CITY OF SANGER, TEXAS MINUTES: REGULAR CITY COUNCIL MEETING January 3, 2017, 7:00 PM 502 Elm Street, Sanger, Texas COUNCIL MEMBERS PRESENT: Mayor Thomas Muir, Councilman Bill Boutwell, Councilman David Clark, Councilman Gary Bilyeu, Councilman Allen Chick COUNCIL MEMBERS ABSENT: Councilman Lee Allison Five Council Members present constituting a quorum. STAFF MEMBERS PRESENT: Mike Brice City Manager, Cheryl Price City Secretary, Alina Ciocan Director of Economic and Community Development CITIZENS RECOGNIZED DURING MEETING: Joe Falls, Marcus Mathis, Jody Roberts 1. Call Meeting to Order, Invocation, Pledge of Allegiance. Mayor Muir called the meeting to order at 7:00 p.m. Councilman Chick led the Invocation followed by Councilman Boutwell leading the Pledge of Allegiance. 2. Citizens Input: (Citizens are allowed 3 minutes to speak. The City Council is unable to respond or to discuss any issues brought up during this section). Joe Falls, 4489 McReynolds Road was recognized and said he is disappointed that Sanger is not moving with his vision would like to see Sanger move forward. He repeated his plea to the City Council to reconsider their plans for the wastewater treatment improvements and relocate the plant. He again let the Council know that he would be glad to meet with them individually or in a Work Session. 3. CONSENT AGENDA: a) Approval of Minutes: a. City Council Work Session, December 19, 2016 b. Regular City Council Meeting, December 19, 2016 b) Disbursements A Motion was made by Councilman Bilyeu to approve the Consent Agenda with a minor correction on the Minutes for Agenda Item 5, correcting the spelling on name of Applicant from "Matt" to "Mark" Carpenter. Councilman Chick posed a few questions to staff regarding the disbursements. The Motion was seconded by Councilman Bilyeu. Motion Carried unanimously (4-0 vote, Councilman Allison Absent). 4. Consider any Items Removed from Consent Agenda. No Items Removed from Agenda. REGULAR AGENDA 5. Conduct a Public Hearing to Consider the Possible Annexation of Land Located East of Marion Road and North of FM 455. Mayor Muir opened the Public Hearing at 7:15 p.m. and solicited any citizens who wished to speak. There being no citizens recognized who wished to speak the Public Hearing was closed at 7:17 p.m. 6. Consider, Discuss and Possibly Act on A Proposed Final Plat (Corbin Estates II), 19.979 Acres in the A. Lynde Survey, Abstract No. 731, Located East of Sam Bass Road and South of Belz Road. Economic and Community Director Alina Ciocan was recognized to summarize the Proposed Corbin Estates II Final Plat. She noted the property is located in the City's ETJ. It will be subdivided into nine (9) two (2) Acre lots. The lots will be Septic. Denton County has reviewed the plat and made improvement statements that were added to the plat. Staff recommends approval. A motion was made by Councilman Bilyeu to Approve the Final Plat of Corbin Estates II consisting of 19.979 Acres in the A. Lynde Survey, Abstract No.731. Motion was seconded by Councilman Boutwell. Motion carried unanimously (4-0 vote, Councilman Allison Absent). 7. Conduct a Public Hearing Concerning a Minor Plat (Jones Street Addition), 0.173 Acres in the Henry Tierwester Survey, Abstract No. 1241 Located on the West Side of Jones Street, Approximately 400 Feet South of Willow Street. Mayor Muir opened the Public Hearing at 7:20 p.m. and solicited any citizens who wished to speak. Marcus Mathis, 229 Jones Street was recognized. He said he was curious what this is since it is on his street. It was noted it is a plat for a residential home. It was noted that the Lot width noted on the plat was non -conforming. The Minimum Lot Width requirement is Sixty feet (60') and the Lot Width on the Plat is 50 feet (50'). Joe Falls, 4489 McReynolds Road was recognized and advised he has a plan for the home and it is an upgrade. He and Roger Otwell have been working on this for two years and many improvements have been made. He noted this home is an improvement for the area. Jody Roberts was recognized and advised he was here on the annexation item. Mayor Muir advised that the Public Hearing has been Closed for that item; however, he would re- open the Public Hearing at the end of the Agenda to hear Mr. Roberts comments. There being no citizens recognized who wished to speak the Public Hearing was closed at 7:23 p.m. 8. Consider, Discuss and Possibly Act on a Minor Plat (Jones Street Addition), 0.173 Acres in the Henry Tierwester Survey, Abstract No. 1241 Located on the West Side of Jones Street, Approximately 400 Feet South of Willow Street. Economic and Community Director Alina Ciocan was recognized to summarize the Minor Plat of the Jones Street Addition. The proposed plat is on Jones Street and is zoned SF- 10. The proposed lot does not meet the zoning requirements of SF-10 because the width of the lot is 50 feet and the requirement for SF-10 is 60 feet. This is a replat of a lot that is currently 50' wide. The applicant would like to maintain the same width as what was originally platted. The applicant owns the surrounding property and has been advised that future lots will have to conform to the zoning. Councilman Chick asked if the applicant could make it 60 feet instead of 50 feet and just be in compliance. Joe Falls answered; No, this is not a subdivision it is a replat of an old ancient plat and it fits real well. He advised he did increase the lot size from 5500 to 6500 square feet. It is an upscale home