81-4-Ordinance-Residential Solid Waste Requirements-04/20/1981ORDINANCE NO. 81-4 AN ORDINANCE AMENDING THE CITY OF BANGER SOILD WASTE ORDINANCE REQUIRING RESIDENTIAL CUSTOMERS TO USE PLASTIC BAGS; REPEALING CONFLICTING ORDINANCES; PROVIDING A SAVINGS CLAUSE; AND DECLARING AN EFFECTIVE DATE. THEREFORE BE TEXAS. IT ORDAINED BY THE CITY COUNCIL OF THE CITY That the Solid Waste Ordinance of the City of Sanger, Texas, is hereby amended and changed in the following particulars. Section 2 of said Ordinance is hereby deleted and amended by adding a Section 2, which shall hereafter read as follows. SECTION 2. CONTAINERS REQUIRED. (a.) Container Requirements for Commercial Customers. It shall be the duty of every person, firm or corporation owning, managing, operating, leasing, or renting any premises or commercial business where garbage or trash accumulates, to provide and maintain in sufficient numbers either portable containers or City owned Commercial Containers to accomodate and securely keep all garbage and/or trash that may accumulate between collections. 1. Portable Containers shall be made of galvanized metal or quality plastic, water -tight, rodent and fly -proof with a tight -fitted lid which shall remain on except when depositing or removing the contents of the receptacle, and with handles on the sides, and have a capacity of not more than twenty (20) gallons. All containers shall be kept clean and free from accumulation of any substance remaining attached to inside of container which would attract or breed flies, mosquitoes or any other insects. 2. City Owned Commercial Containers shall be provided by the city at a rate as determined in Section 14 of this ordinance. The user shall provide a hard surface pad of concrete or asphalt on which the container shall be placed. It will be the responsibility of the user to keep City Owned Commercial Containers clean and free from accumulation of any substance remaining attached to inside of the container which would attract or breed flies, mosquitoes or any other insects. Should the user fail to keep containers clean and free from accumulation the city shall clean the container and charge the cyst o.F J..h cleaning to the user. Users who discard food scraps, surplus foods or food products shall be required to place all food - scraps, surplus food or food products into plastic bags or paper bags designed for garbage or trash disposal. All plastic or paper bags must meet standard City of Sanger specifications and shall be securely tied or otherwise have all openings securely closed. =1- (b.) Container Requirements for Residential Customers. It shall be the duty of persons who own, lease, or rent any residen- tial premises in the City of Sanger to place all garbage or trash in plastic bags or paper bags designed for garbage and trash disposal. All plastic or paper bags must meet standard City of Sanger specifications and have a capacity of not more than forty (40) gallons. All bags shall be placed at the curb and suitably protected from animals and vermin. All bags shall be securely tied or otherwise have all openings securely closed. (c.) Plastic Bag Standard Specifications. City of Sanger standard specifications for plastic bags used in the disposal of garbage or trash shall be not less than 1.5 mil, linear low density polyethylene, size 30 gal., 16"xl4"x37", opaque, bag - weight of 111 pounds per thousand. The City shall make plastic bags meeting standard specifi- cations available for purchase by residential and commercial customers. PART II. That if any section, subsection, paragraph, sentence, clause, phrase or word in this ordinance, or application to any person or circumstances is held invalid by any court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance, and the City Council of the City of Sanger, Texas, hereby declares it would have enacted such remaining portions despite any such invalidity. PART III. That this ordinance shall take effect, and shall be in full force and effect on May 15, 1981. APPROVED THIS THE day of A.D., 1981. ATTEST: MAYUK -2-
