86-16-Ordinance-Setting the Public Hearing Date for Annexation-08/18/1986ORDINANCE 86-16 AN ORDINANCE SETTING A DATE, TIME AND PLACE ON THE PROP lSL- TION OF CERTAIN PROPERTY BY THE CITY OF BANGER, TEXAS, AND AUTHORIZING AND DIRECTING THE MAYOR TO PUBLISH NOTICE OF SUCH PUBLIC HEARING. THE CITY COUNCIL OF THE CITY OF BANGER, TEXAS HEREBY ORDAINS: SECTION I. On the day of 1986, at 7:00 o'clock P.M. in the City Council Ghambe s of the Municipal Building of the City of Sanger, Texas, the City Council will hold a public hearing giving all interested persons the right to appear and be heard on the proposed annexation by the City of Sanger, Texas of the property described below. TRACT N0. 1 Being all that certain lot, tract or parcel of land out of the R. Bebee Survey, Abstract No. 29, Denton County, Texas, and being part of a tract shown by deed to Eagle Farms Inc., recorded in Volume 972, Page 2, of the Deed Records of Denton County, Texas and being more particularly described as follows: BEGINNING at a fence corner post at the Southeast corner of a tract of land owned by Benny Johnson, said corner being South 88 deg. 41 min. 00 sec. West 1301.97 feet from the Southeast corner of said Eagle Farms tract; THENCE: North Ol deg. 06 min. 46 sec. West, with the East line of said Johnson tract, a distance of 20.00 feet to a corner; THENCE: North 88 deg. 41 min. 00 sec. East, a distance of 623.54 feet to a corner on the West line of Gene Souther tract; THENCE: South Ol deg. 06 min. 46 sec. East, with the West line of said Souther tract, a distance of 20.00 feet to a corner on the South line of said Eagle Farms Inc. tract; THENCE: South 88 deg. 41 min. 00 sec. West, with the South line of said tract, a distance of 623.54 feet to the POINT OF BEGINNING. TRACT N0. 2 BEING ALL that certain lot, tract or parcel of land situated in the Reubin Bebee Survey, Abstract No. 29, Denton County, Texas, and being part of a tract shown by deed to Eagle Farms, Inc. recorded in Volume 972, Page 2 of the Deed Records of Denton County, Texas, and being more particularly described as follows: BEGINNING at a 1/2 inch iron rod set on the south line of said Eagle -- Farms tract, at a point S.88°41'00"W. 533.23 feet from the southeast corner of said Eagle Farms tract; THENCE 5.88°41'00"W. with the south line of said Eagle Farms tract, along and near a fence line, a distance of 145.20 feet to a 1/2 inch iron rod set for corner; THENCE N.Ol°06''46"W. a distance of 600.00 feet to a 1/2 inch iron rod set on the south line of a 60.00 foot road; THENCE N.88°41'00"E. with the south line of said 60.00 foot road a distance of 145.20 feet to a 1/2 inch ron rod set for corner; THENCE S.Ol°06'46"E. a distance of 600.00 feet to the POINT OF BEGINNING and CONTAINING 2.00 acres of land, more or less. TRACT N0. 3 Being all that certain lot, tract or parcel of land Reuben Bebee Survey, Abstract No. 29, Denton County, part of a tract described in a deed from John Porter Inc., August 20, 1979, recorded in Volume 972, Page of Denton Counny, Texas, and being more particularly follows: situated in the Texas and being to Eagle Farms, 2, Deed Records described as BEGINNING at a 1/2 inch iron rod set on the south line of said Eagle Farms, tract, said iron rod being South 88 degrees 41 minutes 00 seconds West 388.03 feet from the southeast corner of said Eagle Farms tract; THENCE South 88 degrees 41 minutes 00 seconds West with the South line of said tract a distance of 145.20 feet to a 1/2 inch iron rod set for corner; THENCE North 01 degrees 06 minutes 46 seconds West, a distance of 600.00 feet to a 1/2 inch iron rod set on the south line of a 60 foot gravel road; THENCE North 88 degrees 41 minutes 00 seconds East, with the south line of said road a distance of 145.20 feet to 1/2 inch iron rod set for corner; THENCE South 01 degrees 06 minutes 46 seconds East a distance of 600.00 feet to the POINT OF BEGINNING, containing in all 2.00 acres of land, more or less. TRACT N0. 