Adams, Shelley Ruland MEMBERS ABSENT: Pete Morris, Bobbye Robison, Joe Falls, John Looper, James Adams, Tracy Murphree OTHERS PRESENT: City Manager Jack Smith, City Secretary/ Assistant City Manager Rose Chavez, Virginia and Bill Killgo, Robert Patton, Shauna Stack, Danny Carrigan 1. Polly Dwyer called Meeting to Order. 2. Approve Minutes: January 19, 2006. Motion was made by Mark McNeal to approve minutes. Seconded by Carroll McNeill. Motion Carried. 3. Conduct Public Hearing to Consider a Variance Request Concerning Setback Regulations on the rear yard on property legally described as Sable Creek Addition Lot 33, Block 0. Property is located at 56 Heron Drive. 4. Acting Chairman Polly Dwyer declared Public Hearing open. City Manager indicated this variance request is for 3.2 feet to accommodate a bigger house on the lot. Chairman Polly Dwyer inquired as to whether the set back was 3.2 feet or the house was 3.2 feet larger. City Manager indicated that be believed the request was for a 3.2 foot rear setback. Public Hearing Closed. Consider and Possible Action Regarding a Variance Request Concerning Setback Regulations on the rear yard on property legally described as Sable Creek Addition Lot 33, Block O. Property is located at 56 Heron Drive. This item was postponed for later discussion in the meeting to allow the City Manager to caU the developer to fmd out information concerning his request Board expressed a concern on the variance request on a subdivision. Shelley Ruland indicated she had spoke with Sam Renz, who had called the City Attorney and advised this probably needed to be the last one that should be considered by the Board of Adjustment. These requests are continuing on new subdivisions which have been platted and approved by Planning and Zoning and the City Council. Developers should not have a need to come before the Board of Adjustments with a request. City Manager later returned and advised that they want a variance of 3.2 feet. Shelley Ruland made motion to approve the variance as requested. Seconded by Mark McNeal. Motion Carried unanimously. 5. Conduct Public Hearing to Consider a Variance Request Concerning Setback Regulations on the rear and side yards on property legally described as Abstract 1241 Tract 366, being 0.26 acres. Property is located at 219 S. 6th Street. Acting Chairman Polly Dwyer declared Public Hearing Open. Mrs. Virginia Killgo addressed the Board. They intend to make some improvements to their house. They need a variance in the front and side yards. Mrs. Killgo indicated that Mr. David Carrigan could address their questions concerning the improvements. 6. Consider and Possible Action on a Variance Request Concerning Setback Regulations on the rear and side yards on property legally described as Abstract 1241 Tract 366, being 0.26 acres. Property is located at 219 S. 6th Street. Mark McNeal asked why they needed this request, and indicated the house has been there a long time. Mr. Carrigan indicated they are adding about 160 square feet toward the inside of the property. This will add square footage to the house and the old house did not meet setback regulations. Discussion. Mark McNeal made the motion to approve the request as presented. Seconded by Shelley Ruland. Motion carried unanimously. 7. Meeting Adjourned. Approved
