76-8-Ordinance-Establishing Utility Rates and Payment Provisions-08/16/1976i ORDINANCE NO 76-8 AN ORDINANCE PROVIDING RATES AND PAYMENT PROVISIONS FOR WATER AND SEWER SERVICE, REPEALING CONFLICTING ORDINANCES; PROVIDING FOR A SAVINGS CLAUSE; AND DECLARING AN EFFECTIVE DATE® BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BANGER, TEXAS; SECTION 1, The rates to be charged by the City for water services )re hereby established as follows: A.' (3) Multi -family Dwelling Units: Where multi -family dwellings are served by a single water service line, the total water usage will be de- vided by the number of occupied units. The bill cal- culated from the per unit usage derived therefrom shall be multiplied by the number of occupied units to determine the total amount due. B. Customers Outside of City Limits. (1) Rate and Minimum Charge: Same as Sections 1 A(1) and 1 A(2) except that the monthly billing calculated thereunder will be multi- plied by two hundred (200%) percent® (2) Multi -family Dwelling Units; Same as section 1 A(3). SECTION 2® The rates to be charged by the City for sanitary sewer service are hereby established as follows: A. Customers Inside of City Limits. (1) Rate; Residential - flat rate ®....®®.®.®®.$,. Commercial - flat rate (2) Multi -family Dwelling Units: CITY SECRETARY ORIGINAL COPY The amount due for multi®family dwellings shall be the residential rate multiplied by the number of occupied dwelling units. B. Customers Outside of City Limits. (1) Rate: Same as section 2 A(1) except that the monthly billing calculated thereunder will be multiplied by two hundred (200%) percent. (2) Multi®family Dwelling Units: Same as section 2 A(2). SECTION 3. Payment. A. Billing for water and sewer services hereunder shall be due and payable on the first day of each month. B. Payments become delinquent after the fifteenth day of each month whereupon a ten (10%) percent penalty shall be assessed to each delinquent bill. C. Water service may be discontinued, upon due written notice, to customers having past due bills on the twenty-seventh day of the month. There shall be a charge of six ($6.00) dollars for reconnecting such discontinued service. SECTION That if any section, subsection, paragraph, sentence, clause, phrase or word in this ordinance, or application to any person or circumstances is held invalid by any court of competent jurisdiction, such holding shall not affect the validity of the re® maining portions of this ordinance, and the City Council of the City of Sanger, Texas, hereby declares it would have enacted such re® maining portions despite any such invalidity. SECTION 5. That this ordinance shall become effective from and after the date of its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be published once in the newspaper within ten (10) days of the date of its passage.
