83-15-Ordinance-Amending Special Speed Zones-12/05/1983CITY OF SANGER, TEXAS ORDINANCE N0. 83-15 AN ORDINANCE AMENDING CHAPTER 9, SECTION 6E OF THE CODE OF ORDINANCES OF THE CITY OF SANGER, TEXAS, ENTITLED SPECIAL SPEED ZONES; PROVIDING FOR A REPEAL OF ORDINANCES IN CONFLICT; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR AN EFFECTIVE DATE; AND PROVIDING FOR A PENALTY FOR VIOLATION, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SANGER, TEXAS: SECTION I THAT CHAPTER 9, SECTION 6E (1) OF THE ORDINANCES OF THE CITY OF SANGER, TEXAS IS HEREBY AMENDED TO READ AS FOLLOWS: (1) Farm to Market Road No. 455: (a) From the west corporate city limits of the City of Sanger, east on Farm to Market Road No. 455, a distance of 0.705 mile, 40 miles per hour. (b) From the last mentioned point east on Farm to Market Road No. 455 a distance of 0.850 to a point 1.555 miles east of the west city limits of the City of Sanger, 30 miles per hour. (c) From the last mentioned point east on Farm to Market Road No. 455 a distance of 0.200 mile to a point 1.755 miles east of the west city limits of the City of Sanger, 45 miles per hour. (d) From the last .mentioned point east on Farm to Market Road No. 455 a distance of 0.595 mile to a point 2.350 miles east of the west city limits of the City of Sanger, 55 miles per hour. SECTION II THAT CHAPTER 9, SECTION 6E OF THE ORDINANCES OF THE CITY OF SANGER, TEXAS, IS HEREBY AMENDED TO ADD (16) WHICH SHALL READ AS FOLLOWS: (16) Loop 138 (5th Street) (a) From Interstate Highway No. 35 east Frontage Road at a point where it intersects with Loop 138 on the north side of the City of Sanger, south on Loop 138 a distance of 1.950 mile, 30 miles per hour. SECTION III All Ordinances or parts of Ordinances in conflict herewith are, to the extent of such conflict, hereby repealed. SECTION IV It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses, and phrases of this Ordinance are severable and, if any phrase, clause, sentence, paragraph, or section of this Ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of this Ordinance, since the same would have been enacted by the City Council without the incorporation in this Ordinance of any such unconstitutional phrase, clause, sentence, paragraph, or section. SECTION V Whenever in this Ordinance an act is prohibited or is made or declared to be unlawful or an offense or•a misdemeanor, or wherever in such Ordinance, the doing of an act is required or the failure to do any act is declared to be unlawful, the violation of any such provision shall be punished by a fine of not exceeding Two Hundred ($200.00) Dollars; provided, how- ever, that no penalty shall be greater or less than the penalty provided for the same or similar offense under the laws of the State. Each day any violation of this Ordinance shall continue shall constitute a separate offense. SECTION VI This Ordinance will take effect immediately from and after its passage and the publication of the caption as the law in such cases provides.
