There came on to be considered the petitions filed with the City Clerk on the day of day , 19 69 , requesting that an election be ordered in said City on the question of the adoption of a local sales and use tax for the benefit of said City in accordance with the provisions of House Bill No. 207, 60th Legislature, Regular Session, 1967, and attached to said petition is the certificate of Tax Assessor and Collector and Registrar of Voters for County, Texas, certifying that said petitions are signed by at least 61 qualified voters of said City, and it appearing that said petitioare si n— gned by qualified voters of said City equal in number to at least twenty per cent (20%) of the total number of votes cast in last preceeding regular city election, and that said petition— are otherwise in conformity with the law. 121 Section II. That an election be ordered as requested in said petition in said City on the 7t day of `Tune , 19 69, which date is not less than thirty (30) days nor more than ninety (90) days after the passage of this ordinance and this ordinance is being passed within sixty (60) days after the date said petition— was filed with the City Clerk.0> Section III. The absentee voting for the above designated election shall be held at the office of the City Secretary, City Ball, Sanger, Tegas. within the boundaries of the above named City and said place of absentee voting shall remain open for at least eight hours on each day for absentee voting which is not a Saturday, a Sunday, or an of&cial State holiday beginning on the 20th dap and continuing through the 4th day preceding the date of said election. The above described place for absentee voting is also the absentee clerk's mailing address to which ballot applications and ballots voted by mail may be sent. Section IV. Ballots of said election shall have written or printed thereon the following: ❑ FOR the adoption of a one percent (1%) local sales and use tax within the city. ❑ AGAINST Place an "X" in the square beside the statement indicating the way you wish to vote. The manner of holding said election shall be governed by the terms and provisions of the above men- tioned House Bill No. 207, and in accordance with the law applicable to other municipal elections. Section V. Notice of said election shall be given by publishing a substantial copy of this ordinance on the same day of two successive weeks in a newspaper of general circulation published within said City. The date of the first publication to be at least twenty-one (21) days prior to the date set for said election. The City Clerk is hereby instructed to cause said notice to be so given. c4 (s) Notice of said election shall be given by publishing a substantial copy of this ordinance on the same day of two successive weeks in a newspaper having general circulation within this City, there being no news- paper published within this City, the date of the first publication to be at least twenty-one (21) days prior to the date set by said election. (2) If election ordered by majority vote of governing body without petitions, strike this section and renumber the other sections of this order. (a) If election ordered without petition strike the words "and this ordinance is being passed within sixty (60) days after the date said peti- tion_ were filed with the City Clerk." (4) Strike this paragraph if a newspaper of general circulation is not published within said City. (5) Strike this paragraph if not applicable. (0) House Bill 207 provides that a substantial copy of the ordinance is to be published in the notice of said election. It is suggested the pub- lisher be instructed to publish the ordinance in full and that there be added on the front page above the caption the words "NOTICE OF CITY SALES AND USE TAX ELECTION".
