05-09-10-Ordinance-Amending Traffic and Vehicles adding Golf Cart regulations-05/03/2010CITY OF SANGER ORDINANCE #05-09-10 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANGER, TEXAS, AMENDING CHAPTER 12, TRAFFIC AND VEHICLES, OF THE CODE OF ORDINANCES OF THE CITY OF SANGER, TEXAS, BY ADDING A NEW ARTICLE 12.1600, GOLF CARTS; ADOPTING REGULATIONS PROVIDING FOR THE OPERATION OF GOLF CARTS ON PUBLIC STREETS OR HIGHWAYS WITHIN THE CORPORATE LIMITS OF THE CITY OF SANGER, TEXAS, PURSUANT TO TEXAS TRANSPORTATION CODE SECTION 551.404; PROVIDING FOR ADDITIONAL CITY OF SANGER REQUIREMENTS NECESSARY TO PROMOTE THE HEALTH, SAFETY, AND WELFARE OF THE PUBLIC; PROVIDING FOR THE REPEAL OF ALL ORDINANCES IN CONFLICT; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR A PENALTY; AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SANGER, TEXAS: Section 1. That Chapter 12, in the Code of Ordinances of the City of Sanger, Texas, Is Hereby Amended, by the Addition of a New Article as Follows: ARTICLE 12.1600 GOLF CARTS Article 12.1601 Purpose It is the desire of the City Council of the City of Sanger to adopt a local ordinance allowing for use of golf carts on public streets within the corporate limits of the City of Sanger Texas, pursuant to Texas Transportation Code 551.404. Article 12.1602 Exclusions and Limitations The following exclusions and limitations apply to the operation of any golf cart within the corporate limits of the City of Sanger Texas. (1) To operate a golf cart in the City of Sanger, operators must comply with the requirements of the Texas Transportation Code. (2) Golf carts may only be operated upon a public street or highway with a speed limit of not more than 35 MPH unless otherwise restricted. (3) A golf cart may cross a street or highway with a speed limit of more than 35 MPH if said crossing occurs at an intersection and said crossing is perpendicular to the street or highway with a posted speed limit of more than 35 MPH. (4) Golf carts must move to the right and yield right of way to faster moving vehicles. (5) Golf carts may not be operated upon any public sidewalk, pedestrian walkway, playground, Public Park, school ground, or other public recreational areas, not designated for motor vehicle traffic. (6) The driver and every occupant of a golf cart must remain seated in a seat designated to hold passengers, while the golf cart is in motion. (7) No person may ride in the lap of the driver or any other occupant. Article 12.1603 Definitions (1) Golf cart means a motor vehicle defined pursuant to Section 502.001(7) of the Texas Transportation Code, as a motor vehicle designed by the manufacturer primarily for transporting persons on a golf course. Section 2. All ordinances or parts of ordinances in conflict herewith are, to the extent of such conflict, hereby repealed. Section 3. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses, phrases and words of this Ordinance are severable and, if any word, phrase, clause, sentence, paragraph, or section of this Ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining portions of this Ordinance, since the same would have been enacted by the City Council without the incorporation in this Ordinance of any such unconstitutional word, phrase, clause, sentence, paragraph, or section. Section 4. Any person, firm, or corporation who shall violate any of the provisions of this article shall be guilty of a misdemeanor and upon conviction shall be fined in accordance with the general penalty provision found in Section 1.109 of this Code. Section 5. This ordinance will take effect immediately from and after its passage and the publication of the caption, as the law and Charter in such cases provide.