for the area. Councilman Chick asked if he could make it deeper why could he not make it wider? Joe Falls answered, to make it simple, he will not, it does not fit the area and does not fit his plans and it doesn't fit the right thing for Sanger. It was set up that way from year one. Mayor Muir advised staff is working with Mr. Falls on this request since it is a replat of an existing 50-foot lot knowing that they will need a variance to build on the lot. Mike Brice advised that if the house is actually built they will have to come back with a variance request to shorten up the setbacks for the house itself. The Subdivision regulations apply regarding the width of the lot. The 6,500-square foot requirement is in the Zoning Regulations and also applies. Councilman Boutwell asked if there is a firm understanding that any future lots need to come in with 60-foot width. It was noted that this has been discussed with Mr. Falls. Councilman Bilyeu noted that if you were looking to improve Sanger at every opportunity that you would try to plat a conforming lot. Joe Falls noted that there are two 50 foot lots south of it that he does not own and there is a flood plain issue there. He noted there are plans for the property but he does not have them laid out. Those plans are changeable. He advised he would work out something nice there, this is nice. He noted there is an error in the survey and it has to be corrected and it is going to require a good deal of effort. Councilman advised that Mr. Falls has made a good faith effort in working with staff. A motion was made by Councilman Clark approving a Minor Plat (Jones Street Addition), 0.173 Acres in the Henry Tierwester Survey, Abstract No. 1241 Located on the West Side of Jones Street, Approximately 400 Feet South of Willow Street. Councilman Boutwell Discussed was if there could be a caveat that this would not be setting a precedent. Mike Brice noted that you could not include that in the motion for the plat, that it would be a decision for a future council. Motion was seconded by Councilman Boutwell. Councilman Bilyeu wanted to note for the record, that the property owner knows that he is building a house in close proximity to the wastewater treatment plant. Motion tied (2-2) with Councilman Clark and Boutwell voting in Favor of the Motion and Councilman Bilyeu and Councilman Chick voting Against the Motion. Mayor Muir voted in Favor of the Motion breaking the tie vote. (Motion Carried 3-2, Councilman Allison Absent) 9. Consider, Discuss and Possibly Act on Soliciting Bids for the Rehabilitation of the Wastewater Treatment Plant. A motion was made by Councilman Bilyeu that the City Act on Soliciting Bids for the Rehabilitation of the Wastewater Treatment Plant. Motion was seconded by Councilman Boutwell. Motion Carried unanimously (4-0 Councilman Allison Absent). Mayor Muir took the opportunity to advise citizens in the audience on the efforts of the City to improve the odor issues at the plant. He also noted that the reason that Council has leaned towards rehabilitation is because the extra cost would be about 14 to 15 million dollars. If you issue a 20-year bond at 3.5 % rate it would be a payment of over 1 million dollars a year. It could produce about a 30% increase in property tax rate. Not saying the math is exact, but it is not a small number but possibly like 25% to 30%. Looking at revenues on wastewater (Sewage Cost) there would over a 60% increase to fund it out of wastewater. He feels it is important that everyone understand that and if anyone is asking why Council has chosen this direction over what seems like a nicer option. We are just trying to use the tax payer dollars most efficiently. Councilman Bilyeu advised that another good point to make is that the rehabilitation will double the capacity of the plant. Building a new plant would not be give us as much of an increase in capacity. Councilman Boutwell noted that he felt the Mayor is very close on his figures. If somebody wanted to write a check for 25 million dollars we would start the plant tomorrow. He noted we have bonds out now for 9 million dollars. We can not exceed this and maintain the good credit standing we have in this city. For those of you that have not attended previous council meetings, we are very good at managing the publics funds to maintain our city. We, in all consciousness, have been trying to do the best we can and still financially watch over the income of our citizens. Councilman Bilyeu added while keeping our effective tax rate the same the last six years, trying to keep our taxes low and doing more with less. 5. Conduct a Public Hearing to Consider the Possible Annexation of Land Located East of Marion Road and North of FM 455. Mayor Muir re -opened the Public Hearing at 7:49 for a citizen in the audience who requested to speak because he arrived after the public hearing closed. Jody Roberts was recognized and said he was over at the old City Hall Building for the meeting. That it has been a long time since he has come to one. He noted his property is in the ETJ being annexed. He has investigated the local government codes. He wanted to know the time frame and was under the impression that it is a three-year process. He said they only received one notice. Director Community and Economic Development Alina Ciocan advised that notices were sent out on December 2nd. Mike Brice noted the City is not using the three-year process. There is an annexation process that is a three-year