Re: Habitat for Humanity — Variance on Lot Width
Habitat for Humanity of Denton County is proposing to plat a parcel of land
into 4 lots. A copy of the plat layout is attached with the request. This
property is currently zoned Single Family 3, but is zoned according to our
old guidelines. The minimum lot size for this zoning is 6000 square feet;
however, the minimum lot width is 60 feet.
According to the proposed layout, the minimum lot size that Habitat is
requesting is 7,385.99 sq. feet.
The request is for the Board of Adjustments to grant a variance on the
minimum lot width from 60' wide to 50' wide.

wishing to build a new building to expand his business. This property is
zoned 1-1. The City of Sanger Zoning Ordinace states:

Re: Appeal — 700 S. Sternmons Drive
Dessert Industrial X-Ray, a Business which stores Radioactive
materials on -site
The City of Sanger's Building Inspector has determined that this business
should be in an Industrial Zoned District, with a Specific Use Permit. The
use which he has determined this falls under, in our schedule of uses, is
the following:
"Any use which could create an environmental problem due to
emissions, visual quality, odor, noise, hazard or similar factors"
The business is currently operating in a B-2 Zoning district without a
Certificate of Occupancy.
The property owner and business owner are requesting an appeal to the
Board of Adjustments regarding the zoning category. They feel this
business should be considered an "General Business Offices which is
allowed in the B-2 zoning district.
Attached is a letter from the Building Inspector and a letter from Sgt. Mike
Riley in reference to this business.
The property owner and business owner should be present to present
their appeal.

SUBJECT: 700 S. Stemmons
Ms. Renz:
Due to fire department response, I was made aware that the business at the
above location, Desert Industrial X-Ray, is storing radioactive materials in the
form of Iridium 192 on site. Our current zoning ordinance will allow businesses
having "Any use which could create an environmental problem due to emissions,
visual quality, odor noise, hazard or similar factors" to be located in the 1-1
(Industrial 1) or 1-2 (Industrial 2) districts with a Specific Use Permit approved by
the City Council. Desert Industrial X-Ray did not apply for a certificate of
occupancy as required by city ordinance and is currently occupying and
operating their business at 700 S. Stemmons.
I have been personally informed by Steve Barnes, manager of the Desert
Industrial X Ray facility, that this facility only handles/stores Uranium 238 &
Iridium 192. Steve also told me that he has permits from the appropriate state
and federal agencies for having these materials on site. I have not found permits
for anything but the Iridium for the Sanger, TX. location. I also don't believe that I
have been fully and truthfully informed on all hazardous materials that Desert
Industrial X-Ray handles. I also have questions regarding procedures for
handling hazardous materials which are apparently not in place at this location.
The Hazardous Materials Response & dandling Guide requires, in the event of
fire or disaster exposing tridium 192, evacuation of an area of 1000 feet radius
(calm day) around a facility storinglhandling the radioactive material. Within. this
area is an elementary school, apartment buildings, residential houses, public
swimming.pool andInterstate .35E.
Since the radioactive. materials are. too- close. in. proximity to.. heavily. populated
and high traffic areas, the fire department has no protective equipment -for
dealing with radioactive materials, and there is no evacuation plan in place for
this type of emergency, my recommendation is that any Special Use Permit for
which this company applies be denied on the basis of safety for both our citizens
and for our public safety personnel who must respond to emergency calls.

Attached, you will find information regarding a new business in town. The business is
located at 700 S. Stemmons (Austin & Stemmons). Normally you would not be given
information about a new business. However, this concerns an officer safety issue.
This new business does examinations of welding and the instruments that the
company uses to check the welds contains a radioactive material. The building has a
storage site where the material is kept. The owners of the business think that if the
building is broken into, the hazardous material is what will be taken.
It has been explained to me that the material is strong enough to be harmful if
you are exposed.
If you are dispatched to an alarm call, or while routinely checking the building you
find an open door, DO NOT enter the building. We have been instructed by Chief
- Amyx, because of the potential hazard, to wait outside the building until someone from
the business arrives on scene. Per their company policy, someone from the business is
required to respond to the scene within five (5) minutes.

41.2 Appeals
1. Procedure: Appeals may be taken to and before the Board of Adjustment by any person
aggrieved, or by any officer, department, board, or bureau of the city. Such appeal shall be made
and specifying the grounds thereof. The office or department from which the appeal is taken shall
forthwith transmit to the Board of Adjustment all of the minutes constituting the record upon
which the action appealed from was taken.
2. Stay of Proceedings: An appeal shall stay all proceedings in fintherance of the action
appealed from unless the Building Inspector shall certify to the Board of Adjustment that by
reason of facts in the certificate a stay would, in his opinion, cause imminent peril to life or
property, in which case proceedings shall not be stayed otherwise than by a restraining order
which may be granted by the Board of Adjustment or by a court of equity, after notice to the
office from whom the appeal is taken and on due cause shown.
3. Notice of Hearing on per. The Board shall fix a reasonable time for the hearing of the
appeal or other matter referred to it, and shall mail notices of such hearing to the petitioner and to
the owners of property lying within two hundred (200) feet of any point of the lot or portion
thereof on which a variation is desired, and to all other persons deemed by the Board to be
affected thereby. Such owners and persons shall be determined according to the current tax rolls
of the city. Depositing of such written notice in the mail shall be deemed sufficient compliance
therewith.
4. Decision by Board: The Board shall decide the appeal within a reasonable time. Upon the
hearing, any party may appear in person or by agent or attorney. The Board may reverse or affirm
wholly or partly or may modify the order, requirements, decisions or determination as in its
opinion ought to be made in the premises and to that end shall have all powers of the officer or
department from whom the appeal is taken.
5. Vote Necessary to Revise Order. The concurring vote of four (4) members of the board
shall be necessary to revise any order, requirement, decision or determination of any such
administrative official or to decide in favor of the application on any matter upon which it is
required to pass under this ordinance or to affect any variance in said ordinance.
