84-26-Ordinance-Amending Refuse Collection Regulations-12/17/1984 CITY OF SANGER, TEXAS ORIGINAL ORDINANCE NO 84-26 A N ORDINANCE AMENDING CHAPTER 6, SECTION Q OF THE CODE OF ORDINANCES OF THE CITY OF SANGER, TEXAS ENTITLED REFUSE COLLECTION REGULATIONS TO PROVIDE FOR AN INCREASE IN COLLECTION FEES; PROVIDE FOR REPEAL OF ORDINANCES IN CONFLICT; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR AN EFFECTIVE DATE; AND PROVIDING FOR A PENALTY FOR VIOLATION, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SANGER, TEXAS: SECTION I THAT CHAPTER 6, SECTION Q OF THE CODE OF ORDINANCES OF THE CITY OF SANGER, TEXAS, IS HEREBY AMENDED TO ADD SECTION Q ENTITLED REFUSE COLLECTION REGULATIONS TO PROVIDE FOR AN INCREASE IN COLLECTION FEES WHICH SHALL READ AS FOLLOWS: SECTION Q: COLLECTION FEES L. RESIDENTIAL PREMISES The charge for collecting refuse from residential premises snail be six dollars and fifty cents 06.50) per month. 2. COMMERCIAL PREMISES The charge for collecting refuse from commercial premises shall be based on the frequency of collection and the quantity of refuse. The following scales shall be charged: a. Commercial Premises Using 1-5 Cans The charge for commercial premises using cans shall be as follows: 2 pick-ups per week----------------$ 9.00 5 pick-ups per week---------------- 22.50 b. Commercial Premises Using Containers The charge for commercial premises using containers shall be in accordance with an agreement negotiated with a commercial contractor. NOTE: The following types of commercial premises shall be required to maintain no less than five (5) pick-ups per week: grocery stores, drug stores, meat packing plants, restaurants, and all other businesses whose refuse contain discarded foods, chemicals, or medicines. SECTION II All Ordinances or parts of Ordinances in conflict herewith are, to the extent of such conflict, hereby repealed. SECTION III It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses, and phrases of this Ordinance are severable and, if any phrase, clause, sentence, paragraph, or section of this Ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such un- constitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of this Ordinance, since the same would have been enacted by the City Council without the incorporation in this Ordinance of any such unconstitutional phrase, clause, sentence, paragraph, or section. SECTION IV Whenever in this Ordinance an act is prohibited or is made or declared to be unlawful or an offense or a misdemeanor, or wherever in such Ordinance, the doing of an act is required or the failure to do any act is declared to be un- lawful, the violation of any such provision shall be punished by a fine of not exceeding Two Hundred ($200.00) Dollars; provided, however, that no penalty shall be greater or less than the penalty provided for the same or similar offense under the laws of the State. Each day any violation of this Ordinance shall continue shall constitute a separate offense. SECTION V This Ordinance will take effect immediately from and after its passage and the publication of the caption as the law in such cases provides.
