AN ORDINANCE OF THE CITY OF SANGER, DENTON COUNTY, TEXAS,
CANCELING THE MAY 4, 2019 GENERAL ELECTION AND DECLARING EACH
UNOPPOSED CANDIDATE ELECTED TO OFFICE; PROVIDING FOR A VALIDITY
CLAUSE; PROVIDING A SEVERABILITY CLAUSE; FINDING AND DETERMINING
THAT THE MEETING AT WHICH THE ORDINANCE WAS PASSED WAS OPEN TO
THE PUBLIC AS REQUIRED BY LAW; PROVIDING FOR PUBLICATION IN THE
OFFICIAL NEWSPAPER; AND, PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SANGER,
TEXAS:
WHEREAS, the City of Sanger, Texas, is a home rule City acting under its charter; and
WHEREAS, in accordance with law, a General Election had been ordered for May 4,
2019, for the propose of electing three (3) City Council members to serve a two (2) year term on
the City Council in the City of Sanger, Texas; and
WHEREAS, no propositions or at -large races appeared on the ballot; and
WHEREAS, the filing deadlines for placement on the ballot and declaration of write-in
candidacy has passed; and
WHEREAS, the City Secretary has delivered such certification in writing to the City
Council that Marissa Barrett is unopposed for election to the office of City Council Member Place
1, and Dennis Dillion is unopposed for election to the office of City Council Member Place 3; and
David Clark is unopposed for election to the office of City Council Member Place 5; all are
unopposed for election to the offices of City Council Member Places 1, 3, and 5; and
WHEREAS, in these circumstances, Title 1, Chapter 2, Section 2.053, of the Texas
Election Code authorizes a governing body of a political subdivision by order of ordinance, to
declare each unopposed candidate elected to office and cancel the election;
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF SANGER, TEXAS, THAT:
SECTION 1. The following candidates who are unopposed in the May 4, 2019, General
Election, are hereby declared elected to office, to each serve a full two-year term and shall be
issued a certificate of election following the May 4, 2019 General Election Date and Official
Canvas of the Election:
City Council Member Place 1 Marissa Barrett
City Council Member Place 3 Dennis Dillon
City Council Member Place 5 David Clark
SECTION 2. That pursuant to Section 2.053 of the Texas Election Code, the General
Election for City Council Members Places 1, 3, and 5 called and ordered by Ordinance No. 02-01-
19 for the May 4, 2019 General Election, shall not be held and is hereby canceled.
SECTION 5. Validity. That all ordinances of the City of Sanger in conflict with the
provisions of this ordinance be, and the same are hereby superseded and all other provisions of the
ordinances of the City of Sanger not in conflict with the provisions of the ordinance shall remain
in full force and effect.
SECTION 6. Severability, That, should any paragraph, sentence, clause, phrase, or word
of this ordinance be declared unconstitutional or invalid for any reason, the remainder of this
ordinance shall not be affected.
SECTION 7. That, it is hereby found and determined that the meeting at which this
ordinance was passed was open to the public, as required by Section 551.001 et seq, of the Texas
Government Code, and that advance public notice of the time, place and purpose of said meeting
was given.
SECTION 8. This ordinance will take effect immediately from and after its passage, as
the law and Charter in such cases provide.
PASSED AND APPROVED this, the 4' Day of March, 2019, at the regular meeting of
the City Council of the City of Sanger, Texas with a vote of 15 in favor and 0 against, called
as follows:
