03/04/1999-PZ-Minutes-RegularMINUTES: PLANNING AND ZONING COMMISSION MARCH 4, 1999 PRESENT: Charles Fenoglio, Polly Dwyer, Mary Belle Sims, Ralph Cain, Rick Carter, Joe Higgs. ABSENT: Joe Falls. OTHERS PRESENT: City Administrator Jack Smith, City Secretary Rose Chavez, Administrative Secretary Samantha Renz, John Bucklew, Delbert Sprague. 1. Charles Fenoglio Called Meeting to Order. 2. Approve Minutes -January 28, 1999 Joe Higgs moved to approve the minutes of January 28, 1999. Mary Belle Sims seconded. Motion carried unanimously. 3. Conduct Public Hearing on Replat on Property Legally Described as Lots 1-R to 3-R, Block A, Bucklew-Freese Addition. Property is located on the comer of Kathryn and Bucklew. Chairperson Fenoglio Declared public hearing open. Delbert Sprague indicated he was representing the Church of Christ, and indicated they were replatting because they were trying to sell the property. Discussion concerning where church presently sits on the property. Mr. Sprague indicated the Church is in Lot JR, and Lot lR has a sale pending. John Bucklew addressed the easement of the original subdivision, he indicated it would normally run through Lot 2R on this plat. Discusson concerning utility easements. Staff pulled all plats regarding this subdivision, plats indicated an easement up to the property, but did bot show an easement through Lot 2R, however Mr. Bucklew indicated the easement ran through this property. Lengthy discussion concerning easement. Staff and Planning and Zoning Commission were unable to determine whether or not the easement ran through the property. 4. Consider and Possible Action on Replat on Property Legally Described as Lots 1-R to 3-R, Block A, Bucklew-Freese Addition. Property is located on the comer of Kathryn and Bucklew. Mary Belle Sims moved to deny the replat until furhter investigation is presented back to the Planning and Zoning concerning the easement. Rick Carter seconded. Motion Carried unanimously. 5.
