OTHERS PRESENT: City Secretary/Assistant City Manager Rose Chavez, Paula Morales, Michael Sanders, Jerry Jenkins, Rick Reynolds, Betty Bittle, Charles Bittle, Carroll McNeal. 1. Mary Ann Pyron called Meeting to Order. 2. Approve Minutes: July 1, 2004 Motion was made by Joe Falls to approve minutes as presented. Byron Moore seconded. Motion carried unanimously. 3. Conduct Public Hearing to Consider a Variance Request concerning Waiving the Sidewalk Requirements on Property Legally Described as Sullivan North Block 4(W65'). Property is Located at 809 FM 455. Public Hearing opened. No Discussion. Public Hearing closed 4. Consider and Possible Action regarding a Variance Request concerning Waiving the Sidewalk Requirements on Property Legally Described as Sullivan North Block 4(W65'). Property is Located at 809 FM 455. Rick Reynolds representing Nathan Hight addressed Board Members in regards to building a 45' x 75', 3218 sq. ft. building across the street from Sonic. The building will house two types of businesses, a Video Store and a Laundromat. The variance request is for no sidewalks. The over all parking spaces are 13 total, 9 in front and 4 at back. Discussion followed regarding the request. Motion made by Bryon Moore to grant request for waiver of sidewalk restriction at 809 FM 455. Seconded by John Looper. Motion carried unanimously. 5. Conduct Public Hearing to Consider a Variance Request concerning Landscaping Requirements on Property Legally Described as Sullivan North Block 4(W65'). I Property is Located at 809 FM 455. Public Hearing opened. No Discussion. Public Hearing closed. 6. Consider and Possible Action regarding a Variance Request concerning Landscaping Requirements on Property Legally Described as Sullivan North Block 4(W65'). Property is Located at 809 FM 455. Rick Reynolds presented a site plan,. He addressed the landscape on the property. Approximately 1.4% or 195 sq feet of the 10% is within FM 455 right of way of TXDOT. Motion made by Mark McNeal to approve variance concerning Landscaping approximately 1.4% or 195 sq feet of the 10% requirements. Seconded by Bryon Moore. 7. Conduct Public Hearing to Consider a Variance Request concerning Setback Requirements and Addition to Non-Conforming Building on Property Legally described as Lot 5, Block 1 Elm Street Addition. Property is located at 401 N. Stemmons Frwy. Public Hearing opened. No Discussion. Public Hearing closed. 8. Consider and Possible Action regarding a Variance Request concerning Setback Requirements and Addition to Non-Conforming Building on Property Legally described as Lot 5, Block 1 Elm Street Addition. Property is located at 401 N. Stemmons Frwy 9. Michael Sanders addressed the board in regards to the setback requirements. The property is a non conforming structure use. Motion made by Mark McNeal to grant variance requesting concerning setback on addition to Non-Conforming Building at 401 N. Stemmons Frwy. Seconded by John Looper. Meeting Adjourned. Approved I
