06-19-20-Ordinance-Extending and Continuing the Declaration of Local Disaster-06/03/2020ORDINANCE NO.06-19-20 AN ORDINANCE OF THE CITY OF SANGER, TEXAS AMENDING ORDINANCE 05-17- 20 TO EXTEND AND CONTINUE THE MAYOR'S REVISED DECLARATION OF LOCAL DISASTER DATED MAY 15, 2020, ATTACHED HERETO AS EXHIBIT "1-A"; ADOPTING BY REFERENCE DENTON COUNTY ORDERS REGARDING THE COVID-19 VIRUS HEREINAFTER PASSED; PROVIDING FOR A PENALTY OF FINE NOT TO EXCEED $1,000.00 FOR EACH OFFENSE; PROVIDING A REPEALING CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Council, pursuant to its authority under Chapter 418 of the Government Code, adopted Ordinance 05-17-20 renewing and continuing the Mayor's May 15, 2020 emergency declaration concerning the COVID-19 virus and prevention of its spread throughout Denton County, and WHEREAS, the Mayor's May 15 Declaration incorporated revisions to the Denton County Declaration dated May 12, 2020, and WHEREAS, the Denton County Commissioners Court has extended the effective term of its Declaration until June 30, 2020, and WHEREAS, the City Council wishes to amend Ordinance No. 05-17-20 to extend its term to June 30, 2020, as has been done by Denton County and to hereafter adopt by reference and incorporate herein future amendments by Denton County to its Declaration and Order, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SANGER, TEXAS: SECTION 1. The premises hereof are found to be true and correct and are incorporated herein by reference. Ordinance 05-17-20 is amended by amending the Declaration of Local Disaster for Public Health Emergency heretofore issued by Mayor Thomas Muir on May 15, 2020, attached hereto as Exhibit "l-A", to be renewed and continued as the Revised Declaration and emergency orders of the City of Sanger, Texas, pursuant to section 418.108 (a) of the Texas Government Code, to be effective through June 30, 2020, consistent with the Denton County Declaration and Order, as amended. SECTION 2. That hereafter any amendments to the Denton County Declaration and Order regarding the COVID-19 virus are hereby adopted by reference and incorporated as if full copied herein in lieu of the Declaration and Order referred to herein. That pursuant to Section 418.108 (c) of the Texas Government Code, this ordinance shall be given prompt and general publicity and shall be filed promptly with the City Secretary. SECTION 3. That all ordinances of the City of Sanger in conflict with the provisions of this ordinance are hereby repealed, provided that except as specifically amended hereby, the provisions of Ordinance 05-17-20 and amendments thereto shall remain in full force and effect. That if any section, paragraph, sentence, subdivision, clause, phrase or provision of this ordinance be adjudged or held to be unconstitutional, illegal, or invalid, the same shall not affect the validity of this ordinance as a whole or any part or provision hereof other than the part so decided to be unconstitutional, illegal, or invalid and shall not affect the validity of the remainder of this ordinance or any other provision of the ordinances of the City of Sanger. SECTION 5. Any violation of this ordnance or the Emergency Orders adopted hereby shall be subject to a fine not to exceed the sum of $1,000.00 for each offense. SEVTION 6. That this ordinance shall take effect immediately from and after its passage and the publication of the caption, as the law and charter in such cases provide. In some cases, the virus has caused death; and, WHEREAS, extraordinary measures must be taken to contain COVID-19 and prevent its spread throughout the City of Sanger, Texas, including the quarantine of individuals, groups of individuals, and property as well as compelling individuals, groups of individuals, or property to undergo additional health measures that prevent or control the spread of disease; and, WHEREAS, on March 13, 2020, the Governor of the State of Texas has declared a state of disaster for the State of Texas; and WHEREAS, the Sanger City Council enacted Ordinance Number 03-12-20 on March 26, 2020, which authorized the Mayor to execute any further declaration or order necessary to adopt any subsequent Denton County Emergency Orders relating to COVID-19 pandemic; and, WHEREAS, Denton County has issued a revised Order on May 12, 2020, NOW, THEREFORE, PURSUANT TO THE AUTHORITY VESTED IN THE MAYOR OF THE CITY OF SANGER, DENTON COUNTY, TEXAS AND UNDER TEXAS GOVERNMENT CODE SECTION 418.108, I, THOMAS MUIR, MAYOR OF THE CITY OF SANGER, TEXAS, DO HEREBY DECLARE THAT: SECTION 1. A local state of disaster for public health emergency is hereby continued in effect