The evaluation of the two approaches to resolve the water quality issues may be influenced by stakeholders’, adjacent property owner’s, support. The stakeholder discussions are underway and have yet to come to a final determination of support. As the deadline to file an amendment to the City’s TPDES permit is in March 2021, staff recommends pursuing Phase 2 of the professional services agreement with Plummer Associates, Inc. for the TPDES Permitting and Related Enforcement Support, at this time with TPDES permit amendment application to include options for both the Stream Restoration approach and New Outfall approach. City of Sanger Stream Restoration for Wastewater Treatment Plant Amendment 2 The City of Sanger (City) has been prevented from moving forward with the amendment of their Texas Pollutant Discharge Elimination (TPDES) permit for the wastewater treatment plant for several years. The Texas Commission on Environmental Quality (TCEQ) cannot issue a new permit via the current outfall because water quality modeling has demonstrated that there is no effective effluent set that will maintain water quality standards in the receiving stream. Two approaches have been proposed to resolve this issue:  Restore the receiving stream to conditions that eliminate Paddock Lake, which is the reason the water quality model will not work (Stream Restoration Approach)  Move the discharge location to below Paddock Lake via a new discharge pipeline (New Outfall Approach). Page 6 2019-184-00 DECEMBER 2020 1 AMENDMENT NO.2 TO CITY OF SANGER STANDARD AGREEMENT FOR PROFESSIONAL SERVICES This Amendment modifies the Agreement dated (September 27, 2019) between the City of Sanger (“Owner”) and Plummer Associates, Inc. (“Engineer” or “Plummer”) for a Project generally described as Sanger Stream Restoration Design – Phase 2. This Amendment does not take effect until signed by both parties. The revisions the Agreement are limited to those specified below. All other provisions of the contract remain in effect. Exhibit A, Scope of Services, Basic Services – Phase 2 TPDES Permitting and Regulated Enforcement Support In September 2019, the City of Sanger (Owner) executed a contract with Plummer Associates, Inc., (Engineer) to provide professional services associated with restoring the receiving stream below the current discharge locations for the Owner’s wastewater treatment facility. Restoration of the stream would eliminate Paddock Lake and enable the Owner to continue to use the current discharge point. The alternative would be to construct a new outfall below the Paddock Lake dam. The contract includes a Phase 2 for Texas Pollutant Discharge Elimination System (TPDES) Permitting and Related Enforcement Support. The permitting approach is to submit an application for an amendment of the permit to allow the continued use of Outfall 001 and to add an outfall (Outfall 002) at a point below Paddock Lake. While it is unlikely that both of these outfalls will be needed, it is not possible at this time to know which alternative will be selected. By permitting both outfalls, the Owner has more discharge options available. In order to continue to use Outfall 001, an early meeting with the Texas Commission on Environmental Quality (TCEQ) is needed to discuss the strategy. The presumption at this time is that the TCEQ will allow the permit to be amended with Outfall 001 still available at the current flow of 0.98 million gallons per day (MGD). It is not assured that the TCEQ will allow this, but the early meeting should provide valuable information on how to proceed. In addition to the adding an outfall, the proposed permit amendment will request an increase in flow up to 1.86 MGD. The scope of services for the Phase 2 TPDES Permitting and Regulated Enforcement Support follows. Included are Basic Services, which identify those services that are known to be necessary at this time to complete the permit amendment. Additional Services, which include services that could become necessary or desired during the project are also identified in this scope. Additional Services will not be performed unless authorized by the Owner. A schedule of milestones for the permit amendment is provided that provides approximate time frames from completion of Basic Services. In addition, a budget for Basic Services is provided in Exhibit B. Page 7 2019-184-00 DECEMBER 2020 2 Basic Services Obtaining a permit application is critical to the success of the project. A permit with practical limits and flexible discharge options is necessary. In addition, Phase 2 requires close coordination with TCEQ, Owner, and Engineer. The TPDES Permitting and Enforcement Support includes the following tasks: 2.1 Strategy Development and Project Kick off The Engineer will meet with the Owner by video conference to discuss the application and permitting process for the project. The purpose of the meeting is to ensure that all aspects of the overall project are executed in coordination. The Engineer will meet with the TCEQ Water Quality Division to discuss the application process for the project. The purpose of this meeting is to establish with TCEQ the direction the project may take with respect to Outfall 001. The results of the meeting with TCEQ will be discussed to determine if changes in the permitting strategy are needed. The meeting will include coordination with other aspects of the project, such as the stream restoration project and relevant ongoing enforcement issues for the plant. The Engineer will prepare and submit meeting notes to the Owner and team. 2.2 Review and Finalize Water Quality Modeling The Engineer will finalize water quality modeling requirements for the permit amendment, including coordination with TCEQ water quality modelers to finalize the agency’s requirements for modeling Outfall 001 with an assumption that the Paddock Lake dam has been removed and the stream restored. The Engineer will prepare a draft technical memorandum on the modeling (modeling memorandum) and submit it to the TCEQ for review. The Engineer will finalize the modeling memorandum in coordination with the TCEQ. 2.3 Prepare Texas Pollutant Discharge Elimination System Permit Application Through a Declaration of Administrative Completeness by TCEQ Engineer will prepare an application to amend the TPDES permit for the wastewater treatment