1. Jerry Jenkins called Meeting to Order.
2. Approve Minutes: December 30, 2004
Mike James moved to approve the minutes. Motion was seconded by Shelley Ruland.
Motion carried unanimously.
3. Conduct Public Hearing to Consider a zoning request change from Old Single Family
3 (Old SF-3) to Two-Family (2F) Zoning. The Property is Legally Described as OT
Sanger, Block 49, Lot 1. Property is Located at 604 Plum Street.
Earl Herrington, 512 Plum, addressed the board in favor of the zoning change. He
suggests the improvements would be good for the neighborhood.
4. Consider and Possible Action to Consider a zoning request change from Old Single
Family 3 (Old SF-3) to Two-Family (2F) Zoning. The Property is Legally Described as
OT Sanger, Block 49, Lot 1. Property is Located at 604 Plum Street.
Jerry Jenkins indicated he needed to see plats and square footage on the property. He
indicated that he would not make a change of this nature without a plat.
Shelley Ruland indicated that the owner was wanting a zoning change, not a plat
change.
Discussion. (Map found)
Jerry Jenkins indicated the home does not qualify to be a duplex and asked if it was
ever zoned for two-family.
City Manager indicated the property was never zoned for a duplex •

Polly Dwyer asked if the owner was converting a single family home into a duplex.
Shelly Ruland expressed concerns regarding the property and that she did not feel it
met the requirements for single family or two family zoning.
Discussion regarding the current use of the property.
City Manager indicted the property was a duplex at one time. The structure is grand-
fathered and should not be altered without this zoning change.
Discussion possibly issuing a Specific Use Permit.
Shelley Ruland discussed the plat will never conform to single family or duplex;
however, the better use of the property would be as a duplex.
Shelley Ruland moved to accept the zoning request change from Old Single Family 3
(Old SF-3) to Two-Family (2F) Zoning at Property is Legally Described as OT Sanger,
Block 49, Lot 1. Property is Located at 604 Plum Street.

Changes to the zoning ordinance require a public hearing. The first two items are in reference to the
Duplex zoning, the areas in gray on the original are the items that were removed in the proposed
ordinance. Both the original and proposed are attached.

SECTION 17
"2-F" TWO-FAMILY RESIDENTIAL (DUPLEX DISTRICT)
General Purpose and Description: The "2F" district is intended to provide the opportunity
for development which is two-family ( duplex~ in character, hut which encourage~
~ ndividuai ownership of each dweliing unit. The typical duplex lot is divided from from
to back, thus encouraging the sale of each dwelling unit, tQgether with the land \Q>Qtt
~hich it is situated, to the occupant.
17.1 Use Regulations: A building or premise shall be used for only the following
purposes:
1. Two-family residence (duplex).
2. Other uses as listed in Section 30 of this ordinance.
The following specific uses shall be permitted in a "2F" District when granted in
accordance with Section 31 :
1. Uses as listed in Section 30 of this ordinance.
17.2 Height Regulations: No building shall exceed thirty (30) feet in height. Accessory
buildings shall not exceed fifteen ( 15) feet in height.
17 .3 Area Regulations:
1. Size of Yards:
a. Front Yard: There shall be a front yard having a required depth of not less
than twenty-five (25) feet as measured from the front property line. Accessory
buildings shall have a setback of sixty (60) feet or greater.
b. Side Yard: There shall be a side yard on each side of a structure of not less
than eight (8) feet. A side yard adjacent to a side street shall be not less than
twenty (20) feet. No side yard for allowable nonresidential uses shall be less
than twenty-five (25) feet.
c. Rear Yard: There shall be a rear yard having a depth of not less than twenty-
five (25) feet. Minimum rear yard for accessory buildings shall not be less
than ten (10) feet.
2. Size of Lot:
a. Lot Area: No building shall be constructed on any lot of less than six thousand
five hundred (6,500) square feet or three thousand two hundred fifty (3,250)
square feet per unit.

b. Lots in the 2F District mustbe platted in pairs such that a duplex unit may ~

c. Lot Width: The width of the lot shall be determined by the construction width
of individual dwelling units or dwelling units considering side yards as

d. Lot Depth: The average depth of the lot shall be not less than one hundred
(100) feet.
3. Minimum Dwelling, Size: Each dwelling unit shall be not less than nine hundred
(900) square feet, exclusive of garages and porches and breezeways.
4. Lot Coverage: In no case shall more than forty percent (40%) of the total lot area be
covered by the combined area of the main building. Accessory buildings, driveways and
parking may account for an additional twenty percent (20%) of the total lot area.
17.4 Parking Regulations: **One (1} covered and enclosed off-street parking space per
unit behind the front yard line is required. Off-street parking spaces shall be provided in
accordance with the requirements for specific uses set forth in Section 32.

