Larry Yoast, Mr. & Mrs. Max Wang, Brian S. Holman, Attorney-At-Law representing Mr. & Mrs. Wang 1. Call Meeting to Order Acting Chairperson, Mike Rosenberg called the meeting to order. Invocation and Pledge of Allegiance to the Flag. 2. Approve Minutes of February 16, 1995. Motion was made by Glenn Ervin to approve minutes. Seconded by Mary Bell Sims. Motion Carried. 3. Conduct Public Hearing to Consider Zoning Request for Specific Use Permit on Abstract 29. R. Bebee Addition consisting of 1 Acre, property located 1380 North Stemmons. Acting Chairperson, Mike Rosenberg, declared open the Public Hearing to Consider Zoning Request for Specific Use Permit on Abstract 29, R. Bebee Addition consisting of 1 Acre, property located 1380 North Stemmons. Brian Holman, addressed the Board; representing Max & Yvonne Wang, Owners of the Sanger Inn. Mr. Holman stated the Wangs have asked him to look into protection of their rights as property owners in respect to the specific use permit request which will grant a sand and gravel business. Mr. Holman stated several issues that would affect the Wang's property by this type of business. The physical damage that would be projected by the dust, dirt, noise, and traffic would directly affect the reduction of revenues which would have an impact on the hotel occupancy tax the wangs pay to the City. This amount is projected at $12,000 to $15,000 annually. 0000, P & z Meeting March 30, 1995 Page 2 Mr. Holman advised that the Wangs are in opposition and would appreciate careful consideration be given to their concerns. Mr. Holman did refer to the Zoning Ordinance and the uses required under Industrial 1 Zoning concerning "Non-Nuisance" type businesses. Mr. Conley addressed the board representing this sand & gravel business. Mr. Conley provided sketches concerning the layout of his business and assured the Board there would be no business conducted at night or that large semi-trailers would be coming in and out of that property. His intentions are to be able to use this location for his customers who require a small load of rock or sand. He will not be hauling junk dirt or concrete and storing it in this facility. Mr. Conley indicated that he hoped to include a nursery and a green house later. several questions were asked by the Board and a lengthy discussion concerning the request continued. Larry Yoast, Elect. Supt. referred to Mr. Hamilton's memorandum concerning the request. Mr. Yoast indicated that staff had no formal opinion. Board did indicate that possibly a City Attorney should review this request and make his recommendations. 4. Consider and Possible Action on Zoning Request for Specific Use Permit on Abstract 29, R. Bebee Addition consisting of 1 Acre, property located at 1380 North Stemmons. Russell Madden made the motion to approve the Zoning request for recommendation to the City Council. Motion Carried.
