THAT APPENDIX A "FEE SCHEDULE", OF THE CODE OF ORDINANCES OF THE
CITY OF SANGER, DENTON COUNTY, TEXAS, IS HEREBY AMENDED BY
AMENDING ARTICLE 4.000 "UTILITY RELATED FEES", SECTION 4.405 LARGE
COMMERCIAL RATE AND SECTION 4.408 MUNICIPAL SERVICE LIGHTING
RATE; PROVIDING FOR THE REPEAL OF ALL ORDINANCES IN CONFLICT;
PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SANGER, TEXAS:
Section 1. That Appendix A "Fee Schedule", Article 4.000, Section 4.405, of the Code
of Ordinances, City of Sanger, Texas, is hereby amended to read as follows:
"Sec. 4.405 Large Commercial Electric Rate
(a) Availability. To any customer for electric service supplied at one point of delivery
and measured through one meter. This applies to all customers with usage of 25KW or more on
demand.
(b) Demand. The demand usage will be based on an average of the usage for the
months of June, July, August and September. That average will be the usage billed for the
following twelve (12) months, except for any month where the actual usage is higher than that
average, the actual usage will be billed for that month.
(c) Rate.
(1) Facilities charge: $35.00.
(2) Demand charge: $9.00/KW.
(3) Energy charge: $ .037705."
Section 2. That Appendix A, Fee Schedule, Article 4.000, Section 4.408, of the Code of
Ordinances, City of Sanger, Texas, is hereby amended to read as follows:
"Sec. 4.408 Municipal Service Lighting Rate
(a) Availability. To the city for street lighting and for all municipal purposes other
than water and sewage pumping.
(b) Energy charge. $0.062357 per kwh for all kwh"
Section 3. All ordinances or parts of ordinances in conflict herewith are, to the extent of
such conflict, hereby repealed.
Section 4. It is hereby declared to be the intention of the City Council that the sections,
paragraphs, sentences, clauses, phrases and words of this Ordinance are severable and, if any
word, phrase, clause, sentence, paragraph, or section of this Ordinance shall be declared
unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such
unconstitutionality shall not affect any of the remaining portions of this Ordinance, since the
same would have been enacted by the City Council without the incorporation in this Ordinance
of any such unconstitutional word, phrase, clause, sentence, paragraph, or section.
Section 5. This ordinance will take effect immediately from and after its passage as the
law and Charter in such cases provide
