08-21-20-Ordinance-Amending Ordinance 07-20-20, November General Election-08/03/2020ORDINANCE #08-21-20 AN ORDINANCE REVISING ORDINANCE #07-20-2020 OF THE CITY OF SANGER, TEXAS, ORDERING A GENERAL ELECTION TO BE HELD JOINTLY WITH OTHER DENTON COUNTY POLITICAL SUBDIVISIONS FOR THE PURPOSE OF ELECTING A MAYOR AND TWO (2) CITY COUNCIL MEMBERS: CITY COUNCIL MEMBER PLACE 2 AND CITY COUNCIL MEMBER PLACE 4; DESIGNATING LOCATIONS OF POLLING PLACES; PROVIDING FOR DATES, TIMES, AND PLACES FOR VOTING AND EARLY VOTING BY PERSONAL APPEARANCE; PROVIDING DEADLINE FOR APPLICATIONS FOR BALLOT BY MAIL; ORDERING NOTICES OF ELECTION TO BE POSTED AND PUBLISHED; AND PROVIDING FOR AN EFFECTIVE DATE. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SANGER, TEXAS: Section 1. A municipal election is hereby ordered to be held on November 3, 2020, such date being a uniform election date as defined in the Texas Election Code, Section 41.001, as amended (the "Code"), for the purpose of electing the following for a two (2) year term: Mayor City Council Member Place 2 City Council Member Place 4 Should a runoff election be required following the canvass of the November 3, 2020 election, the City Council hereby orders that a runoff election be held within the qualified period required. Section 2. The election day polling place where qualified voters shall cast ballots will be determined by the precinct number on their Voters Registration Card (subject to change — call Denton County Elections 940-349-3200): Precinct 1001- Sanger Middle School, 105 Berry Street, Sanger 76266 Precinct 1002 - To Be determined -Denton County Elections — Call 940-349-3200 Precinct 1053 - City of Sanger Community Center, 101 Freese, Sanger, Texas 76266 Election polls shall be open from 7:00 a.m. until 7:00 p.m. on the date of election. Section 3. Early voting by personal appearance will be located at the following location beginning Tuesday, October 13, 2020 through Friday October 30, 2020: City of Sanger Community Center 101 Freese Sanger, Texas 76266 Denton County Elections Administrator shall select and arrange for the use of Early Voting and Election Day voting locations. Voting locations will be, whenever possible, the usual voting location for each election precinct. In the event a voting location is not available, or appropriate, the Elections Administrator will arrange for use of an Alternate location. Notice will be provided at the entrance to any previous polling places in the jurisdiction stating that the polling location has changed and stating the polling place names and addresses in effect for the November 3, 2020 Election. The Early Voting hours will be (any notice of change to be posted at early voting locations): Tuesday- Saturday October 13, 2020 — October 17, 2020 7:00 a.m. to 7:00 p.m. Sunday October 18, 2020 11:00 a.m. to 4:00 p.m. Monday -Saturday October 19, 2020 — October 24, 2020 7:00 a.m. to 7:00 p.m. Sunday October 25, 2020 11:00 a.m. to 4:00 p.m. Monday -Friday October 26, 2020 — October 30, 2020 7:00 a.m. to 7:00 p.m. Denton County will be responsible for Early Voting by mail applications. The applications for Early Voting shall be delivered to Frank Phillips, Election Administrator for Denton County at 701 Kimberly Drive, Suite Al 11, Denton, Texas 76208. Voters will be allowed to hand deliver their own ballot in person to Denton County Elections Administrator at 701 Kimberly Drive, Suite A111, Denton, Texas from the time they receive the ballot up until close of business Election Day. Section 4. Candidate filings for the postponed Municipal Election for May 2, 2020, will not be re -opened for the election to be held on November 3, 2020. Section 5. That all annual applications ballot by mail (ABBMs) for voters that are voting by mail due to being over the age of 65 or due to disability will still be valid for the November 3, 2020, election; and the ABBMs for voters who submitted ABBMs based on expected absence from the county shall not be valid for the postponed November 3, 3030 election. Section 6. That the voter registration deadline for the November 3, 2020 election is October 5, 2020; the deadline to submit an ABBM is October 23, 2020; the dates for early voting are October 13, 2020 through October 30, 2020. Section 7. That the City Manager is authorized to negotiate and execute an election contract with Denton County for the purposes of conducting the postponed election on November 3, 2020. Section 8. An electronic voting system, the Hart InterCivic Verity Voting System shall be used in this election for early voting by personal appearance and election day voting. Section 9. The election precinct and voting places of said election shall be determined by the Denton County Elections Administrator. Section 10. Should any part, section, subsection, paragraph, sentence, clause or phrase contained in this ordinance be adjudged or held to be unconstitutional, illegal or invalid, the same shall not affect the validity of this ordinance as a whole or any part or provision thereof other than the part thereof decided to be unconstitutional, illegal or invalid all respects said remaining portion shall be and remain in full force and effect. Section 11. The City Secretary is hereby authorized and directed to publish and/or post, in the time and manner prescribed by law, all notices required to be published and/or posted in connection with the conduct of this election. The Denton County Election contract shall designate the election judges for the election. The election, including providing notice of the election shall be conducted in accordance with the Texas Election Code and other applicable law, and all residents qualified and registered voters of the City shall be eligible to vote at the election. Section 12. The Mayor and City Secretary are hereby authorized and directed to take any and all actions necessary to comply with the provisions of the Texas Election Code and any other state or federal law in carrying out and conducting the election, whether or not expressly authorized herein. Section 13. This ordinance will take effect immediately from and after its passage, and the publication of the caption, as the law and Charter in such case provide. IT IS ACCORDINGLY SO ORDAINED.