for the City of Sanger, Texas, pursuant to Section 418.108(a) of the Texas Government Code. SECTION 2. Pursuant to Section 418.108(b) of the Government Code, the state of disaster for public health emergency shall continue for a period of not more than seven days from the date of this revised declaration unless continued or renewed by the City Council of Sanger, Texas. SECTION 3. Pursuant to section 418.108(c) of the Government Code, this revised declaration of a local state of disaster for public health emergency shall be given prompt and general publicity and shall be filed promptly with the City Secretary. SECTION 4. Pursuant to Section 418.108(d) of the Government Code, this revised declaration of a local state of disaster incorporates and continues the City of Sanger emergency management plan previously activated. Denton County's revised Disaster Declaration and the rules and regulations contained therein, set out in Exhibit "A" attached hereto are incorporated herein by reference, adopted on May 12, 2020, are adopted by reference made applicable in the City of Sanger. SECTION 6. POSTING OF THESE REGULATIONS. The owner, manager, or operator of any facility that is likely to be impacted by these regulations shall post a copy of these regulations onsite and visible to users of the facility and provide a copy to any user of the facility asking for a copy. SECTION 7. SEVERABILITY. If any subsection, sentence, clause, please, or word of these regulations or any application of them to any person, structure, gathering, or circumstance is held to be invalid or unconstitutional by decision of a court of competent jurisdiction, then such decision will not affect the validity of the remaining portions or applications of these regulations. SECTION 8. EFFECTIVE IMMEDIATELY. These regulations shall be effective immediately and continue until they are either renewed, continued, rescinded, superseded, or amended or until they expire pursuant to applicable law. Mitchell Precinct 3 Dianne Edmondson Precinct 4 Denton County Commissioners Court Judge Andy Eads DISASTER DECLARATION AND EXECUTIVE ORDER OF THE DENTON COUNTY COMMISSIONERS COURT WHEREAS, pursuant to Texas Government Code Section 418.108, Denton County Judge Andy Eads issued the first Executive Order on March 13, 2020, due to 'a. novel coronavirus riow designated SARS- CoV2 which causes the disease COVID-19; and WHEREAS, County Commissioners have renewed and extended the initial Executive Order and Disaster Declarations to maintain the safety and security of the public while working to slow the spread of COVID- 19; and WHEREAS, the County recognizes the authority of Texas Governor Greg Abbott through the .use of his Executive Orders to protect Texas from COVID-19; and WHEREAS, an innovative response is required to mitigate the future spread of COVID-19 to protect the citizens and businesses of Denton County and all incorporated and unincorporated areas; and THEREFORE, the May 12, 2020, Executive Order of the Denton County Commissioners Court is hereby CONTINUED as follows: Summary: The virus that causes 2019 Coronavirus Disease (COVID-19) is easily transmitted through person to person contact, making it essential to slow the spread of the virus. Denton County has had over 1398 positive cases and 32 deaths related to COVID-19 in 33 of the 45 municipalities and the unincorporated areas of Denton County. UNDER THE AUTHORITY OF TEXAS GOVERNMENT CODE SECTION 418.108, DENTON COUNTY JUDGE ANDY EADS AND DENTON COUNTY COMMISSIONERS COURT ORDERS: 1. Effective as of 11:59 p.m. on June 2, 2020, this Disaster Declaration shall continue through June 30, 2020, by Order of the Denton County Commissioners Court unless rescinded by the County Judge, pursuant to §418.108(b) of the Government Code: 2. The Denton County Emergency Operations Plan and the Denton County Pandemic Influenza Preparedness Plan shall remain activated through the end of the COVID-19 disaster. 3. As allowed by Local Government Code 262.024, exempt bidding requirements for the purpose of purchasing items necessary to preserve or protect the public health or safety of the residents of the county. This exemption shall remain in effect until a time when the Disaster Declaration is lifted. 4. On March 31, 2020, the Governor issued Executive Order GA-14 which superseded any local Disaster Declaration. Any restriction imposed after that date was made by the Governor, not Denton County. Nothing in this Order is intended to impose restrictions inconsistent with Order GA-21, GA-22, GA-23, or any other subsequent order issued by the Governor in effect relating to COVID-19.
