024-87-Ordinance-Establishing Two Capital Reserve Funds from Water and Sewer Tap Fees-12/07/1987CITY OF SANGER, TEXAS CITY SECRETARY ORDINANCE NO. #024-87 AN ORDINANCE ESTABLISHING TWO CAPITAL RESERVE FUNDS FROM MONIES RECEIVED FROM THE COLLECTION OF WATER AND SEWER TAP FEES; AND, PROVIDING FOR REPEAL OF ORDINANCES IN CONFLICT; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. SECTION I BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SANGER, TEXAS THAT THERE IS HEREBY CREATED A: 1) Capital Reserve Fund (Water) 2) Capital Reserve Fund (Sewer) to which will be deposited in each respective fund monies from water and/or sewer taps less actual cost to the City of Sanger for providing material and/or labor for the installation of said taps. Expenditure from said funds shall be used for capital improvements or emergency use as directed by the governing body of the city. SECTION II All Ordinances or parts of Ordinances in conflict herewith are, to the extent of such conflict, hereby repealed. SECTION III It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses, and phrases of this Ordinance are severable and, if any phrase, clause, sentence, paragraph, or section of this Ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of this Ordinance, since the same would have been enacted by the City Council without the incorporation in this Ordinance of any such unconstitutional phrase, clause, sentence, paragraph, or section. SECTION IV This Ordinance will take effect its passage and the publication in such cases provides.
