2. Approve Minutes September 15, 2005
Motion made by Ken Perry to approve minutes of September 15, 2005. Seconded by
Mike Walker. Motion carried unanimously.
3. Conduct a Public Hearing to Consider a Replat of Property Legally Described as Lot
3, Block 16 of the Hampton Addition. Property is Located at 901 Willow St.
Chairperson Jenkins declared Public Hearing Opened.
Ben Weatherall addressed the Board to obtain more information concerning the plat.
Mr. Weatherall did not have any objections after staff answered his questions.
Discussion.
Chairperson Jenkins Declared Public Hearing Closed.
4. Consider and Possible Action Regarding a Replat of Property Legally Described as Lot
3, Block 16 of the Hampton Addition. Property is Located at 901 Willow St.
Motion was made by Ken Wilson to approve the plat as presented. Seconded by Mike
Walker. Motion carried unanimously.
S. Conduct a Public Hearing to Consider a Rep lat of Property Legally Described Lots 15-
A and 15-B, Block 3, of Sanger South Subdivision. Property is Located at 130
Southside and on Cowling Road (Trinity Chapel).
Chairperson Jenkins declared Public Hearing Opened.

6. Consider and Possible Action Regarding a Replat of Property Legally Described Lots
15-A and 15-B, Block 3, of Sanger South Subdivision. Property is Located at 130
Southside and on Cowling Road (Trinity Chapel).
Discussion.
City Manager indicated that a Church can be in any zoning with a specific use permit.
Motion made by Mike Walker to approve Replat of Property Legally Described as Lots
15-A and 15-B, Block 3, of Sanger South Subdivision. Property is located at 130
Southside and on Cowling Road (Trinity Chapel).
Motion carried unanimously.
7. Conduct a Public Hearing to Consider a Replat of Property Legally Described as Lot
1, Block 11 of the Hampton Addition. Property is Located at 913 Marshall St.
Chairperson Jenkins declared Public Hearing Open.
Mr. Jim Brown addressed the Board with concerns on the Replat. Mr. Brown
indicated that he is wanting to buy the other lot and he thought it was already two lots.
Lengthy Discussion followed concerning this item.
Ms. Morbey, owner of said property, addressed the Board.
Apparently both individuals misunderstood what the replat entailed.
Chairperson declared Public hearing Closed.
8. Consider and Possible Action Regarding a Rep lat of Property Legally Described as Lot
1, Block 11 of the Hampton Addition. Property is Located at 913 Marshall St.
Motion was made by Ken Perry to approve Replat at 913 Marshall St. Seconded by
Paul Edelman. Motion carried unanimously.
9. Conduct a Public Hearing to Consider a Replat of Property Legally Described as O.T.
Sanger Lot 1 and Lot lR, Block 17. Property is Located on the Southwest comer of 4th
and Pecan Streets.
Chairperson Jenkins declared Public Hearing Opened.
Ben Weatherall addressed the Board in regards to getting more information concerning
this replat. This plat is currently in 83 zoning and does meet the requirements for the
replat process.
Mr. Zollinger, owner of the lot, indicated he was subdividing the lot to sell the empty
portion.
Ben Weatherall indicated that after the explanation he was opposed to this Replat.
City Manager indicated that on one the lots there is an existing home that is a non-
conforming use. This home has been on this lot prior to 1987, when the City adopted
their zoning; therefore, the replat meets all criteria for 83 zoning.
John Coker addressed the Board and indicated that this property is zoned all 8-3
which is the Central Business District. He also indicated that his concern was the width
of the lots and that they do not meet the minimum 5,000 sq. ft. requirement. He asked
the Board to disapprove the request. He also indicated that all lots in the area are
larger than this.
Public Hearing Closed.
10. Consider and Possible Action Regarding a Replat of Property Legally Described as
O.T. Sanger Lot 1 and Lot lR, Block 17. