02-88-Ordinance-Amending the Sanitary Landfill Use Fee Schedule-03/21/1988CITY SECRETARY CITY OF SANGER, TEXAS ORIGINAL COPY ORDINANCE #02-88 AN ORDINANCE AMENDING CHAPTER Of HEALTH AND SANITATION, SECTION 61 SUBSECTION R (SANITARY LANDFILL USE FEE SCHEDULE) OF THE CODE OF ORDINANCES OF THE CITY OF SANGER, PROVIDING FOR REPEAL OF ORDINANCES OR PARTS THEREOF WHICH ARE IN CONFLICT, PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR AN EFFECTIVE DATE; AND PROVIDING FOR A PENALTY FOR VIOLATION BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SANGER, TEXAS: SECTION I THAT CHAPTER 6, HEALTH AND SANITATION, SECTION 6, SUBSECTION R SANITARY LANDFILL FEE SCHEDULE IS HEREBY AMENDED TO READ AS FOLLOWS: SANITARY LANDFILL USE FEE SCHEDULE 1. Earth,. rocks, and inert material suitable for cover of refuse ----------------------- No charge 2. Passenger cars, station wagons, used by: a. Sanger residents ------------------- $ 3.00 b. Sanger Rural Route residents ---------- 6.00 3. Pickups, Panel Trucks, and single -axle trailers- Per load -------- 8.00 Sanger Rural Route residents ---------- 16.00 4. Trucks, two axle with cargo bed less than fifteen feet (15') or trailer two axle -------------------- 18.00 Sanger Rural Route- residents----------- 36.00 5. Trucks, three (3) axle or truck, two (2) axle with cargo bed length fifteen feet (15') or greater - Per load -- 28.00 Sanger Rural Route residents ---------- 56.00 6. Trucks, semi -trailers or roll -off Sanger -Rural Route residents ---------- 74.00 7. Truck, compactor, 30 C.Y. or less -Per load- 56.00 Sanger Rural Route residents ---------- 112.00 8. Truck, compactor, greater than 30 C.Y. - Per load ------------------- 74.00 Sanger Rural Route residents --------------- 148.00 9. Trucks, liquid wastes - Per load ----------- Not Allowed 10. Any load including tires or waste rubber---- $2.00 per tire or parts thereof SECTION II All ordinances or parts of Ordinances in conflict herewith are, to the extent of such conflict, hereby repealed. SECTION III It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses, and phrases of this Ordinance are severable and, if any phrase, clause, sentence, paragraph, or section of this Ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such un- constitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of this Ordinance, since the same would have been enacted by the City Council without the incorporation in this Ordinance of any such unconstitutional phrase, clause, sentence, paragraph, or section. SECTION IV Whenever in this Ordinance an act is prohibited or is made or declared to be unlawful or an offense or a misdemeanor, or wherever in such Ordinance, the doing of an act is required or the failure to do any act is declared to be unlawful, the violation of any such provisions shall be punished by a fine of not exceeding Two Hundred ($200.00) Dollars; provided, however, that no penalty shall be greater or less than the penalty provided for the same or similar offense under the Laws of the State. Each day any violation of this Ordinance shall continue shall constitute a separate offense. SECTION V This Ordinance will take effect April 11, 1988 from and after its passage and the publication of the caption as the law in such cases provides. sh PASSED AND APPROVED this day of _ 1988, by the City Council of the City of Sanger, Texas.
