84-28-Ordinance-Street Construction Regulations-12/17/1984CITY OF SANGER., TEXAS CITY SEC Y ORDINANCE NO 84-28 AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF' THE CITY OF SANGER, TEXAS, TO ADD SECTION 13, CHAPTER 3, ENTITLED STREET CUT EXCAVATION AND REPAIR STANDARDS; ESTABLISHING A STREET CUT FEE AND PERMIT; PROVIDING FOR REPEAL OF ORDINANCES IN CONFLICT; PROVIDING FOR A SEVERABILITY CLAUSE; PROVIDING AN EFFECTIVE DATE; AND PROVIDING FOR A PENALTY FOR VIOLATION, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY. OF SANGER, TEXAS: SECTION I THAT CHAPTER 3 OF THE CODE OF ORDINANCES OF THE CITY OF SANGER, TEXAS, IS HEREBY AMENDED TO ADD SECTION.13 ENTITLED STREET CUT EXCAVATION AND REPAIR STANDARDS WHICH SHALL READ AS FOLLOWS: SECTION 13: STREET CUT EXCAVATION AND REPAIR STANDARDS A. PERMIT AND FEE PAYMENT REQUIRED Prior to the cutting of any streets the contractor shall file a street cut permit with the city secretary describing the location of the cut, anticipated width and Length, and stating date work is to begin and finish, and pay a street cut fee in the amount of $2.00. B. GENERAL CONSTRUCTION REQUIREMENTS (l.) Repairs are to be made as rapidly as possible.. Use of fast setting concrete and similar techniques are encouraged. Completion of the job, including replace- ment of pavement and cleanup, shall normally be accom plished within(..48)for'ty,,eight,_working hourfs.=after: the "repair work involving the cut is made. (2.) In the event it is necessary to place a temporary surface on any cut opening, it shall be composed of permanent type paving material, specifically excluding gravel or flexbase as the surface material, unless approved by the owner. Temporary surfaces shall be adequately compacted and sealed to prevent degradation of the repair during the temporary surface that fails to provide a nondegraded riding surface shall be removed and replaced at the contractor's expense. (3.) Special care shall be exercised in removing the existing concrete, pavement, sidewalk, driveway, alley, curb, curb and gutter or waterway to avoid C. damage to that portion of the concrete to remain in place. The existing concrete shall be sawed to neat lines and any existing concrete beyond the neat lines so established when damaged or destroyed by these operations.shall,be replaced at the Contractor's entire expense. (4.) Backfill under the limits of roadway, streets or any other paved surface shall be brought up to the subgrade level with select material. Select material shall consist of a free flowing material such as: sandy loam, good sound earth from the spoil bank, free from excessive clay. The above backfill shall be brought up to subgrade level in six (6) inch lifts compacted to 95% density. The Contractor shall have the option of using granular material (sand) in lieu of the above. Jetting will be permitted upon approval of the Director of Public Works. (5.) The Contractor shall make every effort to complete construction and allow immediate access to adjacent property at all driveway entrances located along the roadways or streets. Owners or tenants of improvements where access and/or entrance drives are located shall be notified at least eight (8) hours prior to the time the construction will be started at their drive-ins or entrances and informed as to the length of time driveways will be closed, which period shall not exceed six (6) hours. (6.) The Contractor shall be responsible for all road and entrance reconstruction, and repairs and maintenace of same, for a period of one year from the date of such reconstruction. In the event the repairs and maintenance are not made immediately to the satisfaction of the Director of Public Works, and it becomes necessary for the City to make such repairs, the Contractor shall reimburse the City for the cost of such repairs. REPLACING ASPHALTIC CONCRETE PAVEMENT ON A NATURAL SOIL BASE Unless otherwise specified by the owner, the existing asphaltic concrete shall be a saw cut back to .produce a verticle edge for the full depth of the paving. The cut shall extend 12 inches back of the firm banks of the trench. The cut shall be replaced with reinforced concrete base. The reinforcement shall be #3 bars on 24 inch centers, lapping 30 diameters on splices. The concrete shall be Class A. The concrete base shall be six inches thick. The final 12 inches over the concrete base shall be asphaltic concrete. -2- D. REPLACING ASPHALTIC CONCRETE PAVEMENT ON A FLEXIBLE BASE Unless otherwise specified by the owner, the existing asphaltic concrete shall be sawed 12 inches back from the firm banks of the trench. The cust shall be replaced with a compacted flexible base to match the existing thickness of the base, six inches minimum. The final two inches over the flexible base shall be asphaltic concrete. SECTION II A11 Ordinances or parts of Ordinances in conflict herewith are, to the extent of such conflict, hereby repealed. SECTION III It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses, and phrases of this Ordinance are severable and, if any phrase, clause, sentence, paragraph, or section of this Ordinance shall be declared unconstitutional by the valid judgment or decree of any cou .t of competent jurisdiction, such unconstitutionality shall not affect any of the re- maining phrases, clauses, sentences, paragraphs, and sections of this Ordinance, since the same would have been enacted by the City Council without the incorporation in this Ordinance of any such unconstitutional phrase, clause, sentence, paragraph, or section. SECTION IV Whenever in this Ordinance an act is prohibited or is made or declared to be unlawful or an offense or a misdemeanor, or wherever in such Ordinance, the doing of an act is required or the failure to do any act is declared to be un- lawful, the violation of any such provision shall be punished by a fine of not exceeding Two Hundred ($200.00) Dollars; provided, however, that no penalty shall be greater or Less than the penalty provided for the same or similar offense under the laws of the State. Each day any violation of this Ordinance shall continue shall constitute a separate offense. SECTION V This Ordinance will take effect immediately from and after its passage and the publication of the caption as the law in such cases provides. -3- PASSED AND APPROVED this _ day of 1984, by the City Council of the City of Sanger, Texas.
