MINUTES: EMERGENCY CITY COUNCIL MEETING September 28, 2012 PRESENT: Mayor Thomas Muir, Councilman Billy Ezell, Councilman Russell Martin and Councilman Scott Stephens ABSENT: Councilman Bilyeu and Councilman Rusty Patton OTHERS PRESENT: Mike Brice City Manager, Tami Taber City Secretary 1. Call Meeting to Order, Invocation, Pledge of Allegiance. Mayor Muir called the meeting to order at 8:04 a.m. Councilman Stephens led the Invocation followed by Councilman Ezell leading the Pledge of Allegiance. REGULAR AGENDA City Manager advised that the Council must pass the budget before the September 30, 2012 deadline. Previous meetings lacked a quorum, that is the reason for this emergency called meeting. 2. Consider, Discuss and Possibly Act on Approving Ordinance #09-13-12 - Adopting the Budget Providing for the Appropriation of Funds for Operating and Capital Expenditures by Fund for the Fiscal Year Beginning October 1, 2012 and Ending September 30, 2013 and Providing for the Intra and Inter Department and Fund Transfers. Councilman Mai -tin made a motion to approve. Seconded by Councilman Stephens. Motion carried unanimously. 3. Consider, Discuss and Possibly Act on Ratifying the Tax Increase. City Manager advised that the Council needed to make a motion to ratify the tax increase. Councilman Stephens made a motion to approve. Seconded by Councilman Martin. Motion carried unanimously. 4. Consider, Discuss and Possibly Act on Approving Ordinance #09-14-12 - Levying a Tax Rate for the General Government for the Fiscal Year 2012-2013 at a Rate of $0.633049 per $100 Assessed Valuation. Councilman Martin made a motion to approve. Seconded by Councilman Ezell. Motion carried unanimously. 5. Consider, Discuss and Possibly Act on Approving Ordinance #09-15-12 - to Approve the 2012 Tax Roll. Councilman Stephens made a motion to approve. Seconded by Councilman Martin. Call Meeting to Order. Mayor Muir called the meeting to order at 6:06 p.m. 2. Discuss Animal Shelter Issues. City Manager advised that the contract with Noah's Ark will end on October 20, 2012. Bob Matthews with All American Dogs located in Pilot Point, spoke to Council and answered questions. The contract will begin on November 1, 2012 The City of Sanger's Animal Control Officer will attempt to contact the owner of any stray animal picked up prior transporting to All American Dogs. Scope of services include impoundment and boarding for not less than 5 days and a monthly report to the City for a monthly fee of $3,400. The City will also provide $21,500 to All American Dogs to accommodate Sanger's animals. The monthly cost does not include quarantine fees, specimen shipment fees, medical or veterinary fees as needed other than euthanasia or fees necessary for adoption. 3. Discuss Potential Amendment to the Sign Ordinance, Permitting Additional Signage for Businesses Near the Intersection of Interstate 35 and FM/455 Chapman Road. Joe Iliff briefed the Council regarding the current sign ordinance and discussed the current allowable signage in business and agricultural zoning. The current ordinance does not allow signage to be placed above roof lines. Steve Watkins, from Fuzzy's Taco, was present and would like the ordinance changed so that they can have additional signage than what is currently allowed. Joe Iliff will bring this item back to Council at the next work session. 4. Overview of Items on Regular Agenda. None. 5. Adjourn. When the house was purchase it was considered outside the city limits. Within the last year or so my parent's property (11698 Metz Road/next door) and my property were brought into the city limits. This property was my second residence. On July 31, 2012 a hearing took place regarding divorce proceedings for my husband and myself. The judge in the case decided that since my husband owned the residence in Gainesville that we had been living at prior to our marriage, my two children and I had to leave the property. She gave me two weeks. I scramble to find a solution as the house at 11754 Metz Road had only two bedrooms and one bath and was not suitable for us to reside in. So I decided to buy a new mobile home and place it on the property behind the existing house. I felt like it would save me money as I could tie into the water and sewer that were already there. My parent's will be retiring within the next five years and we will be selling both of the properties. The mobile home seemed like a great way to have what I needed at this time and have something to utilize later after we moved just in case we need to build. So I went ahead and made the purchase and had the house dropped. I finally felt like things were going to be okay through all the divorce issues and time restraints. When I went to have the electricity hooked up I was informed that I had made a huge error. They told me that I was in violation of a city ordinance stating I could not place a mobile home in the city without authorization. I would like to apologize for my lack of knowledge about the city rules and understand that I should check now regarding constructions or new additions to my property. I have always lived out of the city limits and did not consider at the time that there would be any restrictions. Therefore, I would like to request that you please allow me to keep the home that I have purchased for myself and my two children on the property at 11754 Metz Road. The home should only be there for a few years and will be removed upon my sale of the residence at 11754 Metz Road. ADMINISTRATION: Received the Interlocal Agreement from Denton County. Overall, the county cut library finding by 10% this year, but because Frisco declined County finding, Sanger will be getting $15,810. Last year we got $15,007. On the down side, that eliminates another large library willing to serve our citizens when they needed it. Started pulling information that will be needed for the annual report. Meetings attended: Introduction to News Bank Webinar, 9/13 Denton County Library Advisory Board, 9/19, Little Elm CIRCULATION: Took a new set of book to the Senior Center. COLLECTION: Recent yearbooks from Sanger High School were donated. We now have 37 annuals from 1940 to 2010. SPECIAL PROJECTS: Golden Triangle Fire Protection repaired and upgraded the fire sprinkler system. PROGRAMS: Adult programs held: Fall Gardening, four bilingual classes on Nutrition, two Knitting and Crochet workshops, and the book club meeting. "Wild Animals" was the theme for Storytime in September. The children made a monkey tree with paper towel rolls at the "Monkeys" program. The monkeys were made of peanut shells. For the "Elephants" program, kids made an elephant head with a working trunk (out of a paper cup and a straw). Then we went outside and squirted water with our trunks. At the "Big Cats" program, kids made a lion puppet to use with a finger play: "A lion is knocking at my door. Hello, lion ... ROARRRR". The final program was "Wolves, Foxes and Coyotes". Using large appliance boxes, kids decorated the three little pigs' houses. The houses will be in the children's area during October for children to play in.
