There being a quorum, Mayor Muir called the meeting to order on Monday July 20, 2020 at 7:00
p.m. The Invocation was given by Councilmember Dillon and the Pledge was led by

A motion was made by Mayor Pro Tem Bilyeu to approve the Consent Agenda removing Item b to

5.Resolution No. 070920 Appoint Municipal Judge and Alternate Municipal Judge
Consider, Discuss and Act on Resolution No. 070920 Appointing Municipal Judge, Danny
Spindle for a Two Year Term Commencing On July 20, 2020; And, Appointing Alternate Judge Art
Maldonado For A Two Year Term Commencing On July 20, 2020.
Municipal Court Clerk Christy Dyer summarized. Judge Spindle is the presiding Judge. Judge
Hartless has retired after 20 years as a Judge for the City of Sanger. If appointed, Art Maldonado
would step into his place as Alternate Judge. Mr. Maldonado has an extensive legal background
and would be a good fit. Mayor Pro Tem Bilyeu asked if the judges just cover each other. Ms.
Dyer noted that the Alternate Judge will do pretrials, bench trials, and Jury trials. Judge Spindle will
do show cause and juvenile dockets.
A motion was made by Mayor Pro Tem Bilyeu to approve Resolution No. 070920 appointing
Municipal Judge Danny Spindle for a twoyear term commencing on July 20, 2020 ; and appointing
Alternate Judge Art Maldonado for a twoyear term commencing on July 20, 2020. The motion
was seconded by Councilmember Clark. The motion carried unanimously (40 vote
Councilmember Chick absent).

6.Resolution No. 071020 Appoint Municipal Court Clerk And Deputy Municipal Court

Consider, Discuss and Act on Resolution No. 071020 Appointing the Municipal Court Clerk and
Deputy Municipal Court Clerk of the of Sanger Municipal Court; Authorizing the City Manager to
Oversee the Daily Operations and Performance of the Municipal Court Clerk and the Deputy Court
Clerk; And, Providing An Effective Date.
Mayor Muir noted that the City Charter requires appointment of the Municipal Court Clerk and
Deputy Court Clerk every two years and puts the Courts under the City Council. For personnel
matters, the City Attorney recommends that the City Manager be authorized to oversee the daily
operations and performance of the Municipal Court Clerk and the Deputy Court Clerk.
A motion was made by Mayor Pro Tem Bilyeu to approve Resolution No. 071020 appointing the
Municipal Court Clerk and Deputy Municipal Court Clerk of the Sanger Municipal Court;
Authorizing the City Manager to oversee the daily operations and performance of the Municipal
Court Clerk; and providing an effective date. The motion was seconded by Councilmember Clark.
The motion carried unanimously (40 vote Councilmember Chick absent).
7.Cornavirus Relief Fund Interlocal Agreement
Approve and Authorize the Mayor to Sign an Interlocal Cooperation Agreement for Grant Funding
Under the Coronavirus Relief Fund Between Denton County, Texas and the City of Sanger, Texas.
Mayor Muir read the Agenda Item and noted that this item was discussed briefly at last week's City
Council Work Session.
Director of Finance Clayton Gray noted that this Interlocal Cooperation Agreement is for grant
funding under the Coronavirus Relief Fund (CRF) between Denton Count and the City of Sanger.
This contract allows Denton County to grant money to the City for expenditures incurred due to the
effects of COVID19. Under the terms of the Agreement the County agrees to allocate to the City
the sum of $484,000 from the CRF which is $55.00 per person according to current population. At
the Work Session last week the, the City Council noted they were in favor of 10% of the CRF going
back to the businesses. There was discussion regarding whether the $48,400 in funds would be
going directly to Sanger businesses. Mr. Gray noted that Shannon Joski, Denton County advised
that this money would be specifically designated for Sanger businesses, but it does not mean that it it
will be all that the Sanger businesses will receive as there is additional funding available. Mayor
Muir noted that he felt it was the right thing to do to be be participatory. If the City of Sanger's
businesses apply they are going to look to these funds first. It may amplify the chances of our
businesses getting something, but will we for sure see every dime going back into our businesses, it
wont be that clear. Mayor Pro Tem Bilyeu agreed that this is the right thing to do, that the alternative
was to give 100% to the City and there would be no funds going to the businesses. Discussion
ensued regarding the funding of businesses and it was noted that for Sanger, in the first phase of
funding, seven businesses got approved and sixteen denied. The reason the businesses got denied
was because of not having the correct or complete information. It was noted that they could reapply
in the second round. City Manager Alina Ciocan noted that Economic Development Director Shani
Bradshaw had contacted Denton County today and they could not provide any numbers for the City
of Sanger funding for the second phase until they get through all of the applications. She noted that
Ms Bradshaw had also contacted the businesses in Sanger and let them know about the second
round of funding. The 4B Board may also have a small grant for funding to the small businesses.
Councilmember Dillion had a few questions about the separate account for the funding and how
payroll would be taken out of it. Director of Finance Clayton Gray advised that it would be through
a transfer each payroll. Denton County requested a separate account for auditing purposes. This