process. The state allows you to use either process. The three-year process is for larger tracts of land. He was concerned if the City took in his property he would lose his AG Exemption Status and he wants his land to stay Agricultural Exempt and he also has permits with the County to build buildings on his property. Mike Brice advised that we would do a Development Agreement on the property as long as it is not developed. He also noted that if he has a permit to build a building he would be allowed to complete the building as permitted. The Mayor advised that it is a protection for the citizens to have a development agreement or annexation on the properties so that there is more control on what is developed on the properties around them. Things such as future buildings that are not permitted, etc. Councilman Boutwell noted that Denton has annexed to the south side of FM 2153. Mr. Roberts noted he understands and wanted to know if there is any thing in the works to bringing future utilities to the area. Mayor Muir advised that Bolivar Water has the CCN for the area. We can not provide sewer if we don't have the water. It was noted Mr. Roberts could approach Bolivar Water and discuss this with them. Joe Falls, was recognized and said he wanted to give some history. He said that Denton will not encroach Clear Creek because when Jerry Jenkins was here he effectively blocked Denton to 2164. He said they could not cross the creek There was brief discussion regarding Denton acquiring ETJ. The Public Hearing was closed at 8:05 p.m. 10. INFORMATION ITEMS No Information Items. 11. ADJOURN. Signed copy of the Facility Use Agreement 2. Current copy of the using organization's Articles of Incorporation or Bylaw's 3. A list of the organization' Board of Directors, addresses, and their phone number 4. Proof of public liability insurance 5. A current list of every coach, assistant coach, manager, players 6. The final participation registration figures 7. Game and practice schedule, tournaments, clinics, workday, fundraising 8. The Criminal Background Checks are to be completed and written certification to that effect filed with the Parks Director at least ten (10) working days prior to the commencement of the using organizations season. The written certification will contain the names of every coach, assistant coach, manager, umpire, referee, or board member not disqualified as a volunteer. The Criminal Background Check results will not be filed with the City. The league will be solely responsible for conducting and verifying background checks. 9. All concession areas must have a Health Inspection (required by the using organization) completed prior to the opening of the season. 10. **The Board of Directors for each association must set up a meeting with the Parks Director before a request is granted. Discussion of final registration numbers, rosters, and the verification of the above items will be discussed at this time. ***Failure to submit the initial paperwork will result in the denial of use of facilities*** SECTION IL• GENERAL A. City related functions and sports associations will have priority use of SANGER parks and park facilities but not exclusive use of facilities. B. All persons who reserve or use the parks or park facilities will comply with all applicable rules, regulations, and ordinances of the City of SANGER, State of Texas. C. Persons and/or sports associations, who reserve the fields or park facilities, are responsible for cleanup of the fields and facilities after its usage. They are also responsible for repairs or damage to the fields and facilities caused by their use. D. Reservations will be made by a City of SANGER resident, or the parent of a child enrolled in the SANGER School District. Seventy-five percent (75%) of the youth using the facility, recreational and selected groups combined must reside in the City of SANGER or be enrolled in the SANGER School District. E. There must be at least one adult chaperone for every ten youths under the age of 18. F. No alcoholic beverages are permitted at any time in any City Park. SECTION III: CRIMINAL BACKGROUND CHECKS A. The Youths Sports Associations (YSA) that use the City -owned, leased, or controlled fields and facilities ("City Facilities"), are required to conduct criminal background checks for all recognized YSA coaches, assistant coaches, managers, umpires, referees, board members, and any person eighteen (18) years of age or older acting in an official capacity of the YSA. B. The criminal background checks will be performed prior to each season. Each YSA is required to adopt a procedure for Criminal Background Checks. C. Each prospective YSA volunteer will be required to provide the YSA consent (or authorization) to perform the Criminal Background Check and three (3) references that can be contacted. D. In the event the YSA determines it is necessary to disqualify a prospective volunteer or to disqualify a volunteer previously certified to the City as meeting the requirements of the policy, the YSA must notify the person in writing (without stating the details for disqualification). The written notification must also advise the disqualified person of their right to appeal. E. A person disqualified by the YSA or who is pending appeal, is not entitled to participate as a coach, assistant coach, manager, umpire, or referee or serve in any other volunteer position for the YSA in any organized sporting activities in or on any City Facilities unless the