4 Being all that certain lot, tract or parcel of land situated in the Reuben Bebee Survey, Abstract No. 292 Denton County, Texas and being part of a tract shown by Deed to Eagle Farms, Inc. recorded in Volume 972, Page 2, of the Deed Records of Denton County, Texas and being more particularly described as follows: BEGINNING at a 1/2 inch iron rod set at the southeast corner of said Eagle Farms tract said point being on the west line of G.C. & S.F. Railroad; THENCE South 88 degrees 41 minutes 00 seconds West with the south line of said Eagle Farms tract, along and near a fence line, a distance of 600.00 feet to a 1/2 inch iron rod set for corner; THENCE North Ol degrees 06 minutes 46 seconds West, a distance of 600.00 feet to a 1/2 inch iron rod set on the south line of a 60 foot road; THENCE North 88 degrees 41 minutes 00 seconds East, with the south line of said 60.00 foot road a distance of 337.97 feet to a 1/2 inch rod set on the west line of said Railroad; THENCE South OS degrees 53 minutes 00 seconds East, with the West line of said railroad a distance of 601.91 feet to the POINT OF BEGINNING, and containing 5.000 acres of land, more or less. Cooper and recorded in Volume 849, Page 4, of the Deed Records of Denton County, Texas, and being more particularly described as follows: BEGINNING, for the northwest corner of at an iron pin found at the northwest east line of G.C. & S.F.R.R. R.O. Todd, Jr., by deed recorded in Volume 872, Page 624, of the Deed Records of Denton County, Texas, and being more particularly described as follows: BEGINNING at a point on the East right-of-way line of Interstate High- way 35-E, said point.being South 1°06`46" East 267.16 feet from the Northwest corner of the above described 47.872 acre tract; THENCE North 88°41'East, 599.89 feet to the beginning of a curve to the right; THENCE Southeasterly along said curve to the right having a central angle of 45°5821, a radius of 330.0 feet and a tangent of 139.98 feet, an arc distance of 264.78 feet to a point of reverse curve; THENCE North 88°41' East, 837.25 feet to a point on the West right -of way line of the G.C. & S.F. Railroad right-of-way (100.0 feet wide); THENCE South 5°53' East along said West right-of-way line of the G.C. & S.F. Railroad, 60.19 feet; THENCE 88°41' West, 842.04 feet to the beginning of a curve to the right; THENCE Northwesterly along said curve to the right having a central angle of 45°58`21", a radius of 330.0 feet and a tangent of 139.98 feet, an arc distance of 264.78 feet to a point of reverse curve; THENCE Northwesterly along a curbe to the left having a central angle of 45°58'21", a radius of 270.0 feet and a tangent of 114.53 feet, an acr distance of 216.64 feet; THENCE South 88141' West, 600.11 feet to a point on the East right-of-way line of Interstate Highway 35-E; THENCE North 1°06'46" West along said East right-of-way line of Inter- state Highway 35-E 60.0 feet to the PLACE OF BEGINNING, and containing 2.6460 acres of land. SECTION II The Mayor of the City of Sanger, Texas, is hereby authorized and directed to cause notice of such public hearing to be published once in a newspaper having general circulation in the City and in the above described territory not more than forty days nor less than twenty days prior to the date of such public hearing, all in accordance with the Municipal Annexation Act. (Article 970a, Vernon's Texas Civil Statutes). SECTION III This ordinance shall be in full force and effect immediately following its passage and approval. PASSED AND APPROVED this the day of 1986.