8.Ordinance 072020 Ordering and Providing Notice of General Election for Mayor and Two
City Council Members (Places 2 and 4); Authorize City Manager to Negotiate and Execute
an Election Contract with Denton County to Conduct Postponed Election.
Consider, Discuss and Possibly Act on Ordinance No. 072020 Ordering a General Election To
Be Held Jointly With Other Denton County Political Subdivisions For The Purpose of Electing A
Mayor and Two (2) City Council Members: City Council Member Place 2 and City Council
Member Place 4; Designating Locations Of Polling Places; Providing For Dates, Times, and Places
for Voting and Early Voting By Personal Appearance; Providing Deadline For Application for Ballot
By Mail; Ordering Notices of Election To be Posted and Published; Providing For An Effective
Date; And, Authorizing the City Manager to Negotiate and Execute an Election Contract With
Denton County For the Purposes of Conducting the Postponed May 2, 2020 Election on
November 3, 2020.
Mayor Muir read the item and asked if staff had any comments. City Secretary Cheryl Price noted
that this Ordinance calls the election and will provide for notice of the election. Typically we have
the contract with Denton County for conducting the election included in this item. Denton County
has not provided the Contract so staff is requesting that the City Manager be authorized to negotiate
and sign the contract when it is received. Mayor Muir noted that the election costs were not
typically negotiable since it is based on the number of voters, judges, precincts, etc.
A motion was made by Councilmember Clark to approve Ordinance No. 072020 ordering a
General Election to be held jointly with other Denton County Political Subdivisions For The purpose
of electing a Mayor and two (2) City Council Members: City Council Member Place 2 and City
Council Member Place 4; designating locations of Polling Places; providing for dates, times, and
places for voting and early voting by personal appearance; providing deadline for application for
Ballot By Mail; ordering Notices of Election to be posted and published; providing for an effective
date; and, authorizing the City Manager to negotiate and execute an Election Contract With Denton
County for the purposes of conducting the postponed May 2, 2020 Election on November 3,
2020. The motion was seconded by Councilmember Dillon. The motion carried unanimously (40
vote Councilmember Chick absent).

Municipal Court Clerk Christy Dyer summarized. Judge Spindle is the presiding Judge. JudgeHartless has retired after 20 years as a Judge for the City of Sanger. If appointed, Art Maldonadowould step into his place as Alternate Judge. Mr. Maldonado has an extensive legal backgroundand would be a good fit. Mayor Pro Tem Bilyeu asked if the judges just cover each other. Ms.Dyer noted that the Alternate Judge will do pretrials, bench trials, and Jury trials. Judge Spindle willdo show cause and juvenile dockets. Mayor Muir noted that the City Charter requires appointment of the Municipal Court Clerk andDeputy Court Clerk every two years and puts the Courts under the City Council. For personnelmatters, the City Attorney recommends that the City Manager be authorized to oversee the dailyoperations and performance of the Municipal Court Clerk and the Deputy Court Clerk. A motion was made by Mayor Pro Tem Bilyeu to approve Resolution No. 071020 appointing theMunicipal Court Clerk and Deputy Municipal Court Clerk of the Sanger Municipal Court;Authorizing the City Manager to oversee the daily operations and performance of the MunicipalCourt Clerk; and providing an effective date. The motion carried unanimously (40 vote Councilmember Chick absent). 7.Cornavirus Relief Fund Interlocal AgreementApprove and Authorize the Mayor to Sign an Interlocal Cooperation Agreement for Grant FundingUnder the Coronavirus Relief Fund Between Denton County, Texas and the City of Sanger, Texas.Mayor Muir read the Agenda Item and noted that this item was discussed briefly at last week's CityCouncil Work Session. Director of Finance Clayton Gray noted that this Interlocal Cooperation Agreement is for grantfunding under the Coronavirus Relief Fund (CRF) between Denton Count and the City of Sanger. This contract allows Denton County to grant money to the City for expenditures incurred due to theeffects of COVID19. Under the terms of the Agreement the County agrees to allocate to the Citythe sum of $484,000 from the CRF which is $55.00 per person according to current population. Atthe Work Session last week the, the City Council noted they were in favor of 10% of the CRF goingback to the businesses. There was discussion regarding whether the $48,400 in funds would begoing directly to Sanger businesses. Mr. Gray noted that Shannon Joski, Denton County advisedthat this money would be specifically designated for Sanger businesses, but it does not mean that it itwill be all that the Sanger businesses will receive as there is additional funding available. MayorMuir noted that he felt it was the right thing to do to be be participatory. If the City of Sanger'sbusinesses apply they are going to look to these funds first. It may amplify the chances of ourbusinesses getting something, but will we for sure see every dime going back into our businesses, itwont be that clear. Mayor Pro Tem Bilyeu agreed that this is the right thing to do, that the alternativewas to give 100% to the City and there would be no funds going to the businesses. Discussionensued regarding the funding of businesses and it was noted that for Sanger, in the first phase offunding, seven businesses got approved and sixteen denied. The reason the businesses got deniedwas because of not having the correct or complete information. It was noted that they could reapplyin the second round. City Manager Alina Ciocan noted that Economic Development Director ShaniBradshaw had contacted Denton County today and they could not provide any numbers for the Cityof Sanger funding for the second phase until they get through all of the applications. She noted thatMs Bradshaw had also contacted the businesses in Sanger and let them know about the secondround of funding. The 4B Board may also have a small grant for funding to the small businesses. Councilmember Dillion had a few questions about the separate account for the funding and howpayroll would be taken out of it. Director of Finance Clayton Gray advised that it would be througha transfer each payroll. Denton County requested a separate account for auditing purposes. Thiswould also make it easier for tracking the CRF funds. Discussion ensued. Mayor Muir read the item and asked if staff had any comments. City Secretary Cheryl Price notedthat this Ordinance calls the election and will provide for notice of the election. Typically we havethe contract with Denton County for conducting the election included in this item. Denton Countyhas not provided the Contract so staff is requesting that the City Manager be authorized to negotiateand sign the contract when it is received.
