorizes the city to levy and
collect a fee not to exceed one-half of the state fee for each permit issued for
premises located within. the City; NOW, THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SANGER,
TEXAS:
SECTION 1.
A. That each application to the Alcoholic Beverage Commission for a wine and beer
retailer's off premise permit or for a Mixed Beverage Permit for a location within the City limits
of the city of Sanger shall be accompanied by the permit fee required by state law and, at the same
time, the applicant shall remit to the City Secretary of the City of Sanger a fee equal to the amount
designated in the City of Sanger's Fee Schedule.
B. Off -Premise Alcohol Sales and Mixed Beverage Permit Processing Fee shall be the
amount designated in the City of Sanger's Fee Schedule
SECTION 2. The City Secretary shall forward a certified copy of this ordinance to the
Alcoholic Beverage Commission to give notice of the levy of this fee.
SECTION 3. The Commission may cancel the permit if it finds that the Permittee has not
paid a fee levied by this ordinance or has not paid delinquent ad valorem taxes
due on the permitted premises or due from a business operated on that premises.
SECTION 4. This ordinance shall take immediately from and after its passage, as the law
and charter in such cases provides.
