Shelley Ruland Called Meeting to Order. 2. Approve Minutes: August 30, 2001- Ken Perry moved to approve the minutes as written, Polly Dwyer seconded. Motion carried unanimously. 3. Conduct Public Hearing Regarding a Replat on property legally described as Original Town, Block 77, Lot 3 & 4. Property is located at the comer of Plum and Fourth Streets. Public Hearing opened. Jimmy Kirby, 702 N. 5t11, indicated he was in favor of the request. Public Hearing closed. 4. Consider and Possible Action Regarding a Replat on property legally described as Original Town, Block 77, Lot 3 & 4. Property is located at the comer of Plum and Fourth Streets. Discussion regarding the location of the property. John Kirby indicated he planned to build a house on lot 4. Discussed current zoning and concerns were expressed regarding this possibly being spot zoning. Polly Dwyer indicated the Council may have a problem with spot zoning this property; however at this time it is not feasible for a business. Shelley Ruland asked about the property North of this. Jimmy Kirby indicated the owner of the two houses to the right of his home owned the vacant lot in that area. Shelley questioned the potential of the property if sold at a later date as business. Mr. Kirby indicated he would never sell the property to a business. Discussed the surrounding property and the zoning. The property directly across the street is residential zoning. Polly Dwyer indicated at this time she felt that residential zoning would be more beneficial to the residents. Discussion regarding the zoning of the property, and that at the time this property was zoned there was some discussion or intention to only zone the front half of those blocks facing F.M. 4S5 as B-1, and the remainder to be zoned Single family; however, at the time it was easier to zone the entire block. Shelley Dwyer asked about #S of the engineer's letter referencing a waiver for the existing structures. Samantha, Assistant City Secretary, indicated the structures are existing; therefore have been grand-fathered. Ken Perry asked about item #Son the Engineer's letter referencing the building lines. Samantha indicated the comment was made for the current zoning of B-1, but the next item will be the zoning change to Single Family and the setbacks meet the requirements of Single Family. Ralph Cain moved to grant the request as long as all City requirements are met. Polly Dwyer seconded. Motion carried unanimously. 5. Conduct Public Hearing Regarding a Zoning Request Change from Bl (Business 1) to SF7G (Single Family 7G)on property legally described as Original Town, Block 77, Lot 4R. Property is located at the comer of Plum and Fourth Streets. Public Hearing opened. John Kirby indicated he was in favor of the request. Jim Kirby indicated he was in favor of the request. Public Hearing closed. 6. Consider and Possible Action Regarding a Zoning Request Change from Bl (Business 1) to SF7G (Single Family 7G)on property legally described as Original Town, Block 77, Lot 4R. Property-is located at the comer of Plum and Fourth Streets. Polly Dwyer indicated while this may be considered spot zoning she felt the best use for the property at this time was residential. Polly Dwyer moved to approve the request. Ralph Cain seconded. Motion carried unanimously. S. Any Other Such Matten. None. 6. Meeting Adjourned.
