79-3-Ordinance-Establishing the Prima Facie Speed Limit along FM 455-05/21/1979SPEED LIMIT ORDINANCE NO. 79-3 A1 T ORDINANCE FIXING AND ESTABLISHING A NEW SPEED LIMIT FOR VEHICLES, UPON THE BASIS OF AN ADDITION ENGINEERING AND TRAFFIC INVESTIGATION, ON 8TH STREET NORTH OF FM 455, AND 7TH STREET NORTH OF FM 455, WITHIN THE LIMITS OF THE CITY OF BANGER, TEXAS AS SET OUT IN THIS ORDINANCE, PROVIDING THAT VIOLATION ON THIS ORDINANCE SHALL CONSTITUTE A MIS- DEMEANOR, AND PROVIDING A PENALTY UPON CONVICTION OF A FINE NOT TO EXCEED $200.00 FOR VIOLATION OF SAID ORDINANCE. WHEREAS, the State of Texas, provides that whenever the governing body of the City shall determine upon the basis of an engineering and traffic investigation, a reasonable and safe prima facie speed limit upon the streets and highways, of the City, taking into consideration the width and condition of the pavement and other circumstances on said streets and highways, the governing body of said City may declare said reasonable and safe speed limit thereon appropriate signs giving notice thereof are erected on said streets and highways; NOW THEREFORE: TEXAS: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BANGER, SECTION I Upon -the basis of an additional engineering and traffic investigation the present speed limits on the said streets have been revoked and a new one has been fixed for all vehicles travel- ing upon the herein after designated streets and are hereby deter- mined to be reasonable and safe. SPEED ZONE 8TH Street -North from FM 455 7TH Street -North from FM 455 The change is as follows: SPEED LIMIT 2 0 Mph 20 Mph The above speed limits fixed and established for the respec- tive speed zones, shall be applicable to all vehicles traveling within each speed zone. SECTION II Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor, and upon conviction there- of shall be fined in any sum not more than two hundred ($200.00) dollars. SECTION III All ordinances and parts of ordinances of the City of Sanger in conflict with any of the provisions of this ordinance are hereby replaced to the extent of such conflict. SECTION IV This ordinance shall be effective from and after the date of its publication as provided by law and the erection of said signs on said streets.
