07/05/2002-BOA-Minutes-RegularI MINUTES: Board of Adjustments July 5, 2001 PRESENT: Jerry Jenkins, Ginger Burt, Sherry Lewis, Lisa Hardy, Bobby Frizzell, Mike James ABSENT: Russell Madden, Nel Armstrong OTHERS PRESENT: City Manager Jack Smith, City Secretary/ Assistant City Manager Rose Chavez, Administrative Assistant Samantha Renz, Mike Watkins, Becky Watkins, Johnny Looper 1. Chairperson Jerry Jenkins Called Meeting to Order. 2. Approve Minutes -May 31, 2001 Jerry Jenkins indicated on item #2, Ralph Cain did not second the motion, it was Russell Madden. Bobby Frizzell moved to approve the minutes as corrected. Sherry Lewis seconded. Motion carried unanimously. 3. Conduct Public Hearing to Consider a Variance Request Concerning Setbacks on property legally described as Abstract 1241 H. Tierwester Survey, Tract 133. Property is located at 1109 Pecan St. 4. Public Hearing opened. Mike Watkins, 3220 Shadow Trail, indicated he was requesting the variance to face the doors on the auto repair shop to the West. He would like to put the back of the building on the East side of the lot, and it would be 10 feet off the property line. The property owner, Mr. Lynch does not have a problem with it, and actually would prefer that he face the doors to the back of Dairy Queen. Public Hearing closed. Consider and Possible Action Regarding a Variance Request Concerning on property legally described as Abstract 1241 H. Tierwester Survey, Tract 133. Property is located at 1109 Pecan St. Chairperson Jenkins indicated Mr. Lynch is the main property owner in that area, and he expressed that he did not have a problem with this request. He continued to discuss the drainage situation from Dairy Queen's parking lot. He indicated the setbacks are fme with the exception of the east property line. He read the ordinance that stated a twenty foot setback was required. He advised Mr. Watkins he would still need to erect a fence on the sides and rear. He indicated the metal building ordinance would also come into play for this building. He indicated all sides visible from the street will need to be bricked. City Manager indicated his North Property line will abut Commercial property and a fence would not be required. Mr. Watkins indicated Mr. Lynch did not want him to fence the East side of the lot, because there are trees there that would have to come down. Discussion regarding the lot and the trees. Mr. Watkins indicated he would like to put the fence from the comer of the building to the road instead of at the property line. City Manager indicated that shouldn't be a problem. Mike James indicated he felt this was good for the City and would help solve the on-going drainage problem. Bobby Frizzell moved to approve the variance as presented and that he follow the City code as far as the drainage problem and work with the City on the fence situation, and comply with all other City ordinances. Mike James seconded. Motion carried unanimously. 5. Any Other Such Matters. New board members were welcomed -Ginger Burt, and Mike James. 6. Meeting Adjourned. Approved