disqualification is removed, and the City is notified of such change of status. It is the duty of the YSA to notify the City of the change in status. F. If a person is approved for reinstatement and the season has already begun, that person can participate in that season as determined by the YSA. SECTION IV: SPECIFIC SPORT SEASON A. All sports within any season will be given priority in regard to fields and park facilities allocation and scheduling. Fields and park facilities will be allocated according to participation in the sport for that sports season. The largest participation being allocated the most fields in declining order. B. Other sports shall be considered as the need arises, subject to the following: 1. Field facility availability 2. Allocated maintenance funds 3. Determination by the Parks Department of field/facility capacity to withstand additional play. SECTION V: FACILITY ADMINISTRATION Where possible and practical and in cooperation with the SANGER Independent School District (or any other organization having athletic facilities), the Parks Department will coordinate the use of outdoor facilities. The Parks Department, with the consent of the SANGER School District and other organizations, as applicable, will schedule the use of the fields and or facilities. SECTION VI: FIELD ALLOCATIONS A. The Parks Department will consider all requests for fields or facilities and allocate the available fields or facilities according to the best interests of the City subject to, but not limited to the following criteria: Every effort will be made to allow the use of the facilities and fields only for their designed purposes. 2. Priority will be given to programs accommodated during the previous year. Every effort will be made to accommodate new programs according to facility availability. 3. The Parks Department will, in its sole discretion, allocate the fields and facilities to regular season and tournament play, and may assign more than one organization to a given facility. B. Any organization which desires to organize a new athletic program or enlarge an existing program must meet with the Parks Director at least 90 days prior to the commencement of the season to coordinate the availability of fields or facilities. The using sports organization must meet the criteria outlined in Section I. Failure to meet with the Parks Director will result in the denial of field or facility usage. C. Organizations requiring facilities for practice and/or league games only will submit in writing their final registration figures upon which all field allocations shall be based. In order to maximize use of all fields and facilities, the allocation will be based on the total game units per week per available facilities. SECTION VII: FACILITY MAINTENANCE: A. In the event any individual, team or group uses an available field or facility during a time period other than within the specific sports season, that field or facility will not receive special maintenance but will be subject to general park maintenance. Tournaments, however, are considered an exception and will receive special maintenance, with 30 days prior notice. B. Any special maintenance request in relation to normal league play must be made in writing, and delivered, faxed (940-458-4072), or e-mailed to the Parks Director. The Park Director will need this information at least 48 hours in advance. Examples of special maintenance include: 1. Moving bases or goals 2. Relining fields 3. Removing pitcher mounds and/or rubber C. It will be the responsibility of the Parks Department to determine whether or not the fields or facilities are safe for use. Any individual, team, or group which uses or attempts to use a field or facility which the Parks Department has determined as unsafe, will be denied future use of any field or facility. D. Maintenance of all facilities owned or controlled by the City will be performed by the Parks Department, its agents, or contractors. No modifications, alterations, additions, or deletions temporary or otherwise, may be made to any facility owned, leased, or otherwise controlled by the City unless written approval is first obtained from the Park Director. E. The User of the facility will be responsible for the control and removal of all trash, litter, or other refuse in or on the facility. F. Cleaning of the concession stand and restrooms at the end of the day and the season are the responsibility of the User. The Health Inspector subjects these facilities to inspection. G. In conjunction with the sports season, tournaments, or special events, the City will provide the following: Use of the field or facility Maintenance of all exterior landscape and repairs to the basic structure Mow and trim all fields and non-playing areas of the park at least weekly SECTION VIII: NON-LEAGUE USE SCHEDULING Any group, team, or resident of SANGER or person who attends school in the SANGER School District, may make a request to the Parks Department for the use of available fields or facilities provided the use is recreational and not for profit. Associated fees will apply such as maintenance, lights, etc. SECTION IX: CONCESSIONS A. First choice of operating the concession stand, during requested season play, will be given to each league using the facility, If the User does not want to operate a concession stand, another individual, team or organization will be given the option with preference to non-profit service organizations, such as Jaycees, Lions Club, Chamber