2. Approve Minutes: April 29, 2004
Polly Dwyer moved to approve the minutes as presented. Katharine Wordell seconded.
Motion carried unanimously.
3. Conduct Public Hearing to Consider a Zoning Request Change to the PD (Planned
Development) Zoning on Property Legally Described as Abstract 1241 in the Henry
Tierwester Survey, Tract 87 & 88.
Public Hearing opened.
Allen Bussell, indicated he revised the plan to include Single Family. The old plan was
good for long term, but not for short term. He went over the proposal on the layout.
The limit of commercial area is shown on the plan and written in the write up.
Discussed assisted living area. Discussed single family area.
Mr. Bussell indicated they changed the homes to 2000 square ft. minimum living area.
They would like the front yard setback to be 20 feet. They would like the side yard on
corner lots to have 15 ft. setbacks. They are proposing to line the street up with Laney
Drive. He continued to go through the planned development proposal. Sidewalks will
be constructed per code. Parking lot will have trees every 12 spaces maximum, with an
island every twelve spaces. Two out of three islands will have a large tree. Everything
will have automatic irrigation systems. There will not be any signs on Keaton Road.
Discussed landscaping and irrigation.
Mr. Bussell indicated there is a two story limit on assisted living. The maximum will be
80 units on assisted living.
Don Jost,102 Holt Street, asked if the office and small retail will be two story or one
story.
Mr. Bussell indicated that would be in the B2 area, and would possibly be two story.
Mr. Jost indciated there was parking in the residential area and asked if it was for the
assisted living.
Mr. Bussell indicated it was not for the assisted living, it was for the homes on that
street. It is a courtyard street.
Mr. Jost asked about the width of the street. He indicated originally they had a
boulevard. He asked if they will still have it.
Mr. Bussell indicated they did away with the boulevard.
Discussed the street and drainage.
Mr. Jost continued to express concerns regarding the proposed development. He felt it
should be changed best for the city.
Mr. Jost asked if they were going to put in the doctor's office and medical facility.
Mr. Bussell indicated they will not have the offices in the West area, it will all be in the
B2 area.
Mr. Jost expressed concerns regarding the maintenance of the property.
Mr. Jost asked about the cost of the homes.
Mr. Bussell indicated they will be $140-$160, 000 and up.
Dale Keith Roberts, 600 Keaton Rd., indicated he is adjacent on the South side of the
subject property. He is in favor of the assisted living, and felt it was a positive thing for
the community. The original plan had the road meeting Brooke Lane. This new plan
will have the road at his bedroom window. He indicated the detention ponds he has seen
are mosquito breeding grounds. If you have a 100 year flood you just store water to
breed mosquitos. He has done a lot of landscaping around his home to keep the water
from settling to keep the mosquitos away. He indicated he would like to see a
controlled intersection, not just a four way stop. Mr. Roberts expressed concerns
regarding the speed on Keaton Road. He felt more traffic control should be required.
He indicated he would prefer the road meet Brooke Lane. Mr. Roberts expressed
concerns regarding increased taxes. He also indicated he would like to see garden areas
in the assisted living sections.
Teri Voss, 1803 Duck Creek, expressed concerns regarding the differences in the
existing planned development and this new plan.
4. Consider and Possible Action Regarding a Zoning Request Change to the PD (Planned
Development) Zoning on Property Legally Described as Abstract 1241 in the Henry
Tierwester Survey, Tract 87 & 88.
Discussion regarding the fence.
Polly Dwyer asked if they would be willing to put in an 8 foot fence all the way down the
North side.
The developers indicated they would.
Mr. Bussell indicated it would most likely be six foot in the residential.
Shelley Ruland indicated there is no park area.
Polly Dwyer asked about the roof pitch.
Mr. Bussell indicated it would be consistent with the homes on the North.
Mr. Bussell indicated he would be comfortable putting a minimum 6:12 pitch.
City Secretary indicated she was pleased they were building bigger homes. She had no
objection to this concept plan.
Discussion.
City Secretary indicated the only concern she had was the drainage issues.
Polly Dwyer asked if on the Single Family they would have varying elevations.
Discussion.
Polly Dwyer asked if these would be front entry garages.
Mr. Bussell indicated they will be front or J-entry.
Poly Dwyer asked about the 20 ft. front building line.
Mr. Bussell indicted he did not like to push it back more than that, this would enable
them to have a larger back yard. He liked it closer to the street. The rear yard is
minimum 25 feet.
Polly Dwyer asked if they will have 2 car garages.
Mr. Bussell indicated they will.
Discussion regarding setbacks.
Discussion regarding traffic on the main street.
City Manager indicated there will be no parking on that street.
Shelley Ruland indicated she liked that it will take traffic off of Keaton Road.
Polly Dwyer asked if there will be a garden plan in the assisted living area.
Mr. Bussell indicated it is not in the plan but they will have garden areas.
Discussion.
Polly Dwyer asked if there was any type of government assistance for this development.
Mr. Bussell indicated there was not.
Polly Dwyer indicated she would like to put in the PD that a garden area adequate for
residents of the assisted living areas will be included.
Discussed traffic lights.
Mr. Bussell indicated he felt they should require traffic control devices. They need to
have traffic combing devices that narrow intersections, or raise the street in the
intersections. He recommended the City consider adding this type of requirement to the
subdivision regulations.
Discussion regarding the main road.
Shelley Ruland indicated when they start dealing with water flow the detention
situation will really have to be addressed. As they get into this, they do not want to see
a detention pond, they want to see the water flow addressed.
Ralph Cain indicated that drainage was also his primary concern. He would hate to see
the people disappointed on something they approve where the drainage was inadequate.
He asked if they had full intention of taking care of the drainage.
Mr. Bussell indicated they would.
Polly Dwyer moved to approve the Planned Development with the changes as discussed
in the meeting, including a minimum 2000 square foot dwelling, no parking on the main
street, an 8 foot buffer between the commercial and residential areas, the elevations will
vary with ten different plans, they will have 2 car garages, minimum 6:12 roof pitch on
homes, garden areas adequate for assisted living, park areas as required by subdivision
regulations, all subdivision regulations will be met, and all drainage studies must be
approved. Katharine Wordell seconded. Motion carried unanimously.

Re: Change to Zoning Ordinance
Staff is proposing a change to the zoning ordinance regarding a maximum coverage of lots with
concrete and/or any other structures. We have had a situation, where an individual has covered his
entire yard with concrete and caused drainage problems for his neighbors. We would like to prevent
this in the future. For all single family zoning categories, the current ordinance states:
D. Maximum Lot Coverage: Forty percent (40%) by the main building; Sixty percent
(60%) by the main building, accessory buildings, driveways and parking.
