01/08/1998-BOA-Minutes-RegularI MINUTES: Board of Adjustment January 8, 1998 PRESENT: Acting Chairperson Ben Weatherall, Allen Sweeney, Andy Garza, Russell Madden ABSENT: Francile Sullivan, Fred Yeatts, Bobbye Robison OTHERS PRESENT: Administrative Secretary Cheryl King, Mr. and Mrs. Tom Redus -Redus & Company 1. Acting Chairperson Ben Weatherall Called the Meeting to Order. 2. Approve Minutes. Two sets of Minutes were presented for approval -October 9, 1997 and October 23, 1997. Motion was made by Russell Madden to Approve Minutes from meeting on October 9, 1997. Seconded by Andy Garza. Motion Carried unanimously. Motion was made by Russell Madden to Approve Minutes from meeting on October 23, 1997 with one correction to be made showing Mr. Ben Weatherall as Present or Absent. Seconded by Andy Garza. Motion Carried unanimously. 3. Conduct Public Hearing to Consider a Property Setback Variance Request on property legally described as Abstract 1241, Block 2, Shirley Addition, also known as 403 S. 2nd. Action Chairperson Ben Weatherall Declared Public Hearing Opened. Tom Redus, President of Redus & Company addressed the board concerning the requested variance. Mr. Redus advised the board that they would have to face the house towards Marshall Street rather than 2nd Street in order to comply with the zoning requirements. Russell Madden verified the setbacks and that the house would have a 2-car garage. Lengthy discussion concerning the setbacks due to the proposed house not facing 2nd Street. There was some confusion about this as the previous structure faced 2nd Street, and the proposed new home's layout shows the house facing Marshall. Discussion was bad regarding the drainage and utility easements. I BOA MINUTES 01/08/98 PAGE2 Mr. Redus advised the board that this home would not be for rent, it would be sold. Also the address would change from 403 S. 2nd to 201 Marshall. The board then centered their discussion on the negative responses received. Acting Chairperson Ben Weatherall Declared the Public Hearing Closed. 4. Consider and Possible Action Regarding a Property Setback Variance Request on property legally described as Abstract 1241, Block 2, Shirley Addition, also known as 403 S. 2nd. Motion was made by Russell Madden to Approve Setback Variance Request as described in the letter to Property Owners on property legally described as Abstract 1241, Block 2, Shirley Addition. Seconded by Allen Sweeney. Motion Carried unanimously. 5. Any Other Such Matters. None. 6. Meeting Adjourned. Approved
