06-23-08-Ordinance-Sidewalk Safety-06/16/2008ORDINANCE 06-23-08 AN ORDINANCE OF THE CITY OF SANGER, TEXAS, AMENDING THE CODE OF ORDINANCES BY AMENDING ARTICLE 8.700, "SIDEWALK SAFETY", SECTION 8.701, " SIDEWALK OPERATION OF CERTAIN DEVICES PROHIBITED" BY ADDING (7), PROVIDING FOR THE REPEAL OF ALL ORDINANCES IN CONFLICT; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR A PENALTY; AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SANGER, TEXAS: Section 1. That the Code of Ordinances, City of Sanger, Texas be and the same is hereby amended by adding (7) New City Hall Property Located at 502 Elm Street, in the Code of Ordinances of the City of Sanger, Texas, which said article shall read as follows: "ARTICLE 8.700 SIDEWALK SAFETY Section 8.701 Sidewalk Operation of Certain Devices Prohibited No person shall operate a bicycle, motor assisted scooter, neighborhood electric device, skateboard, roller skates, roller blades, or other similar device at any time on any sidewalks running adjacent to the streets listed below: (1) Bolivar Street from Pt Street to 6' Street (2) 5th Street from Bolivar Street to Elm Street (3) 4"' Street from Cherry Street to Elm Street (4) 3rd Street from Cherry Street to Elm Street (5) 2nd Street from Cherry Street to Elm Street (6) Elm Street from 5th Street to 0' Street (7) New City Hall Property located at 502 Elm Street This section shall not apply to a mobility impaired individual using a personal assistive mobility device such as a motorized wheelchair. Section 2. Any person who violates a provision of this article is guilty of a misdemeanor and upon conviction is punishable by a fine not to exceed the sum of five hundred dollars ($500.00) for each offense. Section 3. All ordinances or parts of ordinances in conflict herewith are, to the extent of such conflict, hereby repealed. Section 4. The sections, paragraphs, sentences, clauses, phrases and words of this ordinance are severable and, if any word, phrase, clause, sentence, paragraph, or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not effect any of the remaining portions of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional word, phrase, clause, sentence, paragraph or section. Section 5. This ordinance will take effect immediately from and after its passage and the publication of the caption, as the law and Charter in such cases provide.
