This proposed single family estate-style subdivision is located in the extraterritorial jurisdiction of Sanger, on the west side of Metz Road, approximately 1,650 feet south of Lois Road. The overall property is approximately 97.9 Acres and will be developed in multiple phases. Phase 1 consisted of six (6) lots, Phase 2 proposes an additional eighteen (18) lots, each approximately one (1) acre in size. It is unknown at this time how the approximately 67 acres remaining will be subdivided in the future. Water line on Metz road will be tapped in two places with an 8” water line and Phase 2 lots will be serviced from these proposed water lines. Sanitary Sewer service will be provided with individual Onsite Treatment Systems (septic). A Drainage Area Map has been provided to show a majority of drainage will be directed to the pond(s) on the south side of the site. Drainage will be conveyed in ditches on each side of the new roads and in culverts under the roads when necessary. Enclosed is our application form, final plat checklist, and final plat. Additional information, including variance requests, has been provided below. Our proposed 50-acre development is generally located at the southeast corner of the intersection of F.M. 1190 and Highway 455. We are seeking to divide the existing tract of land into 77 residential lots and 1 green space lot. The development also includes the dedication of 7.5 acres for City right-of-way. The creation and build out of these 78 lots represents the full extent of the proposed development, and no additional improvements beyond those described herein are anticipated at this time. Additionally, despite a sincere effort to adhere to all applicable City Ordinances, we are asking for the following variances to be granted: 1. Code Section 10.106 (b)(2)(c)(i) – The subdivider shall, at his own cost and expense, pay for constructing all streets and alleys within his subdivision and one-half (1/2) of all existing and/or proposed perimeter streets. Monies for the construction of the one-half (1/2) street shall be placed in an escrow account if the construction of the street is to be deferred to a later date. Variance Request: We request to allow Union Hill Road (at the perimeter of our development) to remain in its existing condition without monies being placed in an escrow account. We are asking for this variance because our Traffic Impact Analysis (TIA) indicated the development would not create any significant increase in traffic along Union Hill Road; therefore, based on proportionality calculations, we are not responsible for improvements to the road. Additionally, the County is responsible for a portion of Union Hill Road adjacent to our site, and they have indicated improvements are not necessary. 2. Section 10.106 (c) – Concrete sidewalks shall be constructed on both sides of streets and thoroughfares, except in industrial areas and along residential/estate streets, by the subdivider. The sidewalks shall have a width of not less than four feet (4') and thickness of not less than four inches (4") and shall be constructed of three thousand (3,000) p.s.i. concrete on both sides of all streets within the subdivision and of a width not less than eight feet (8') on all major thoroughfares. Sidewalks shall be constructed one foot (1') from the property line within the street or thoroughfare right-of-way and shall extend along the street frontage including the side of corner lots and block ends. Variance Request: We request to install a 5’ wide sidewalk in lieu of an 8’ sidewalk along Highway 455. We are asking for this variance because we will be constructing a large drainage channel adjacent to Highway 455 that will provide a significant buffer between traffic and pedestrians. The typical desire to increase the distance between pedestrians and traffic by widening the sidewalk is alternatively met by the proposed channel. Additionally, we do not believe a sidewalk along a highway will be frequently utilized as a major pedestrian thoroughfare. This decreases the need for a wider sidewalk because it is unlikely strollers, bicycles, and pedestrians will all be routinely trying to share this sidewalk. b. Variance Request: We request to not install a sidewalk along Union Hill Road. We are asking for this variance for the same reasons provided in our request to allow Union Hill Road to remain in its existing condition. 3. Section 10.106 (g)(7)(7) – The use of underground electrical services and transmission lines is required for all subdivisions. Variance Request: We request to leave all existing overhead electrical lines in place. We are asking for this variance because the lines in question are existing, rather than proposed, and located at the perimeter of the development. We feel it would create an unnecessary hardship on the development to remove these functioning electric lines located within public right-of-way where it is common to have overhead electric lines. Provide incentives in areas and to businesses most likely to stimulate similar enhancements by other private entities. Section 2. Definitions The following definitions shall apply to the terms used in this Policy: Agreement:  A written performance agreement between the Board and the Applicant. Applicant: Shall mean the Property owner or business occupant signing the Application for a Property Enhancement Grant. Application:  Shall mean the Application for Property Enhancement Incentives as maintained by Staff. Board:  Shall mean the Board of Directors of the Sanger Texas Development Corporation of the City (STDC). City:  The City of Sanger, Texas. City Council:  The City Council of the City. Code Violations:  Shall be any violation of the City’s code of ordinances. Construction Costs: The cost of permits, fees, construction materials, and installation labor. All other associated costs are deemed excluded, including, but not exclusively, the following costs: design, construction document preparation, bidding, sweat equity and construction financing. Properties:    Only  properties  meeting  the  following  requirements  at  the  time  an  Application  is  submitted shall be eligible to receive Grants as outlined by this Policy:  3.1.1. Within the City:  Property must be located within the City’s municipal boundaries.  3.1.2. Non‐Residentially Zoned:  Property must be zoned for uses other than residential uses and the  current use of the Property may not be residential.  