MINUTES: EMERGENCY CITY COUNCIL MEETING
September 28, 2012
PRESENT: Mayor Thomas Muir, Councilman Billy Ezell, Councilman Russell Martin and
Councilman Scott Stephens

1. Call Meeting to Order, Invocation, Pledge of Allegiance.
Mayor Muir called the meeting to order at 8:04 a.m. Councilman Stephens led the
Invocation followed by Councilman Ezell leading the Pledge of Allegiance.
REGULAR AGENDA
City Manager advised that the Council must pass the budget before the September 30,
2012 deadline. Previous meetings lacked a quorum, that is the reason for this
emergency called meeting.
2. Consider, Discuss and Possibly Act on Approving Ordinance #09-13-12 - Adopting the
Budget Providing for the Appropriation of Funds for Operating and Capital
Expenditures by Fund for the Fiscal Year Beginning October 1, 2012 and Ending
September 30, 2013 and Providing for the Intra and Inter Department and Fund
Transfers.
Councilman Mai -tin made a motion to approve. Seconded by Councilman Stephens.
Motion carried unanimously.
3. Consider, Discuss and Possibly Act on Ratifying the Tax Increase.
City Manager advised that the Council needed to make a motion to ratify the tax
increase.
Councilman Stephens made a motion to approve. Seconded by Councilman Martin.
Motion carried unanimously.
4. Consider, Discuss and Possibly Act on Approving Ordinance #09-14-12 - Levying a
Tax Rate for the General Government for the Fiscal Year 2012-2013 at a Rate of
$0.633049 per $100 Assessed Valuation.
Councilman Martin made a motion to approve. Seconded by Councilman Ezell.
Motion carried unanimously.
5. Consider, Discuss and Possibly Act on Approving Ordinance #09-15-12 - to Approve
the 2012 Tax Roll.
Councilman Stephens made a motion to approve. Seconded by Councilman Martin.
Motion carried unanimously.

Matthews, Steve Watkins, Roger Ballas and John Harden
1. Call Meeting to Order.
Mayor Muir called the meeting to order at 6:06 p.m.
2. Discuss Animal Shelter Issues.
City Manager advised that the contract with Noah's Ark will end on October 20,
2012.
Bob Matthews with All American Dogs located in Pilot Point, spoke to Council and
answered questions.
The contract will begin on November 1, 2012
The City of Sanger's Animal Control Officer will attempt to contact the owner of
any stray animal picked up prior transporting to All American Dogs.
Scope of services include impoundment and boarding for not less than 5 days and a
monthly report to the City for a monthly fee of $3,400. The City will also provide
$21,500 to All American Dogs to accommodate Sanger's animals.
The monthly cost does not include quarantine fees, specimen shipment fees, medical
or veterinary fees as needed other than euthanasia or fees necessary for adoption.
3. Discuss Potential Amendment to the Sign Ordinance, Permitting Additional Signage
for Businesses Near the Intersection of Interstate 35 and FM/455 Chapman Road.
Joe Iliff briefed the Council regarding the current sign ordinance and discussed the
current allowable signage in business and agricultural zoning. The current
ordinance does not allow signage to be placed above roof lines.
Steve Watkins, from Fuzzy's Taco, was present and would like the ordinance
changed so that they can have additional signage than what is currently allowed.
Joe Iliff will bring this item back to Council at the next work session.

Councilman Stephens made a motion to approve the contract with the amendments
of prorating the first 12 months and return of the cat "condos" in the event that All
American Dogs terminates the contract.
Seconded by Councilman Martin. Motion carried unanimously.

The Sign Ordinance describes in Section 3.1407 the allowable signage in Business and Agricultural
Zoning Districts. Businesses are permitted to have both attached and detached signage. The Sign
Regulations do not permit attached signage to be placed above the roof line. (§3.1407 a 2)
Staff has received requests for increasing the allowable signage for properties near the intersection of
Interstate 35 and FM 455, but not directly fronting either thoroughfare. At the worksession on October
1, Staff presented the idea to City Council to expand the signage allowance within an area around the I-
35 & FM 455 intersection for properties that do not front directly on either thoroughfare.
The proposed ordinance amends the Sign Regulations to.
1. Create a Regional Commercial District: Shown on the attached map, these sign allowances
would apply only to this area. Roughly the area is from 10th Street to Acker Street, and Pecan
Street to the 5th Street — I-35 merge.
2. Properties that do not have frontage on either I-35 or FM 455 would be permitted to install
signage to a maximum of 10 feet above the roof or the height of the parapet, whichever is
greater.
3. Businesses would also be permitted to place the detached non -pylon signage they are permitted
on an adjacent site that fronts on either thoroughfare with the agreement of the owner.

AN ORDINANCE OF THE CITY OF SANGER, DENTON COUNTY, TEXAS,
AMENDING THE SIGN REGULATIONS; PROVIDING FOR THE REPEAL OF ALL
ORDINANCES IN CONFLICT; PROVIDING FOR A SEVERABILITY CLAUSE;
PROVIDING FOR A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO
THOUSAND DOLLARS ($2,000.00) FOR EACH OFFENSE; AND PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, The area around the intersection of Interstate 35 and Farm -to -Market Road 455
features businesses intending to serve people traveling through the region on these major
thoroughfares;
WHEREAS, Many properties in this area do not have direct frontage on either thoroughfare;
and
WHEREAS, These properties may have to relocate their allowed signage to achieve the same
degree of visibility as with other properties within the area; Now Therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SANGER, TEXAS:
Section 1. The following section is added to Article 3.14 Sign Regulations of the
City of Sanger Code of Ordinances:
Sec. 3.1414 Regional Commercial District
The regional commercial district is the area surrounding the intersection of
Interstate 35 and Farm -to -Market Road 455, as shown on the attached map.
1. Properties that do not have frontage on either I-35 or FM 455 are permitted
to install their attached signage up to a maximum of 10 feet above the roof
of the building or the height of the parapet, whichever is greater.
2. Businesses are permitted to place their allowed non -pylon detached signage
on an adjacent site that fronts on either thoroughfare with the agreement of
the adjacent property's owner. The agreement with the adjacent property's
owner most be demonstrated in writing and submitted to the Building
Official along with the required permits for the sign or signs.
Section 2. All ordinances or parts of ordinances in conflict herewith are, to the
extent of such conflict, hereby repealed.
Section 3. It is hereby declared to be the intention of the City Council that the
sections, paragraphs, sentences, clauses, phrases and words of this Ordinance are severable
and, if any word, phrase, clause, sentence, paragraph, or section of this Ordinance shall be
declared unconstitutional by the valid judgment or decree of any court of competent
jurisdiction, such unconstitutionality shall not affect any of the remaining portions of this
Ordinance, since the same would have been enacted by the City Council without the
incorporation in this Ordinance of any such unconstitutional word, phrase, clause, sentence,
paragraph, or section.
Section 4. Any person, firm, or corporation who shall violate any of the
provisions of this article shall be guilty of a misdemeanor and upon conviction shall be fined
in an amount not to exceed the sum of two thousand dollars ($2,000.00) for each offense, and
each and every day such offense shall continue shall be deemed to constitute a separate
offense.
Section 5. This ordinance will take effect immediately from and after its passage
and the publication of the caption, as the law and Charter in such cases provide.

The Zoning Ordinance permits the installation of a mobile home as a fixed dwelling in an A
Agricultural District with a Specific Use Permit (SUP). The applicant is proposing to install a
manufactured house behind the existing structure and occupy it as a dwelling unit. The applicant is
proposing to continue to occupy the existing building as an office.
STAFF OPTIONS & RECOMMENDATION
Staff finds that the proposed installation of the manufactured house as a mobile home as a fixed
dwelling on the property meets the criteria of the Zoning Ordinance for being harmonious with adjacent
properties and uses. Staff also finds that the property provides adequately for the use. Staff
recommends approval of the proposed Specific Use Permit.

RE: Mobile home at 11754 Metz Road
To Whom It May Concern:
I have owned the property at 11754 Metz Road for almost 13 years. When the house was
purchase it was considered outside the city limits. Within the last year or so my parent's
property (11698 Metz Road/next door) and my property were brought into the city limits.
This property was my second residence.
On July 31, 2012 a hearing took place regarding divorce proceedings for my husband and
myself. The judge in the case decided that since my husband owned the residence in Gainesville
that we had been living at prior to our marriage, my two children and I had to leave the property.
She gave me two weeks. I scramble to find a solution as the house at 11754 Metz Road had only
two bedrooms and one bath and was not suitable for us to reside in. So I decided to buy a new
mobile home and place it on the property behind the existing house. I felt like it would save me
money as I could tie into the water and sewer that were already there.
My parent's will be retiring within the next five years and we will be selling both of the
properties. The mobile home seemed like a great way to have what I needed at this time and
have something to utilize later after we moved just in case we need to build. So I went ahead
and made the purchase and had the house dropped. I finally felt like things were going to be
okay through all the divorce issues and time restraints.
When I went to have the electricity hooked up I was informed that I had made a huge error.
They told me that I was in violation of a city ordinance stating I could not place a mobile home
in the city without authorization.
I would like to apologize for my lack of knowledge about the city rules and understand that I
should check now regarding constructions or new additions to my property. I have always lived
out of the city limits and did not consider at the time that there would be any restrictions.
Therefore, I would like to request that you please allow me to keep the home that I have
purchased for myself and my two children on the property at 11754 Metz Road. The home
should only be there for a few years and will be removed upon my sale of the residence at 11754
Metz Road. I have also submitted a Specific Use Permit (SUP) with the city for this fixed
dwelling. Please see pictures of the house on the following page.