of Commerce, Boy Scouts, etc. GUM, TOBACCO, or ALCOHOLIC products of any kind will not be sold at the concession stands. Organizations that use a concession stand are responsible for all concession costs and damages. B. Any vehicle, structure, or equipment used by the User in connection with the operation of the concession stand must comply with all applicable state and local laws and be approved by the Parks Director. All concession vehicles, structures, or other equipment will be removed from the facility each night unless approved by the Parks Director. The City will not be held responsible for damaged, or theft to any vehicle or equipment left at the facility. SECTION X: SCHEDULES A. It is the responsibility of adult or youth league to furnish the Parks Department with a complete league schedule prior to the commencement of each sports season. The Parks Department will be notified in writing of any makeup games. If league schedules and/or written notification of makeup games are not provided to the Parks Department, then the field or facility will not receive special maintenance, and will be subject to general park maintenance. B. The City, at the discretion of the Parks Director, may allow other users of the assigned fields during the term of this contract except when league activity occurs and reserves the right to cancel an activity scheduled for use of the facility. The City will coordinate outside use of the field or facility with the User. The administration of this Agreement will be the responsibility of the Parks Department under the supervision of the Parks Director. The Parks Department is responsible for declaring all necessary rules and regulations concerning the use of field and facilities for each sport as it pertains to maintenance, use, lights, schedules, etc. SECTION XH: SANGER INDEPENDENT SCHOOL DISTRICT (SISD) FACILITIES Any group or individuals using SISD facilities will abide by the SISD administration regulations. SECTION XIH: VIOLATIONS Any breach of the conditions of this agreement will be heard by the Park Director after all viable options in each association's by-laws appeal process have been exhausted. All groups or organizations utilizing recreation facilities owned or controlled by the City for competitive league play must be incorporated as a nonprofit organization by the Internal Revenue Service with an active Board of Directors, including a President or Chairperson, Vice President, Secretary, and Treasurer. All members of each group or organization's Executive Board of Directors must reside within the city limit of SANGER or the boundaries of the SANGER School District. The Board Members must provide the City of SANGER with valid proof of residency. The president of each association will be responsible for the regulation of this agreement. Members who move out of the boundaries may finish their term if bylaws permit. The User agrees to provide and maintain in effect during the term of this agreement the following insurance amounts: Workers' Compensation Insurance (for paid employees) as required by law; Employer's Liability Insurance in an aggregate amount of not less than: $100,000 — Each Accident $500,000 Disease — Policy Limit $100,000 Disease — Each Employee Texas and/or All State's Endorsement attached. Comprehensive General Liability Insurance with not less than the following limits: $2,000,000 — General Aggregate $1,000,000 — Products/Completed Operations Aggregate $500,000 — Personal and Advertising Injury Limit $500,000 — Each Occurrence Limit $50,000 — Fire Legal Liability $5,000 — Premises Medical Payments Using organization agrees that with respect to the required insurance, the City will: Be named as additional insured under the General Liability policy. Have a Waiver of Subrogation issued favoring the City on the General Liability. Be provided with thirty- (30) days advance written notice of cancellation or material change. Be provided with Certificates of Insurance evidencing the above insurance requirement, prior to the commencement of the Agreement and thereafter with certificates evidencing renewals or replacements of said policies of insurance at least fifteen (15) days prior to the expiration or cancellation of any such policies. The Using organization agrees to indemnify and hold harmless the City, its officers, agents, and employees (City") from and against any and all claims, demands, actions, damages, losses, costs, liabilities, expenses, and judgments including death ("Claims"), recovered from or asserted against the City for personal injury, court costs, or damage to persons or property incident to, arising out of, or caused, directly or indirectly, in whole or in part, by an act, omission, negligence, or misconduct by the Using organization or any of its agents, servants, employees, contractors, patrons, guests, or invitees whether based upon the alleged joint and/or concurrent negligence of the City and Using organization arising out of the incident to Using organization's use of the facilities covered by this Agreement. 2. Force Maieure. If Facilities or any portion thereof are destroyed or damaged by fire or another calamity so as to prevent the use of Facilities for the purposes intended and during periods specified by this Agreement, or if the use of the Facility by the Using Organization will be prevented by an act of God, strike, lockout, material or labor restrictions by any governmental authority, civil riot, flood, or any other cause beyond the control of the City, then this Agreement will terminate. The City will not be liable or responsible to the Using Organization for any damages caused thereby, and the Using Organization hereby waives any claim against the City for damages by reason of such termination. 3. Governing Law. The validity of this Agreement and any of its terms and provisions as well as the rights and duties of the parties shall be governed by the laws of the State of Texas; and venue for any action concerning this Agreement shall be in Court of Denton County, Texas 4. Termination. This agreement may be terminated by either party by providing the other Party with thirty-(30) day's prior written notice of termination. 5. Notice. Any notice required or permitted to be delivered hereunder shall be deemed received when sent in the United States Mail, Postage Prepaid, Certified Mail, Return Receipt Requested, or by hand delivery or facsimile transmission addressed to the respective party at the address set forth opposite the signature of the party. 6. Severability. In the event any section, subsection paragraph, sentence, phrase, or word herein is held invalid, illegal, or unconstitutional, the balance of the Agreement shall stand, shall be enforceable, and shall be read as if the parties intended at all times to delete said invalid section, subsection, paragraph, sentence, phrase, or word. 7. List of Supporting Documents/Exhibits Attached: Prior Action/Review by Council, Boards, Commissions or Other Agencies: • Development Agreement None • Aerial Photo of Subject Area STATE OF TEXAS COUNTY OF DENTON DEVELOPMENT AGREEMENT This Agreement is entered into by and between the City of Sanger, Texas (the "City") and the undersigned property owner(s) (individually and collectively, the "Owner"). The term "Owner" includes all owners of the Property. WHEREAS, the Owner owns a parcel of real property (the "Property") in Denton County, Texas, which is more particularly and separately described in the attached Exhibit "A" (Legal Description or Tax Record); and WHEREAS, the City has begun the process to institute annexation proceedings on all or portions of the Property; and WHEREAS, the Property has been appraised by the Denton County Appraisal District for ad valorem tax purposes as land for agricultural uses under Chapter 23, Tax Code, and Owner desires to have the Property remain in the City's extraterritorial jurisdiction, in consideration for which the Owner agrees to enter into this Development Agreement; and WHEREAS, this Agreement is entered into pursuant to Sections 43.035 and 212.172 of the Texas Local Government Code, in order to address the desires of the Owner and the procedures of the City; and WHEREAS, the Owner and the City acknowledge that this Agreement is binding upon the City and the Owner and their respective successors and assigns for the term (defined below) of the Agreement; and WHEREAS, the Development Agreement is to be recorded in the Real Property Records of Denton County. NOW, THEREFORE, in consideration of the mutual covenants contained herein, the parties hereto agree as follows: Section 1. The City guarantees the continuation of the extraterritorial status of the Owner's Property, its immunity from annexation by the City, and its immunity from City property taxes, for the term of this Agreement, subject to the provisions of this Agreement. Except as provided in this Agreement, the City agrees not to annex the Property, agrees not to involuntarily institute proceedings to annex the Property, and further agrees not to include the Property in a statutory annexation plan for the Term of this Agreement. However, if the Property is annexed pursuant to Page 1 of 4 Development Agreement the terms of this Agreement, then the City shall provide services to the Property pursuant to the Service Plan approved in the ordinance annexing the Property. Section 2. The Owner acknowledges that each and every Owner of the Property must sign this Agreement in order for the Agreement to take full effect, and each Owner who signs this Agreement covenants and agrees, jointly and severally with the other Owners, to indemnify, hold harmless, and defend the City against any and all legal claims, by any person claiming an ownership interest in the Property who has not signed the Agreement, arising in any way from the City's reliance on this Agreement. Section 3. The City is authorized to enforce all of the City's regulations and planning authority that do not materially interfere with the agricultural use of the Property. The City states and specifically reserves its authority pursuant to Chapter 251 of the Texas Local Government Code to exercise eminent domain over property that is subject to a Chapter 43 and/or Chapter 212 development agreement. Section 4. The term of this Agreement (the "Term") shall be ten (10) years from the date that the Mayor's signature to this Agreement is acknowledged before a notary public, provided however that the provisions of this Agreement that restrict or otherwise limit the annexation of all or part of the Property shall be void if the Owner, his heirs, successors or assigns, files any type of subdivision plat or related development document for the Property with a governmental entity that has jurisdiction over the Property, regardless of how the Property is appraised for ad valorem tax purposes. Section S. The Owner, and all of the Owner's heirs, successors and assigns shall be deemed to have filed a petition for voluntary annexation before the end of the Term, for annexation of the Property to be completed on or after the end of the Term. Prior to the end of the Term, the City may commence the voluntary annexation of the Property. In connection with annexation pursuant to this section, the Owner hereby waives any vested rights he may have under Section 43.002(a) (2) of the Texas Local Government Code that would otherwise exist by virtue of any plat of construction the Owner may initiate during the time between the expiration of this Agreement and the institution of annexation proceedings by the City. This Agreement is not a "permit" for purposes of Chapter 245 of the Local Government Code. Section 6. Property annexed pursuant to this Agreement will initially be zoned as provided by the City Comprehensive Zoning Ordinance, pending determination of the Property's permanent zoning. Section 7. Any person who sells or conveys any portion of the Property shall, prior to such sale of conveyance, give written notice of this Agreement to the prospective purchaser of grantee, and shall give written notice of the sale or conveyance to the City. Furthermore, the Owner and the Owner's heirs, successors, and assigns shall give the City written notice within 14 days of any change in the agricultural exemption status of the Property. Failure to do so shall not be deemed a waiver to enforce the provisions of this Agreement thereafter. Section 11. No subsequent change in the law regarding annexation shall affect the enforceability of this Agreement of the City's ability to annex the properties covered herein pursuant to the terms of this Agreement. Section 12. Venue for this Agreement shall be in Denton County, Texas. Section 13. This Agreement may be separately executed in individual counterparts and, upon execution, shall constitute one and the same instrument. Section 14. The City extended to the property owners the opportunity to enter into a development agreement in lieu of annexation. If authorized by City Council, the agreement will delay the annexation of the property for 10 years and authorize the City to enforece land use regulations on the property during that period. List of Supporting Documents/Exhibits Attached: Prior Action/Review by Council, Boards, Commissions or Other Agencies: • Development Agreement None • Aerial Photo of Subject Area STATE OF TEXAS COUNTY OF DENTON DEVELOPMENT AGREEMENT This Agreement is entered into by and between the City of Sanger, Texas (the "City") and the undersigned property owner(s) (individually and collectively, the "Owner"). The term "Owner" includes all owners of the Property. WHEREAS, the Owner owns a parcel of real property (the "Property") in Denton County, Texas, which is more particularly and separately described in the attached Exhibit "A" (Legal Description or Tax Record); and WHEREAS, the City has begun the process to institute annexation proceedings on all or portions of the Property; and WHEREAS, the Property has been appraised by the Denton County Appraisal District for ad valorem tax purposes as land for agricultural uses under Chapter 23, Tax Code, and Owner desires to have the Property remain in the City's extraterritorial jurisdiction, in consideration for which the Owner agrees to enter into this Development Agreement; and WHEREAS, this Agreement is entered into pursuant to Sections 43.035 and 212,172 of the Texas Local Government Code, in order to address the desires of the Owner and the procedures of the City; and WHEREAS, the Owner and the City acknowledge that this Agreement is binding upon the Ciry and the Owner and their respective successors and assigns for the term (defined below) of the Agreement, and WHEREAS, the Development Agreement is to be recorded in the Real Property Records of Denton County. NOW, THEREFORE, in consideration of the mutual covenants contained herein, the parties hereto agree as follows: Section 1. The City guarantees the continuation of the extraterritorial status of the Owner's Property, its immunity from annexation by the City, and its immunity from City property taxes, for the term of this Agreement, subject to the provisions of this Agreement. Except as provided in this Agreement, the City agrees not to annex the Property, agrees not to involuntarily institute proceedings to annex the Property, and further agrees not to include the Property in a statutory annexation plan for the Term of this Agreement. However, if the Property is annexed pursuant to Page 1 of 4 Development Agreement the terms of this Agreement, then the City shall provide services to the Property pursuant to the Service Plan approved in the ordinance annexing the Property. Section 2. The Owner acknowledges that each and every Owner of the Property must sign this Agreement in order for the Agreement to take full effect, and each Owner who signs this Agreement covenants and agrees, jointly and severally with the other Owners, to indemnify, hold harmless, and defend the City against any and all legal claims, by any person claiming an ownership interest in the Property who has not signed the Agreement, arising in any way from the City's reliance on this Agreement. Section 3. The City is authorized to enforce all of the City's regulations and planning authority that do not materially interfere with the agricultural use of the Property. The City states and specifically reserves its authority pursuant to Chapter 251 of the Texas Local Government Code to exercise eminent