3.1.3. Tax‐Paying Entity:  The Property must be subject to the City’s Ad Valorem property tax.  3.1.4. Financial Standing:  Property shall be in good standing as it relates to taxes or any monies due  to the City or the STDC.  3.1.5. City Liens:  Property shall be in good standing as it relates to any liens held by the City.  3.1.6. Ownership:  Property owners must provide sufficient proof of ownership.  3.1.7. Code Violations:  Property must not have any outstanding code violations.  3.1.8. Frequency:  Property must not have received a Grant for the same category of Enhancement  (e.g. Façade, Landscaping) in a twelve (12) month period.  3.2. Businesses:  Only businesses meeting the following requirements shall be eligible to receive benefits  outlined by this Policy:  3.2.1. Financial Standing:  The business shall be in good standing as it relates to taxes or any monies  due to the City.  3.2.2. Tax‐Paying Entity:  The business must be a tax‐paying entity.   3.2.3. Operations in City:  The business must have maintained continuous operations in the City for  a minimum of six (6) months.  3.2.4. Aspirations:  As with any policy or regulation, it is difficult to precisely regulate factors that are not  easily defined.  With that in mind, the following are to be considered aspirations for contemplated  Enhancements:   Enhancements  should  be  compatible  with  the  character  and  architecture  of  the  individual  building and those in proximity;   Where appropriate, Enhancements may act as a catalyst to create a unique environment;   Enhancements should make the Property more inviting to the public; and   Enhancements should be functional as well as visually appealing.  4.2. General Enhancement Eligibility:  Property Enhancements shall be deemed as eligible or ineligible for  the benefits of this Policy as defined below.  In general, the following Enhancements, though not  exclusively, are ineligible for all Grants:    Any Enhancement that does not comply with existing ordinances of the City;   Any Enhancements made prior to the Notice to Proceed;   Sweat equity or “in‐kind” services;   New construction which is not specifically listed in this Policy as an Eligible Enhancement;   Any Enhancements to eliminate Code Violations of a Property or Business;    Fees for designing, engineering, surveying, legal services, financing, etc.; or   Any Enhancements not identified as eligible below.  A potential  applicant  may  discuss  an  enhancement not identified below with City staff to ascertain whether or not the enhancement  meets the Purpose and Intent of this Policy.  If so, an amendment to this Policy may be placed  before the Board to make a recommendation to the City Council who shall determine the merits  of including a new eligible enhancement.  4.3. Façade Enhancements:  The following are Eligible Enhancements except as noted otherwise:  4.3.1. Façade Materials:  Replacing deteriorated or unsafe façade materials with brick, stone, tile,  wood, or siding meeting the City’s masonry requirements or architectural standards, if any.   Removal of “slip” coverings of prior façade materials and re‐establishment of historic façade  details.  Repointing of mortared joints, replacement or repair of damaged masonry.  4.3.2. Cleaning:  Pressure washing or sand blasting existing facades, cleaning of tiles.  4.3.3. Painting:  Scraping, priming and otherwise preparing the surface and painting.  4.3.4. Window / Doors:  Replacement of or improvements to existing windows or doors that are  visible from a public street.  New windows and doors matching replaced windows or doors.   Replacement of broken glass panes.   4.3.5. Awnings / Canopies:  Replacement of or improvements to existing awnings or canopies.  New  awnings or canopies.  4.3.6. Historical Restoration:  Restoration of architectural details of historic significance and / or  removal of elements covering such details.  4.3.7. Roof Repair:  Replacement or repair of all or portions of the roof.  4.3.8. Ineligible:  Though not an all‐inclusive list, the following are specifically not eligible:  burglar  bars, painting a new building.  4.4. Interior Renovation:  The following are Eligible Enhancements except as noted otherwise:    4.4.1. Renovations:  Renovations that enhance the commercial usability of the building.  4.4.2. Ineligible:  Though not an all‐inclusive list, the following are specifically not eligible:  painting,  wallpaper, aesthetic treatments, and lighting.  4.5. Landscaping:  The following are Eligible Enhancements except as noted otherwise:    4.5.1. Edging:  Providing a perimeter to shrub beds with materials deemed to be of a long life, e.g.  brick, stone, concrete, steel.  4.5.2. Shrubs and Trees:  Shrubs and / or trees of a variety that are sustainable in the area when  combined with removal of existing shrubs and / or trees that are either overgrown or of poor  quality.  4.5.3. Seasonal Color:  Providing one‐time planting of annual or perennial flowers in critical areas  adequate to provide an appealing impact.  4.5.4. Irrigation:  Automatic irrigation system complying with all code requirements.  Irrigation may  be required with any other Landscaping Grant.  4.5.5. Lawn Renovation:  Removal or re‐establishment of an existing lawn with a desirable type of  lawn.  (An automatic irrigation system is required with this Enhancement.)  4.5.6. Fencing:  Replacement of fencing or installation of new fencing that is visually appealing.    4.5.7. Ineligible:  Though not an all‐inclusive list, the following are specifically not eligible:  landscape  pruning, mowing and / or maintenance.  4.6. Lighting:  The following are Eligible Enhancements:  4.6.1. Pedestrian:  Increases in lighting in pedestrian areas on or adjacent to the Property, e.g.  sidewalks, parking lots.  4.6.2. Accents:  Lighting that accentuates features of the building or Property creating a pleasant  ambience on the Property.  4.6.3. Signage:  Lighting that illuminates signage identifying the business.  4.7. Parking / Driveways:  The following are Eligible Enhancements except as noted otherwise:  4.7.1. Reconstruction:  Removal of existing pavement, gravel, curbing, drives, accessibility ramps,  etc. and replacement with reconstruction meeting City requirements.  4.7.2. Resurfacing:  Re‐topping asphalt parking areas.  4.7.3. Restriping:  Repainting of parking stall stripes and / or fire lane graphics meeting the City’s  requirements.  4.7.4. Ineligible:    Though  not  an  all‐inclusive  list,  the  following  are  specifically  not  eligible:   Installation, repair or replacement of any surface that is not an all‐weather hard surface as  required by the City’s code of ordinances.  4.8. Pedestrian Amenities:  The following are Eligible Enhancements:  4.8.1. Paving:  Paving of a unique nature in areas that allow customers to congregate.  4.8.2. Shade:  Provisions for shading pedestrian areas to include permanent or temporary canopies,  awnings, umbrellas or similar shade structures.  4.8.4. Music:  Provisions for permanent installation of fixtures to accommodate providing music in  areas where customers congregate.  4.8.5. Trash Receptacles: Trash receptacles establishing or matching a  design  theme  utilized  throughout the pedestrian areas.  4.8.6. Play Equipment:  Recreational equipment intended for the entertainment of children when  placed on private property in close proximity to the primary building.  4.9. Signage:  The following are Eligible Enhancements. The replacement of signs that do not conform to  current City requirements is a priority for the City.  4.9.1. Replacing  Signs:    Replacing  existing  signs,  with  new  signage  that  complies  with  all  City  requirements.  4.9.2. New Signs:  New signs for existing or new businesses.  4.10. Utilities:  The following are Eligible Enhancements:    4.10.1. Franchise Utilities:  The upgrading or installation of new franchise utilities (e.g. electric, phone,  Internet) that increase the commercial capacity or functionality of a building.  4.10.2. Public Utilities:  The upgrading or installation of new public utilities (e.g. water, sanitary sewer,  gas) that increase the commercial capacity or functionality of a building.  4.10.3. Private Utilities:  The upgrading or installation of new private utilities (e.g. septic systems) that  increase the commercial capacity or functionality of a building.  4.10.4. Placement Underground:  The placement of existing or new utilities underground.  4.11. Code Compliance:  The following are Eligible Enhancements:  4.11.1. Public Accessibility:  Reconstruction or new construction to comply with public accessibility  requirements.  4.11.2. Fire Suppression Systems:  Replacement, upgrade, or installation of fire suppression systems  in compliance with current codes.  4.12. Demolition:    The  costs  of  demolishing  and  removing  existing  structures  on  a  Property  may  be  considered for Property Enhancements.  4.13. Participation Limitations:    The potential matching Grant for each type of Enhancement would be the  lesser of the Maximum Percentage or Maximum Per Enhancement Category Amount.  The Applicant  is responsible for the remaining costs of the Enhancement and must complete the full Enhancement  to be eligible for the matching Grant.  4.13.1. Maximum Percentage: A Maximum Percentage of fifty percent (50%) shall be the maximum  percentage of the total cost of any Enhancement that the City will grant the Applicant.  4.13.2. Maximum Per Enhancement Category: A Maximum Amount of five thousand dollars ($5,000)  is the maximum dollar amount to be granted for any category of Enhancement other than  Signage which shall have a Maximum Amount of one thousand dollars ($1,000).    4.13.3. Accumulative Maximum Grant:  Notwithstanding the Maximum Percentage and Maximum Per  Enhancement Category limitations for each type of Enhancement, no Property or Business may  receive more than five thousand dollars ($5,000) in matching Grants during one 12‐month  period.  The following examples are provided to clarify different application scenarios:  Page 56 Sanger, Texas     ‐     Property Enhancement Incentives Policy ‐     APPROVED 2021‐02‐01     ‐     Page 6 of 9   A. Example 1:  Applicant desires to do $24,000 in eligible Landscape Enhancements.  By  Policy, the maximum Grant allowed by the Max Percentage (50%) would be $12,000, but  the maximum Grant allowed by the Max Per Category would be $5,000.  The lesser of the  two is $5,000 which would be the maximum matching Grant for the $24,000 landscaping  project.  Further, within a 12‐month period the Applicant cannot receive additional grants  for any Enhancements (per Section 4.13.3).  B. Example 2:  Applicant desires to do $8,000 in eligible Landscape Enhancements.  By Policy,  the maximum Grant allowed by the Max Percentage (50%) would be $4,000, and the  maximum Grant allowed by the Max Per Category would be $5,000.  The lesser of the two  is $4,000 which would be the maximum matching Grant for the $8,000 landscaping  project.  Further, within a twelve‐month period the Applicant cannot receive more grants  for Landscape Enhancements (per Section 3.1.8), but may apply and receive a second  matching Grant, not to exceed $1,000 ($5,000 max ‐ $4,000 Grant) for any Enhancement  category other than Landscaping.  Section 5.  Grant Priorities  The City has determined that the following are priorities for the benefits of this Policy.  The evaluation of the  merits of any Application shall take into consideration whether or not the Application also meets these  priorities.  5.1. Preferred Areas:  The following areas of the City are areas of priority for implementation of this Policy:  5.1.1. Downtown Sanger; and  5.1.2. Areas where greatest benefit may be obtained.  5.2. Preferred Businesses:  The following types of businesses are a priority for implementation of this Policy:  5.2.1. Retail;  5.2.2. Restaurants;  5.2.3. Professional Office; and  5.2.4. Any sales‐tax generating business.  Section 6.  Administrative Procedures  Following  are  the  Administrative  Procedures  regarding  the  Application for and approval of Property  Enhancement Grants:  6.1. Application:  The submittal of an Application is required prior to any evaluation of the request for  Property Enhancement Grants.  The Application shall be on a form prepared by Staff and available on  the City’s website or at the location noted in 6.1.  Page 57 Sanger, Texas     ‐     Property Enhancement Incentives Policy ‐     APPROVED: 2021‐02‐01     ‐     Page 7 of 9   6.2.1. Required Information:  The following shall be included with the Application:  A. Proof of ownership of the Property;  B. Photographs of the existing Property;  C. Drawings, renderings, plans of the proposed Enhancements;  D. Written description of the Enhancements including building materials and color schemes  to be used;  E. Construction Cost estimates from at least two (2) different contractors; and  F. If Applicant is not the Property owner:  i. Written approval of the Application from the owner; and  ii. Copy of the signed lease agreement.  6.2.2. Amendments:  Staff may amend the form of the Application as needed to more efficiently  evaluate the merits of requested Enhancements.  6.3. Review & Evaluation:  Following are criteria to review and evaluate the Application:  6.3.1. Review Criteria:    A. Completeness of Application:  Completeness of the Application; including all required  attachments.  B. Grant Priorities:  Whether the Application includes a targeted business classification or  whether it is located in a targeted improvement area as defined in Section 5.  C. Impact:  An estimation of the impact that the Enhancements might have, particularly as a  catalyst for continued private investment.  D. Non‐funded Improvements:  Are the improvements associated with the Grant part of a  larger effort to enhance the Property.  E. Elimination of a Non‐Conformity:  Do the Enhancements eliminate a legal non‐conforming  aspect of the Property.  6.3.2. Staff Evaluation and Recommendation:  The coordinating Staff member shall convene a team  of the appropriate persons to evaluate the Application.  Upon review, such team shall prepare  a recommendation to forward to the Board.  A. Site Visit:  Prior to formal evaluation of the Application, the Applicant shall allow Staff the  opportunity to visit the Property to verify its status prior to any Enhancements.  6.4. Approval:  The Board shall make the final decision regarding the merits of the Application and the  appropriate Property Enhancement Grant to be given, if any, if funds are available as pre‐approved by  the Council for the funding period.  If approval of the Application requires funds not pre‐approved by  the Council, the board will prepare a recommendation to forward to the Council for final approval.   Upon approval of a matching Grant, the Board shall enter into an Agreement with the Applicant on a  form acceptable to the City Attorney.  The Agreement, at a minimum, must contain the following:   6.4.1. Enhancements:  List the specifications of the proposed Enhancements on the Property.  6.4.2. Access:  Provide the City and Staff access to the Property to ensure that the Enhancements or  repairs are made according to the specifications and conditions in the Agreement.  6.4.3. Recapture Provisions:  Provide for the repayment of a Grant if the Applicant or the condition  of the Property do not fulfill all obligations required under the Agreement.  The City may take  any remedy necessary to recover the funds, including filing a lien on the Property.  6.5. Pre‐Construction Meeting:  If the matching Grant is approved as noted above, and if deemed necessary  by Staff, the Applicant must attend a pre‐construction meeting with Staff to coordinate any required  permits, execute Grant documents, and resolve any questions either party might have.  6.6. Notice to Proceed:  Upon approval as noted above, Staff shall prepare and issue a written Notice to  Proceed authorizing the Applicant to begin work on the Enhancements.  The Notice to Proceed shall in  no event be regarded as the issuance or approval of a building permit or any other construction  permits.  6.6.1. Required:  All Grant documents, including the Agreement with the Board, must be executed  and all required permits must be received prior to issuance of the Notice to Proceed.  6.6.2. Beginning of Work:  All work must begin within sixty (60) days of the issuance of the Notice to  Proceed.  6.6.3. Completion of Work:  All work for approved projects must be com plete within ninety (90) days  of the Notice to Proceed unless an Applicant’s written request for extension is granted in  writing by the Board.  6.7. Construction:    All  construction  shall  be  in  accordance  with  all  requirements  for  permitting  and  inspection required by the City.  6.8. Verification:  Upon completion and approval of the work by the City, Staff shall verify that the work  has been performed as authorized in the approval action.  6.8.1. Documentation:  The Applicant shall provide Staff with documentation necessary to determine  the Construction Costs of the Enhancements as approved, e.g. copies of paid contractor  invoices,  receipts  or  processed checks.    Construction  Costs  not  supported  by  adequate  documentation shall not be eligible for reimbursement.  6.9. Payment:  Upon verification of compliance with the approval action, Staff shall cause a check to be  issued to the Applicant in the approved amount.  6.9.1. Cost Overruns:  Any costs above and beyond the amounts approved shall be the responsibility  of the Applicant.  Section 7.  Applicant / Owner Certifications  The Application shall include the following certifications which shall be affirmed by the Applicant / Owner by  signing the Application.  7.1. Application Accuracy:  The information provided in the Application, and all that may have been affixed  thereto, is true and correct, and that the City may rely on all of the information therein contained, and  all that may have been affixed thereto, as being true and correct.  7.2. Compliance:  I (we) certify that I am (we are) solely responsib le for all safety conditions and compliance  with all safety regulations, building codes, ordinance and other  applicable  regulations.    Neither  approval of an Application nor payment of a Property Enhancement Grant upon completion of the  project shall constitute approval of the project by any City department, Board Member or Staff or a  waiver by the City of any safety regulation, building code, ordinance or other applicable regulation.  7.3. Maintenance:  I (we) certify that the Enhancements, once approved by the City shall be maintained for  a period of three (3) years from the date of payment.  No changes shall be made without prior written  approval from the Board.    7.5. Discretionary Rights:  I (we) certify that I (we) acknowledge that the Board has the absolute right of  discretion in deciding whether or not to approve a matching Grant relative to the Application, whether  or not such discretion is deemed arbitrary or without basis in fact, including the right to approve or  disapprove a Grant on terms and conditions that are contrary to the guidelines of this Policy.  7.6. Policy Promotion:  I (we) authorize the Board to use an approved project to promote the merits of this  Policy, including but not limited to displaying a sign at the Property or Business during and within thirty  (30) days after construction, and using photographs and descriptions of the project in distribution  material, press releases, social media and on the City’s website.  7.7. Indemnification:  I (we) certify that I am (we are) solely responsible for overseeing the work, and will  not seek to hold the City, the Board, and / or their agents, employees, officers, and / or directors liable  for any property damage, personal injury, or other loss related in any way to this Policy, and by  submission of an Application, agree to indemnify the City, the Board and / or their agents, employees,  officers, and / or directors from any claims or damages resulting from the project, including reasonable  attorney fees.   Section 8.  General Provisions  8.1. Termination:  The City and / or the Board has the right to terminate any agreement under this Policy  for any reason.  8.2. Changes During Construction:  If an Applicant seeks to change the scope of their project after a Grant  has been approved, the Applicant shall meet with Staff to discuss the desired change.  Staff has the  authorization to approve minor modifications during construction.  Any other desired modification  shall be placed before the approving body for reconsideration.  8.3. Flexibility:  The terms and conditions of this Policy are a guideline for the Board and / or City Council  during their deliberation and evaluation.  The Board and / or City Council reserves the right to modify  the terms and conditions herein at any time, including for any pending application, and may approve  a Grant on terms and conditions contrary to the guidelines set forth in this Policy.  8.4. Section or Other Headings:  Section or other headings contained in this Policy are for reference  purposes only and shall not affect in any way the meaning or interpretation of this Policy.  8.5. Severability:  In the event that any provision of this Policy is determined to be illegal, invalid, or WHEREAS, Section 545.356 of the Texas Transportation Code, provides that whenever the governing body of the City shall determine upon the basis of an engineering and traffic investigation that any prima facie speed therein set forth is greater or less than is reasonable or safe under the conditions found to exist at any intersection or other place or upon any part of a street or highway within the City, taking into consideration the width and condition of the pavement and other circumstances on such portion of said street or highway, as well as the usual traffic thereon, said governing body may determine and declare a reasonable and safe prima facie speed limit thereat or thereon by the passage of an ordinance, which shall be effective when appropriate signs giving notice thereof are erected at such intersection or other place or part of the street or highway; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SANGER, TEXAS: SECTION 1. Upon the basis of an engineering and traffic investigation heretofore made as authorized by the provisions of Transportation Code, Section 545.356, the following prima facie speed limits hereafter indicated for vehicles on the attached Exhibit “A” (strip map) are hereby determined and declared to be reasonable and safe; and such speed limits are hereby fixed at the rate of speed indicated for vehicles traveling upon the named streets and highways, or parts thereof, described as follows: A. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SANGER, TEXAS: 1. That from and after the date of the passage of this speed zone ordinance, no motor vehicle shall be operated along and upon INTERSTATE Highway No. 35 within the corporate limits of the City of SANGER in excess of speeds now set forth in Exhibit “A”. Each Page 73 6 SECTION III INSURANCE INSURANCE REQUIREMENTS (IN THE MINIMUM OF) The successful bidder shall submit evidence of required insurance on an original Acord certificate not later than fifteen (15) working days following bid award notification. Failure to submit the required document(s) may result in rescinding the award. The bid may thereafter be awarded to the next lowest bidder. 1. An insurance certificate is required to be on file prior to the start of any work but is not required to be submitted at the time of the bid. 2. Commercial General Liability: $500,000.00 combined single limit per occurrence for bodily injury, personal injury and property damage. This policy shall have no coverages exclusions. 3. Automobile Liability: $500,000.00 combined single limit per occurrence for bodily injury and property damage. Coverage shall be provided as “Code 1,” any auto. 4. Workers’ Compensation Insurance: Coverage shall be provided which meets the statutory requirements of Texas Labor Code, Section 401.011 (44) for all employee providing services. 5. Employers’ Liability: Employers Liability policy limits of $100,000.00 for each occurrence, $500,000.00 policy limit. Other Insurance Provisions 1. The City shall be named as an additional insured on the Commercial General Liability and Automobile Liability Insurance policies. These insurance policies shall contain the appropriate additional insured endorsement signed by a person authorized by that insurer to bind coverage. 2. Each insurance policy required by this clause shall be endorsed to state that coverage shall not be suspended, voided, canceled, reduced in coverage or in limits unless thirty (30) days prior written notice has been proved to the City. 3. Insurance is to be placed with insurers with a Best rating of no less than AVII. The company must also be duly authorized to transact business in the State of Texas. 4. Employers’ Liability Coverage: The insurer shall agree to waive all rights of subrogation or indemnity against the City, its officials, employees and volunteers for losses arising from the activities under this contract. 5. Workers’ Compensation Insurance Coverage a. Certificate of coverage (“Certificate”) – A copy of a certificate of insurance, a certificate of authority to self-insure issued by the commission, or coverage agreement (TWCC-81, TWCC-82, TWCC-83 or TWCC-84), showing statutory workers’ compensation insurance coverage for the person’s or entity’s employee providing services on a project, for the duration of the project. b. Duration of the project – Includes the time from the beginning of the work on the project until the contractor’s/person’s work on the project has been completed and accepted by the governmental entity. 7. Persons providing services on the project (“subcontractor” in Section 406.096) – Includes all persons or entities performing all or part of the services the contractor has undertaken to perform on the project, regardless of whether that person contracted directly with the contractor and regardless of whether that person has employees. This includes, without limitation, independent contractors, subcontractors, leasing companies, motor carries, owner- operators, employees of any such entity, or employees of any providing, hauling, or delivering equipment or materials, or providing labor, transportation or other service related to a project. “Services” dos not include activities unrelated to the project, such as food/beverage vendors, office supply deliveries and delivery of portable toilets. 8. The contractor shall provide coverage, based on proper reporting of classification codes and payroll amounts and filing of any coverage agreements, which meets the statutory requirements of Texas Labor Code, Section 401.011(44) for all employees of the contractor providing services on the project, for the duration of the project. 9. The contractor must provide a certificate of coverage to the governmental entity prior to being awarded the contract. 10. If the coverage period shown on the contractor’s current certificate of coverage ends during the duration of the project, the contractor must, prior to the end of the coverage period, file a new certificate of coverage with the governmental entity showing that coverage has been extended. 11. The contractor shall obtain from each person or entity providing services on a project, and provide to the governmental entity: a. A certificate of coverage, for each person or entity prior to that person work on the project, showing coverage for all person providing services on the project; and b. No later than seven (7) days after receipt by the contractor, a new certificate of coverage showing extension of coverage, if the coverage period shown on the current certificate of coverage ends during the duration of the project. c. The contractor shall retain all required certificates of coverage for the duration of the project and for one (1) year thereafter. d. The contractor shall notify the governmental entity in writing by certified mail or personal delivery, within ten (10) days after the contractor knew Page 75 8 or should have known, of any change that material affects the provision of coverage of any person providing services on the project. e. The contractor shall post on each project site a notice, in the text, form and manner prescribed by the Texas Workers’ Compensation Commission, informing all persons providing services on the project that they are required to be covered, and stating how a person may verify coverage and report lack of coverage. f. The contractor shall contractually require each person with whom it contracts to provide services on a project, to: i. Provide coverage, based on proper reporting of classification codes and payroll amounts and filing of any coverage agreements, which meets the statutory requirements of Texas Labor Code, Section 401.011(44) for all of its employees providing services on the project, for the duration of the project; ii. Provide to the contractor, prior to that person beginning work on the project, a certificate of coverage showing that coverage is being provided for all employees of the person providing services on the project, for the duration of the project; iii. Provide the contractor, prior to the end of the coverage period, a new certificate of iv. Coverage showing extension of coverage, if the coverage period shown on the current certificate of cover ends during the duration of the project; v. Obtain from each other person with whom it contracts, and provide to the contractor; vi. A certificate of coverage, prior to the other person beginning work on the project; and a new certificate of coverage showing extension of coverage, prior to the end of the coverage period, if the coverage period shown on the current certificate of coverage ends during the duration of the project; vii. Retain all required certificates of coverage on file for the duration of the project and for one (1) year thereafter; viii. Notify the governmental entity in writing by certified mail or personal delivery, within then (10) days after the person knew or should have known, of any change that materially affects the provision of coverage of any person providing services on the project; and ix. To perform as required by paragraphs (1)-(7), with the certificates of coverage to be provided to the person for whom they are providing services. 12. By signing this contract or providing or causing to be provided a certificate of coverage, the contractor is representing to the governmental entity that al l employees of the contractor who will provide services on the project will be covered by workers; compensation coverage for the duration of the project, that the coverage will be based on proper reporting of classification codes and payroll amounts, and that all coverage agreements will be file with the Page 76 9 appropriate insurance carrier or, in the case of self-insured, with the commission’s Division of Self-Insurance Regulation. Providing false or misleading information may subject the contractor to administrative penalties, criminal penalties, civil penalties, or other civil actions. 13. The contractor’s failure to comply with any of these provisions is a breach of contract by the contractor which entitles the governmental entity to declare the contract void if the contractor does not remedy the breach within then (10) days after receipt of notice of breach from the governmental entity. Chris Hartung Owner/President Page 87 PROPOSED WORK PLAN Recruitment and Selection of a New City Manager for the City of Sanger, Texas SCOPE OF THE PROJECT Sanger, Texas is located in Denton County on Interstate 35, the major north/south corridor through Texas and the Midwestern United States. The 2015 estimated population was 7,590. The City has been ranked as one of the 25 best places to live and raise a family in Texas. The City is governed by a City Council composed of a Mayor and five City Councilmembers. The City Council operates under a Home Rule Charter which established the Council/Manager form of government. The Council appoints a City Manager to be the Chief Executive Officer for the City. Because of the resignation of the previous incumbent, the City Council is currently considering contracting with an executive recruiting firm to assist the City in the recruitment and section of the next City Manager. We understand the City will be seeking an experienced public management professional who can assist the City Council achieve the City’s vision for the community. This work plan has been developed to utilize the expertise and background of the consultant in partnership with the City Council. The goal of Chris Hartung Consulting, LLC is a search engagement which will give the City Council ‘Peace of Mind’ throughout the process. TASK ONE: DEVELOPMENT OF THE PROFILE AND ADVERTISING STRATEGY Chris Hartung Consulting, LLC conducts executive search assignments based upon the belief that the best predictor of success in a position is past success in the same or a similar position. Therefore, the process that follows is intended to describe the requirements of the position accurately and then to generate a pool of candidates who have accomplishments and experiences in areas of interest to the City Council. When authorized to begin this project, the Consultant will coordinate with the City Council to schedule meetings with the Council Members and others as directed by the City Council, to discuss the background, qualifications and personal characteristics which would make someone a truly outstanding candidate for this position. The Consultant will gather information about immediate issues that will confront the new City Manager during the first twelve to twenty-four months of employment. If desired by the City Council, the Consultant will interview other key stakeholders including city personnel and/or members of the community to gather additional perspectives on the position. During the initial discussions regarding this engagement, the Consultant will also gather information from the City staff to be used in the development of a community profile to be included with the advertising piece to be developed for this recruitment. We realize that often the decision to apply for a municipal executive position is a family decision as much as it is a career decision. For that reason, we will promote the Sanger position as not only a good career opportunity, but also promote the area as a great place to live. Because of our previous experience with the City of Sanger, we believe we are in a good position to be a strong advocate for this position. The Consultant will ask the City to designate one person to be the Project Coordinator and the primary contact for this recruitment. In addition, the Consultant will present an updated schedule for this assignment and will get concurrence from the City Council for the schedule. Following the initial stakeholder interviews, the Consultant will develop a profile describing the ideal candidate background as well as the priority issues which will face the new executive during the first twelve to twenty-four months of employment. This profile will be submitted to the Mayor and City Council for review and approval before its use in Task Two. Once the City has approved a profile, the Consultant will prepare a brochure based upon the profile to be used as an advertising piece during Task Two. The completed brochure will include instructions to interested parties indicating that they should forward their resume and other information directly to the Consultant. A sample brochure from the Bastrop recruitment is attached to this proposal. Page 88 Page 2 As part of Task One, the consultant will also advise the City Council regarding the placement of ads in various professional organization job posting web sites and/or journals as mutually agreed to by the Consultant and the City. This assistance will include the development and placement of ad copy for this position. Typical ad placements for the position of City Manager include the job boards of various professional organizations such as the Texas Municipal League and the International City/County Management Association. TASK TWO: RECRUITMENT OF OUTSTANDING CANDIDATES FOR THE POSITION Following completion of Task One and placement of the advertising, the Consultant will undertake a process of contacting, directly by telephone and electronically, individuals in city management as well as local government officials, consultants, and others with knowledge of local government to identify potential candidates for the position. Our experience in similar searches of this kind has shown us that often the best qualified candidates are not in the active job market and may not respond to traditional advertising approaches or to spam e-mails. The Consultant will focus his efforts on personal outreach and extensively circulating the brochure developed during Task One. Throughout this effort, the Consultant will actively promote this position as a good career and family opportunity. The Consultant will acknowledge receipt of all resumes to the applicants and will prepare a master list of applicants for this position. It is recommended that the position be posted by the City as “Open until filled”, so that resumes which come in after the first review date can be considered. TASK THREE: INITIAL SCREENING OF THE APPLICANT POOL Following the first review date, the Consultant will begin the screening process. Initially, applicant information will be reviewed to allow the Consultant to eliminate candidates whose information does not indicate the background and qualifications desired by the City as described in the profile developed in Task One. The Consultant will identify candidates who appear to meet the minimum qualifications and experience desired by the City. A questionnaire will be submitted to these candidates seeking additional information about the applicant's background and accomplishments in several specific areas of importance to the City of Sanger as described in the profile developed in Task One. Once the questionnaires have been completed and returned to CHC, it is anticipated that the Consultant will meet with the City Council to discuss the pool of candidates for the position. The objective of this discussion will be to identify a group of six to ten candidates for the Consultant to invite to participate in a video interview and a telephone interview with the Consultant. Chris Hartung Consulting, LLC is proud to be able to make available video interviewing through Interviewstream. (See information on page 3.) The video interviews will be designed to provide the Consultant and the Client with additional information about these applicants’ experiences and accomplishments as well as provide an opportunity to see and hear their responses to the questions. The City Council will be provided with a link to the Interviewstream website which will provide access to the video interviews at the convenience of the reviewer. The Consultant telephone interviews are intended to provide the Consultant with additional information about the candidates to allow the development of a recommendation to the City Council for a group of four to six candidates to be designated as finalists who will be scheduled for interviews with the City Council in Sanger. During this Task, the Consultant will conduct an Internet search for