The following are the procedures for the production of concrete for this portable concrete plant:
1) Raw material is delivered to the site by trucks.
2) Material is stored in stockpiles or silos.
3) Stockpiled material is carried to the plant by wheel loaders.
4) Dust emissions from this operation are controlled by water sprinkling.
5) Silo stored material is carried to the weigh hoppers by enclosed augers. Dust emission
from this operation is controlled by venting to the central bag house.
6) Weighed material and water are discharged into the central mixing drum and thoroughly
mixed. Dust emissions from this operation are controlled by venting to central bag hou$e.
7) Mixed material is discharged into open top dump trucks.
8) Dump trucks d~liver the material to the spreader.

It appears that all items from the original review have been addressed adequately.
Additional comments may be forthcoming by other staff members.
Additional comments that must be addressed with the Final Plat or any building plans
include:
• A dedication statement is required on the final plat. • The City cannot assure that the 60 foot Access and Utility Easement will coincide
satisfactorily with driveways allowed by TxDOT. It is the developer's
responsibility to satisfy himself that the lot/drive confiauration will work. A rep lat
may be needed to adjust drives and lot configurations depending upon where
TxDOT will permit a driveway(s). • Existing utility easements adjacei;tt to the lots should be dedicated with the final
plat • Existing offsite easements must be dedicated with future final plats.

Diane Peterson will address the board regarding this item. Attached is a letter from her, and a copy
of the ordinance regarding unlisted uses. She is wanting to put in a sign shop that may have some
welding involved. We do not have a current zoning category for this.

This letter is seeking approval for locating a new Company (Atitania, Ltd.) which has patents on new
techniques in the computer, memorabilia and signing industry in Sanger, Texas. The location for which I am
seeking approval is 803 Keaton, Sanger, Texas.
Further, I would like to know if your City has any incentives for locating new companies to Sanger.
Atitania, Ltd. is an environmentally friendly company. The Company needs approval to do business for
the following:
• Retailing for products and services
• Light Manufacturing for fencing, signage, memorabilia, carpentry, powder coating,
sandblasting, spot or tack welding, technology for printing metals, plastics, and
woods. and technology for cutting metals, plastics, and woods
• Distributing materials for signing, food, memorabilia, and fencing
• Storage for materials for food, signing, memorabilia, and fencing
• Preparing food
• Having proper signage
• Having facilities like bathroom, parking, and other entities
• Inspection for kitchen.
As the Company grows, it needs the approval for the ability to add additional buildings and possibly
a mobile home. These building possibly may be metal.
Since it is presently agricultural, the Company would like approval to retain this privilege and place animals
on the property. Also, it will for a time be my residence.
There is commercial on this street and a welder down the street.

Sanger Code of Ordinances
SECTION37
CLASSIFICATION OF NEW AND UNLISTED USES
37 .1 It is recognized that new types of land use will develop and forms of land use not
anticipated may seek to locate in the City. In order to provide for such changes and
contingencies, a determination as to the appropriate classification of any new or unlisted fonn of
land use shall be made as follows:
l. The building inspector shall refer the question concerning any new or unlisted use to
the Planning and Zoning Commission requesting an interpretation as to the zoning
classification into which such use should be placed. The referral of the use
1nterpretation question shall be accompanied by a statement of facts listing the nature
of the use and whether it involves dwelling activity, sales, processing, type of
product, storage and amount, and nature thereof, enclosed or open storage,
anticipated employment, transportation requirements, the amount of noise, odor,
fumes, dust, toxic material and vibration likely to be generated and the general
requirements for public utilities such as water and sanitary sewer.
2. The Planning and Zoning Commission shall consider the nature and described
perfonnance of the proposed use and its compatibility with the uses pennitted in the
various districts, and detennine the zoning district or districts within which such use
should be pennitted.
3. The Planning and Zoning Commission shall transmit its findings and
recommendations to the City Council as to the classification proposed for any new or
unlisted use. The City Council shall by resolution approve the recommendation of the
Planning and Zoning Commission or make such detennination concerning the
classification of such use as is detennined appropriate based upon its findings.
4. Standards for new and unlisted uses may be interpreted as those of a similar use. When
detennination of the minimum requirements cannot be readily ascertained, the same process
outlined in paragraphs 1, 2, and 3 above shall be followed.
