83-9-Ordinance-Issuance of Master or Journeyman Electricians License-10/03/1983ORDINANCE NO. 83-9 AN ORDINANCE AMENDING CHAPTER 3, SECTION 4D (3) (2) OF THE CODE OF ORDINANCES OF THE CITY OF SANGER, TEXAS, ENTITLED ISSUANCE OF MASTERS OR JOURNEYMAN ELECTRICIAN'S LICENSE; PROVIDING FOR A REPEAL OF ORDINANCES IN CONFLICT, PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR AN EFFECTIVE DATE; AND PROVIDING FOR A PENALTY FOR VIOLATION. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SANGER, TEXAS: SECTION I THAT CHAPTER 3, SECTION 4D (3) (2) OF THE SANGER CODE OF ORDI- NANCES IS HEREBY AMENDED TO READ AS FOLLOWS: SECTION 4D (3) (2): ISSUANCE OF MASTER OR JOURNEYMAN ELECTRI- CIAN'S LICENSE An examination shall be made available to applicants once each month and an examination fee of One Hundred Dollars ($100.00) shall be paid in advance. This fee shall apply toward the initial license fee if applicant successfully completes the examination. The examination fee shall be retained by the City if the applicant fails the examination. After having successfully passed the required examination, a master or journeyman electrician shall be issued a certificate of licensing showing that he has the necessary qualifications to perform the work so licensed by the requirements of this code. SECTION II All Ordinances or parts of Ordinances in conflict here- with are, to the extent of such conflict, hereby repealed. SECTION III It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses, and phrases of this Ordinance are severable and, if any phrase, clause, sentence, paragraph, or section of this Ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of this Ordinance, since the same would have been enacted by the City Council without the incorporation in this Ordinance of any such unconstitutional phrase, clause, sentence, paragraph, or section. SECTION IV Whenever in this Ordinance an act is prohibited or is made or declared to be unlawful or an offense or a misdemeanor, or wherever in such Ordinance, the doing of an act is required or the failure to do any act is declared to be unlawful, the violation of any such provision shall be punished by a fine of not exceeding Two Hundred ($200.00) Dollars; provided, however, that no penalty shall be greater or less than the penalty provided for the same or similar offense under the laws of the State. Each day any violation of this Ordinance shall continue shall constitute aseparate offense. SECTION V This Ordinance will take effect immediately from and after its passage and the publication of the caption as the law in such cases provides.
