AN ORDINANCE AMENDING CHAPTER 10, SECTION 4 OF THE CODE
OF ORDINANCES OF THE CITY OF SANGER, TEXAS, ENTITLED
SEWER SERVICE RATES, ESTABLISHING NEW SEWER RATES
INSIDE AND OUTSIDE THE CITY LIMITS, ESTABLISHING RATES
FOR MULTI -FAMILY DWELLINGS; PROVIDING FOR REPEAL OF
ORDINANCES IN CONFLICT; PROVIDING A SEVERABILITY
CLAUSE; PROVIDING FOR AN EFFECTIVE DATE; AND PROVIDING
FOR A PENALTY FOR VIOLATION.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SANGER, TEXAS:
SECTION I
THAT ORDINANCE #85-12 WHICH IS IN CONFLICT IS HEREBY REPEALED
AND THAT CHAPTER 10, SECTION 4 OF THE SANGER CODE OF ORDINANCES IS
HEREBY AMENDED TO READ AS FOLLOWS:
SECTION 4: SEWER SERVICE RATES
The rates to be charged by the city for sanitary sewer
service are hereby established as set forth in this section.
A. INSIDE THE CITY LIMITS
A user classification is hereby established for all
users of the municipal wastewater facilities inside
the city limits of Sanger, Texas, as follows:
User Classification: Class A: Residential Users
Class Be Commercial Users
Class A users shall include all residential type
users including, but not limited to, residences,
apartment units, trailer court units, duplexes, or
any other service primarily intended for domestic
or residential type use. The city may include
small office buildings, churches, and other
low volume (similar to domestic volume) users in
Class A.
Class B users shall include commercial users, such
as but not limited to, restaurants, cafes, car washes,
schools, hospitals, nursing homes, offices, hotels,
motels, laundries, grocery stores, department stores,
etc., not included in Class A.
\i All Class A users of municipal facilities shall be
charged a minimum of $8.00 per month, plus a charge
of $0.60 per 1000 gallons of metered water consumption
in excess of 1000 gallons. All Class B users of
municipal facilities shall be charged a minimum
of $14.00 per month plus a charge of $0.60 per 1000
gallons of metered water consumption in excess of
1000 gallons. The water consumption to be used to
establish sewer billings shall be the actual water
consumption for each customer during the month of the
previous year exhibiting the lowest city wide water
use so as not to account for water used for such
purposes as lawn and garden watering from which
water is not returned to wastewater facilities.
New connections to the system shall be billed at the
average city wide sewer billing rate for each customer
during the month for the respective class of use until
which time a rate can be established based upon actual
use.
B. OUTSIDE THE CITY LIMITS
Same as subsection A above, except that the monthly
billing calculated thereunder will be multiplied by
two hundred percent (200%).
C. MULTI -FAMILY DWELLINGS
The amount due for multi -family dwellings shall be the
residential rate multiplied by the number of occupied
dwelling units.
SECTION II
All Ordinances or parts of Ordinances in conflict herewith
are, to the extent of such conflict, hereby repealed.
SECTION III
It is hereby declared to be the intention of the City
Council that the sections, paragraphs, sentences, clauses,
and phrases of this Ordinance are severable and, if any
phrase, clause, sentence, paragraph, or section of this
Ordinance shall be declared unconstitutional by the valid
judgment or decree of any court of competent jurisdiction,
such unconstitutionality shall not affect any of the
remaining phrases, clauses, sentences, paragraphs, and
sections of this Ordinance, since the same would have been
enacted by the City Council without the incorporation in
this Ordinance of any such unconstitutional phrase, clause,
sentence, paragraph, or section.
SECTION IV
Whenever in this Ordinance an act is prohibited or is made
or declared to be unlawful or an offense or a misdemeanor,
or wherever in such Ordinance, the doing of an act is
required or the failure to do any act is declared to be
unlawful, the violation of any such provision shall be
punished by a fine of not exceeding One Thousand ($1000.00)
Dollars; provided, however, that no penalty shall be
greater or less than the penalty provided for the same or
similar offense under the laws of the State. Each day
any violation of this Ordinance shall continue shall
constitute a separate offense.

SECTION V
This Ordinance will take effect immediately from and after
its passage and the publication of the caption as the
law in such cases provides.

11. Consider and Possible Action Regarding average of Low
Three months for sewer rates.
Mayor Armstrong stated that if this ordinance was passed
it would mean an additional charge for the program to'
the computer to calculate this charge.
Steve_.Shutt recommended that the City Council not approve
this increase due to the fact that if the 3 months were
considered it would actually mean an increase for the user.
He.also-stated that'the sewer rates had already been
increased several months ago.
Carroll McNeill made the motion that we accept staff s
recommendation. Jerry Jenkins seconded. Motion carried.