WHEREAS, all Requests for Changes in Zoning Classifications were duly filed with the City
of Sanger, Texas, concerning the hereinafter described properties;
WHEREAS, due notice of hearings were made in the time and manner prescribed by law and
the Planning and Zoning Commission of the City of Sanger, Texas, duly covered and
conducted public hearings for the purpose of assessing zoning classification changes on the
hereinafter described properties located in the City of Sanger, Texas; and
WHEREAS, an additional opportunity for all interested persons to be heard was provided by
the City Council of the City of Sanger, Texas, at open meetings, with proper notice posted;
Now Therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SANGER, TEXAS:
Section 1. That the legal description of the property zoned herein is generally
described as Tract 7 of the Henry Tierwester Survey.
Section 2. A Specific Use Permit (SUP) for a Mobile Home as a Fixed Dwelling
in an A Agricultural District, subject to the following conditions:
1. TheSUP expires seven years from issuance
2. The SUP expires if the property is rezoned from A Agricultural District to another
district.
3. The SUP expires if the property is subdivided.
4. The SUP expires if the owner removes the manufactured dwelling unit.
Section 3. All ordinances or parts of ordinances in conflict herewith are, to the
extent of such conflict, hereby repealed.
Section 4. It is hereby declared to be the intention of the City Council that the
sections, paragraphs, sentences, clauses, phrases and words of this Ordinance are severable
and, if any word, phrase, clause, sentence, paragraph, or section of this Ordinance shall be
declared unconstitutional by the valid judgment or decree of any court of competent
jurisdiction, such unconstitutionality shall not affect any of the remaining portions of this
Ordinance, since the same would have been enacted by the City Council without the
incorporation in this Ordinance of any such unconstitutional word, phrase, clause, sentence,
paragraph, or section.
Section 5. Any person, firm, or corporation who shall violate any of the
provisions of this article shall be guilty of a misdemeanor and upon conviction shall be fined
in an amount not to exceed the sum of two thousand dollars ($2,000.00) for each offense, and
each and every day such offense shall continue shall be deemed to constitute a separate
offense.
Section 6. This ordinance will take effect immediately from and after its passage
and the publication of the caption, as the law and Charter in such cases provide.

BACKGROUND/SUMMARY OF ITEM
The subject area is approximately 1.246 acres, part of Sullivan West Block 15. The subject property is
located at the northeast corner of 10th Street and Plum Street. The property is zoned MF-2 Multi -
Family District on the Official Zoning Map.
The applicant is requesting to rezone the property into the B-2 Business District 2. The adjacent
properties to the north and east are within an I-1 Industrial District. The properties across 101h Street to
the west are zoned B-2 Business District 2. The properties to the south are zoned SF-8 Single -Family
Residential District. The Future Land Use Map designates the area for commercial land uses.
STAFF OPTIONS & RECOMMENDATION
Staff finds that the proposed rezoning satisfies the criteria listed in the Zoning Ordinance for being
rezoned from the MF-2 Multi -family District to B-2 Business District 2. Staff recommends approval of
the proposed rezoning.
Staff mailed out 14 notices of this public hearing. At the time of this report, Staff had not received any
response forms indicating support for of opposition to the proposed rezoning.

HIGHLIGHTS:
Friends of the Library had their annual Book Sale at the Selebration.
ADMINISTRATION:
Received the Interlocal Agreement from Denton County. Overall, the county cut library
finding by 10% this year, but because Frisco declined County finding, Sanger will be getting
$15,810. Last year we got $15,007. On the down side, that eliminates another large library
willing to serve our citizens when they needed it.
Started pulling information that will be needed for the annual report.

Introduction to News Bank Webinar, 9/13
Denton County Library Advisory Board, 9/19, Little Elm
CIRCULATION:
Took a new set of book to the Senior Center.
COLLECTION:
Recent yearbooks from Sanger High School were donated. We now have 37 annuals
from 1940 to 2010.
SPECIAL PROJECTS:
Golden Triangle Fire Protection repaired and upgraded the fire sprinkler system.
PROGRAMS:
Adult programs held: Fall Gardening, four bilingual classes on Nutrition, two Knitting
and Crochet workshops, and the book club meeting.
"Wild Animals" was the theme for Storytime in September. The children made a
monkey tree with paper towel rolls at the "Monkeys" program. The monkeys were made of
peanut shells. For the "Elephants" program, kids made an elephant head with a working trunk
(out of a paper cup and a straw). Then we went outside and squirted water with our trunks. At
the "Big Cats" program, kids made a lion puppet to use with a finger play: "A lion is knocking at
my door. Hello, lion ... ROARRRR". The final program was "Wolves, Foxes and Coyotes".
Using large appliance boxes, kids decorated the three little pigs' houses. The houses will be in
the children's area during October for children to play in.
