06/22/2000-BOA-Minutes-RegularI MINUTES: BOARD OF ADJUSTMENT JUNE 22, 2000 PRESENT: Ken Perry, Sherry Lewis, John Springer, Rodney Dillon, Bobby Frizzell, Pete Morris ABSENT: Mike James, Russell Madden, Jimmy Evans OTHERS PRESENT: City Manager Jack Smith, Administrative Assistant Samantha Renz, Alternate Jerry Jenkins, Alternate Lisa Hardy, Andy Garza, and Curt Roberts 1. Ken Called Meeting to Order. 2. Approve Minutes -February 3, 2000 Rodney Dillon moved to approve the minutes. Bobby Frizzell seconded. Motion carried unanimously. 3. Conduct Public Hearing on a Variance Request Concerning Setbacks on Property Legally Described as Lot 6, Block A, of the Hillcrest Addition, Section Two. Property is Located at 700 Diane Drive. Public Hearing opened. Curt Roberts, 700 Diane, spoke in favor of the request, he indicated he had a small front yard, a small side yard on the North, and a large side yard on the South. He indicated also that his back yard was small. He explained the he and his family would like to have a pool, the pool they have chosen is 12' X 28', he indicated it was not a large pool, but one that would fit in his back yard. Mr. Roberts showed a drawing of his property, and explained where the pool would go. Sherry Lewis asked if he was going to put up a privacy fence, and expressed concerns regarding the children in the neighborhood. Mr. Roberts indicated he would either put up a wood fence or red tip Photinias around the cyclone fence. Mr. Roberts indicated he did not want a privacy fence, because of the size of his yard; however, if it was necessary he would put one on the south comer only. Bobby Frizzell asked where his children's room was, and where the fire hydrant was. Mr. Roberts indicated the room was opposite the pool, and the fire hydrant was across the street, on the other comer. Sherry Lewis again expressed concerns regarding the privacy fence, and the children in the neighborhood. Discussion. Public hearing closed. 4. Consider and Possible Action Regarding a Variance Request Concerning Setbacks on Property Legally Described as Lot 6, Block A, of the Hillcrest Addition, Section Two. Property is Located at 700 Diane Drive. City Manager explained that Mr. Roberts' back yard setback should be 25'; however, his house is not 25' from the property line. He indicated he was not sure you could walk safely between the pool and the fence. His concern was for meter readers, or anyone who would possibly go in the back yard. Discussion. City Manager indicated there was only 18' from the property line to the house, and again expressed concerns regarding safety. Curt Roberts indicated there would be 7 feet left after the pool was in , and he would have four feet on one side, and three feet on the other side. Discussion. Bobby Frizzell moved to approve the request. Sherry Lewis seconded. Motion carried unanimously. 5. Any Other Such Matters. None. 6. Meeting Adjourned. Approved I