domain over property that is subject to a Chapter 43 and/or Chapter 212 development agreement. Section 4. The term of this Agreement (the "Term") shall be ten (10) years from the date that the Mayor's signature to this Agreement is acknowledged before a notary public, provided however that the provisions of this Agreement that restrict or otherwise limit the annexation of all or part of the Property shall be void if the Owner, his heirs, successors or assigns, files any type of subdivision plat or related development document for the Property with a governmental entity that has jurisdiction over the Property, regardless of how the Property is appraised for ad valorem tax purposes. Section 5. The Owner, and all of the Owner's heirs, successors and assigns shall be deemed to have filed a petition for voluntary annexation before the end of the Term, for annexation of the Property to be completed on or after the end of the Term. Prior to the end of the Term, the City may commence the voluntary annexation of the Property. In connection with annexation pursuant to this section, the Owner hereby waives any vested rights he may have under Section 43.002(a) (2) of the Texas Local Government Code that would otherwise exist by virtue of any plat of construction the Owner may initiate during the time between the expiration of this Agreement and the institution of annexation proceedings by the City. This Agreement is not a "permit" for purposes of Chapter 245 of the Local Government Code. Section 6. Property annexed pursuant to this Agreement will initially be zoned as provided by the City Comprehensive Zoning Ordinance, pending determination of the Property's permanent zoning. Section 7. Any person who sells or conveys any portion of the Property shall, prior to such sale of conveyance, give written notice of this Agreement to the prospective purchaser of grantee, and shall give written notice of the sale or conveyance to the City. Furthermore, the Owner and the Owner's heirs, successors, and assigns shall give the City written notice within 14 days of any change in the agricultural exemption status of the Property. No subsequent change in the law regarding annexation shall affect the enforceability of this Agreement of the City's ability to annex the properties covered herein pursuant to the terms of this Agreement. (7) In the case of personal injury or death, the names and addresses of all persons who, according to the knowledge or information of the claimant witnessed the happening of the injury or any part thereof and the names of the doctors, if any, to whose care the injured person is committed. (8) In the case of property damage, the location of the damaged property at the time the claim was submitted along with the names and addresses of all persons who witnessed the happening of the damage or any part thereof. Sec. 1.602 Claim Shall Furnish Addresses The person giving notice under this Article shall give the address of every place the claimant has resided during the last six (6) months prior to the injury, death, or damage and shall subscribe the claimant's name thereto. Neither the Mayor, Councilmember, City Manager, City Secretary, City Attorney, or any other officer or employee of the City shall have authority to waive any of the provisions of this Article, but the same may be waived only by resolution of the Council made and passed before the expiration of said six (6) months' period. Sec. 1.603 Serving of Notice All notices required by this article shall be effectuated by serving them upon the City Secretary at the following physical location: 502 Elm Street. All such notices shall be effective only when actually received in the office of the person named above. SECTION 2. All ordinances of the City of Sanger in conflict with the provisions of this ordinance shall be, and the same are hereby repealed. SECTION 3. Should any word, sentence, paragraph, subdivision, clause, phrase or section of this ordinance or of the Code of Ordinances, as amended hereby, be adjudged or held to be void or unconstitutional, the same shall not affect the validity of the remaining portions of said ordinance or the Code of Ordinances, as amended hereby, which shall remain in full force and effect. SECTION 4. A claim for an injury, death, or damage occurring before the effective date of this ordinance is governed by prior law and the provisions of the Code of Ordinances, as amended, in effect at the time of such injury, death, or damage, and the former law is continued in effect for this purpose. SECTION 5. This ordinance shall take effect immediately from and after its passage and publication of the caption as required by law. The City only invests in Money Market accounts and Certificates of Deposit. Interest is paid monthly on all accounts. Therefore, book value and market value are the same and the City does not have accrued interest on its investments. Ethics Disclosure and Conflicts of Interest In accordance with the PFIA, investment officers are required to file a disclosure statement with the Texas Ethics Commission and the governing body if: a. the officer has a business relationship with a business organization offering to engage in an investment transaction with the City (as defined in 2256.005 (i) (1-3); or b. the officer is related within the second degree by affinity or consanguinity, as determined under Chapter 573 of the Texas Government Code, to an individual seeking to transact investment business with the entity.
