AN ORDINANCE AMENDING CHAPTER 3, BUILDING REGULATIONS
AND.OTHER CONSTRUCTION CODES, OF THE SANGER CITY CODE;
PROVIDING FOR THE ESTABLISHMENT OF A BUILDING INSPECTION
DEPARTMENT; PROVIDING FOR A BUILDING OFFICIAL, ADOPTING
CERTAIN BUILDING CODES AND PERMIT FEES; AMENDING AND
REPEALING CERTAIN SECTIONS AND PARTS OF EXISTING CODES;
PROVIDING A SEVERABILITY CLAUSE; PENALTY CLAUSE, AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Sanger, Texas,
has determined that i t -s i n t h e best interest of the public
safety and welfare to establish and regulate the construction
and alteration of all residential, commercial, and incidental
structures in the City of Sanger, Texas.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF SANGER, TEXAS, THAT:
SECTION 1. BUILDING INSPECTION DEPARTMENT
(A) There is hereby established a Building Inspection Division
to enforce the Building Codes, adopted by the City of Sanger,
Texas, to insure and safeguard life and limb, health,
property, and public welfare.
(B) There is hereby established a position of Building Official
to be head of said Division, who shall be sole responsible
for all matters relative to construction, inspection, and
enforcement of these codes.
(C) The Building Official shall be responsible for the issuance
of citations to any person, firm, or corporation, which,
is found to be in violation of any building codes or city
ordinances, after all other attempts to correct the problem
has failed.
(d) The Building Official shall receive an annual salary as
determined by the City Manager and the City Council, which,
will be paid in bi-weekly installments, which, will commence
on or before September 1, 1986s
SECTION 2. BUILDING CODES
It is hereby ordained that, the now existing Section (2)
two, of the Sanger City Codes be repealed in its entirety, and
a new Section (2) shall be adopted to read as follows:
SECTION 2. BUILDING CODES
(l.) It is hereby adopted for the purpose of establishing rules
and regulations for the construction, erection, alteration,
moving, demolition, repair, use and occupancy of any build-
ing or structure within this jurisdiction, The Uniform Building
Code, 1985 edition, published by the International Conference
of Building Officials, and all new editions as they become
available. One copy of said code to be on file in the
office of the City Secretary. Also, to amend sections
301 and 304a of the Uniform Building Code, 1985 edition, to
read as follows.

A building permit fee will be charged based on the cal-
culation of building costs per square foot of structure
set at $25.00 per square foot of heated area, and, $10.00
per square foot for garages and porches.
Example: A house with a total heated area of 3050 square
feet would have a value of $76,250.00 (heated area) and
550 square feet of garage and porches at $5500.00 would
be a total valuation of $81,750.00 Permit fees based on
The Uniform Building Code recommendations on Table 3-a
reads:
$1.00 to $500.00 = $10.00
$501.00 to $2,000.00 = $10.00 for the first $500.00
plus $1.50 for each additional $100.00 or fraction
thereof, to and including $2,000.00.
$21001.00 to $25,000.00 = $32.50 for the first $2,000.00
plus $6.00 for each additional $1,000.00 or fraction
thereof to and including $25,000.00.
$25,001.00 to $50,000.00 = $170.50 for the first
$25,000.00 plus $4.50 for each additional $1,000.00
or fraction thereof to and including $50,000.00.
$50,001.00 to $100,000.00 = $283.00 for the first $50,000.00
plus $3.00 for each additional $1,000.00 or fraction
thereof to and including $100,000.00
$100,001.00 and up = $433.00 for the first $100,000.00
plus $2.50 for each additional $1,000.00 or fraction
thereof.
Therefore, a building permit for the above mentioned house
would cost, $379.00.
OTHER INSPECTIONS AND FEES
(1) Inspections outside of normal business hours
$15.00 per hr. (minimum charge = two hours)
(2) Reinspection fee assessed under provisions of section
305g $15.00 each.
(3) Inspections for which no fee is specifically indicated
---$15.00 per hour (minimum charge = one-half hour)
(4) Additional plans review required by changes, additions
or revisions to approved plans $15.00 per
hr. (minimum charge = one-half hour)
All approved plans from office will be subject to field
inspection approval.
(2.) It is hereby adopted for the purpose of providing minimum
requirements and standards for the protection of the public's
health, safety, and welfare, The Uniform Plumbing Code, 1985
edition, published by the International Conference of Build-
ing Officials, and all new editions as they become available.
One copy of said code to be on file in the office of the
City Secretary. Also, to amend Part 1-20.7 of The Uniform
Plumbing Code, 1985 edition, to read as follows:

Code, 1985 edition, published by the International Conference
of Building Officials, and all new editions as they become
available. One copy of said code to be on file in the
office of the City Secretary. Also, to amend section 304a
of The Uniform Mechanical Code, 1985 edition, to read as
follows:

(5). It is hereby ordained by the City Council that, Appendix A
of the Sanger City Code be repealed in its entirety.
SECTION III
It is hereby declared to be the intention of the City Council
that the sections, paragraphs, sentences, clauses, and phrases
of this Ordinance are severable and, if any phrase, clause,
sentence, paragraph, or section of this Ordinance shall be
declared unconstitutional by the valid judgment or decree of
any court of competent jurisdiction, such unconstitutionality
shall not affect any of the remaining phrases, clauses,
sentences, paragraphs, and sections of this Ordinance, since
the same would have been enacted by the City Council without
the incorporation in this Ordinance of any such unconstitutional
phrase, clause, sentence, or section.
SECTION IV
Whenever in this Ordinance an act is prohibited or is made or
declared to be unlawful or an offense or a misdemeanor, or
wherever in -such Ordinance, the doing of an act is required
or the failure to do any act is declared to be unlawful, the
violation of any such provision shall be punished_ by a fine of
not exceeding One Thousand ($1,000.00) Dollars; provided, how-
ever, that no penalty shall be greater or less than the penalty
provided for the same or similar offense under the laws of the
State. Each day any violation of this Ordinance shall continue
shall constitute a separate offense.

SECTION V
This Ordinance will take effect immediately from and after
its passage and the publication of the caption as the law
in such cases provides. All ordinances of a general and
permanent nature of the City of Sanger, Texas enacted on
final passage on or before the effective date of this
ordinance as described above and not included in this
ordinance or recognized and continued in force by reference
that are in conflict with this ordinance are hereby repealed.
No resolution of the city is repealed by this ordinance.