facility. To the extent possible, previous information and data used will be employed. The Engineer will coordinate with the Owner to obtain additional analytical data on effluent quality. A request for information will be prepared and submitted to the Owner. Engineer will complete the application and provide a draft to the Owner for review. Once finalized, the application will be submitted to the TCEQ for their review. The TCEQ will first perform an administrative review of the application. If there are any administrative deficiencies, the TCEQ will request changes and additional information. Engineer will prepare any necessary changes to the application and submit the changes to the TCEQ. Once all deficiencies are addressed, the TCEQ will declare the application administratively complete and provide the language for the first public notice to the Owner for publication in one or more local newspapers. Engineer will assist the Owner with the publication process. However, publication fees are the responsibility of the Owner. Page 8 2019-184-00 DECEMBER 2020 3 2. 4 Provide Regulatory Support During Permit Processing During the technical review and draft permit process, Engineer will coordinate with the TCEQ periodically to ensure their review is continuing as necessary. One additional meeting with the TCEQ during this task is anticipated. There are also a number of email or telephone contacts anticipated to discuss technical issues raised by the TCEQ. The TCEQ will provide an initial draft of the TPDES permit to the Owner for review. Engineer will perform a review of the draft permit, comparing it against requests made in the application or subsequent to the application. The draft permit will also be compared to the previous issued permit. Comments on the draft permit and requests to the TCEQ for changes are anticipated. Engineer will prepare a draft response-to-draft letter for the Owner’s review. Once the comment letter is finalized, the response letter will be submitted to the TCEQ for their consideration. For purposes of this scope of services, it is anticipated that the draft permit process will include a total of three rounds of draft permits from the TCEQ from the initial draft to a final draft prior to the final public notice. In each round, Engineer will review the draft permit and assist with the appropriate response to the TCEQ, which could include responses by letter, email, or telephone conferences. Once the draft permit is finalized and accepted by the Owner, TCEQ will provide the language for the final public notice for the permit. Engineer will assist the Owner with the publication process. However, publication fees are the responsibility of the Owner. Additional Services Additional Services are those services that may be required or desired by the Owner but cannot be defined sufficiently at this time to establish the Scope of Work and compensation. These services are not included in the scope of work for Basic Services. Additional Services may include the following  Any change in permitting strategy or permit application resulting from the TCEQ’s ruling about the continued use of Outfall 001, resulting from a change in approach for stream restoration, or enforcement actions of the TCEQ, that would significantly modify the approach outlined in this scope of services.  Coordination with City’s attorney or staff or other consultants regarding ongoing enforcement actions against the facility.  Additional meetings with TCEQ beyond those specified in Basic Services.  Additional water quality modeling beyond that already accomplished or planned under Basic Services.  Modifications to the permit application resulting from additional requirements of the TCEQ, once the agency has reviewed additional modeling.  Modifications to the permit application resulting from enforcement actions by the TCEQ.  Fees for application submission or costs for publication of notices.  Sampling, testing, or analysis beyond that included in Basic Services.  Additional meetings beyond that specified in Basic Services. Page 9 2019-184-00 DECEMBER 2020 4 Basic Services Schedule The project schedule for development of the application is driven primarily by the permit application due date, which is April 4, 2021. However, April 4, 2021 is a Sunday therefore the application will be due on the next business day. The TCEQ’s schedule for a major amendment is generally around 12 months but depends on the agency’s available resources for processing. Engineer will provide additional information on the processing schedule as it becomes available. Page 10 2019-184-00 DECEMBER 2020 5 Exhibit B Compensation 1. Basic Services Budget Owner shall pay Engineer for Basic Services of Engineer rendered for “Scope of Services” as provided in this agreement. Compensation for these Tasks shall be paid on a lump sum basis. Engineer will provide monthly invoices with estimates of the percent completion of the project as of the close of the month prior. The budget for Basic Services does not include the application fee, laboratory costs, and public notice publication costs, Owner will pay application fees, laboratory costs, and public notice costs. 3. Additional Services of Engineer Cost reimbursable compensation for Additional Services shall be based on Engineer’s hourly labor rates attached hereto as Table B -1 Hourly Rate Schedule for Professional Services. All direct expenses, including mileage, travel and lodging expenses, but excluding subcontract expenses, applied to the Additional Services of Engineer, shall be paid at invoice or internal office cost plus a fifteen percent (15%) service charge. Subcontract expenses shall be paid at direct cost plus a fifteen percent (15%) service charge. All sales, use, value added, business transfer, gross receipts, or other similar taxes will be added to Engineer's compensation when invoicing Owner. Section 4: If any section, article, paragraph, sentence, clause, phrase or word in this ordinance or application thereof to any person or circumstance is held invalid or unconstitutional by a court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of the ordinance and the City Council hereby declares it would have passed such remaining portions of the ordinances despite such invalidity, which remaining portions shall remain in full force and effect.