information published about any of the potential finalists. As a final step in this Task, the Consultant will meet with the City Council to discuss the results of the initial screening of the candidates and the video interviews. The objectives of this meeting will be to identify the finalists to be interviewed by the City Council and to develop a schedule for the final interview process. With concurrence of the City, the Consultant will move forward to Task Four, Gathering of Reference Information. Page 90 Page 4 TASK FOUR: GATHERING OF REFERENCE INFORMATION Upon completion of Task Three, the Consultant will obtain a release from this group of finalists, allowing him to contact references and to gather information about his/her background including education verification in accordance with the federal Fair Credit Reporting Act (FCRA). The candidates will also be given information about the schedule for interviews in Sanger. The main effort in Task Four will be to contact named and unnamed references to gather information about what others think about the work experience and accomplishments of the potential finalists. The Consultant will request at least ten named references from the candidates and will contact at least seven of them. We will also contact other individuals familiar with the candidates’ work experience but not named as references as well. Because we consider the reference calls a vital part of the screening process, Chris Hartung will personally contact these individuals. This task will not be delegated to support personnel. In addition, if authorized by the City, the Consultant will investigate social media, court records, driver license, and educational clearinghouses to determine if there are any problems in these areas of a candidate's background that the City Council should be aware of. If negative information is discovered during this Task, the City Council will be informed as soon as possible. TASK FIVE: FINAL INTERVIEW PROCESS AND COMPLETION OF SEARCH As part of the base fee, the Consultant will be available to assist the City Council as needed in the preparation and conduct of the final interviews for this position in Sanger. The Consultant will notify finalists about the schedule and other details of the interview process. Candidate travel expenses are the responsibility of the City. The Consultant will prepare a binder containing information on the finalists for this position for the City Councilmembers. This information will be sent to the City several days prior to the interviews. The information included in the Final Book will include the resumes and other information provided by the candidates, the questionnaire completed by the finalists, the interview notes from the Consultant's interview with the finalists as well as the written reference notes. (Reference notes are typically only provided to the hiring authority and those in the hiring chain, but not to potential peers, subordinates or outside panel members.) The Final Books will also include a set of suggested interview questions for the City Council. The Consultant will be available to attend the final interviews, not to participate in the questioning of candidates, but to assist the City Council and facilitate discussion if desired. Following completion of the interviews for a position, the Consultant will also be available to assist in negotiations of a salary and benefit offer and/or employment agreement with the selected candidate. GUARANTEE CHC is offering a three-way guarantee to the City of Sanger if selected to conduct the search as outlined in this work plan. (1) If for some reason, the City is not able to appoint a candidate following the initial group of interviews for a position, the Consultant will work to develop an additional group of finalists for the position for the City Council to consider. CHC will stay with the process until an appointment is made for the basic fee outlined in the proposal dated January 27, 2021. (2) CHC also commits to not solicit any selected candidate for other search assignments during his/her tenure with the City of Sanger. (3) If the candidate selected as a result of this contract is terminated or resigns within twelve months of appointment, CHC will conduct a new search to fill the position for no additional fee, but only with the reimbursement of out-of pocket expenses. Page 91 Page 5 PROPOSED FEE AND EXPENSES The fee for professional services to conduct the recruitment engagement as described in this proposal is $18,000, plus reimbursement for out-of-pocket expenses. Reimbursement for out of pocket expenses typically includes the direct cost for advertising, printing, postage/shipping, consultant mileage and travel expenses, and third-party background research, but does not include costs for candidate travel which are handled directly by the City. The fee includes up to six trips to Sanger during the search process including the final interview sessions. If additional trips or additional services beyond the scope of this proposal are requested by the City, an additional fee may be requested. The fee for professional services is due and payable according to the following schedule: $4000 due at completion of Task One, $3000 at completion of Task Two, $2000 at completion of questionnaires in Task Three, $2000 at completion of Task Three, $3000 at Completion of Task Four, $2000 at submission of the finalist binders prior to the interviews in Task Five, and $2000 when the search is finalized and the appointment is made. Expenses will be billed as incurred. Payments should be sent to Chris Hartung Consulting, LLC, P.O. Box 434, Bedford, Texas 76095. Chris has over twenty-five years of public sector consulting experience in the areas of executive search, compensation, classification and other management consulting projects. He also has 20 years of experience as a manager in city government, including service as Director of Finance, Assistant City Manager, and City Manager in full-service municipalities with populations ranging from 15,000 to 160,000. He served for eight (8) years as City Manager of Denton, TX and for seven (7) years as Assistant City Manager for the City of Garland, Texas. Chris is proud of the fact that both Garland and Denton developed reputations for being able to recruit and maintain highly qualified professional staff members. Chris has conducted management-consulting assignments in a number of areas including compensation planning and implementation, strategic planning, organizational staffing, total quality management, and executive recruitment.
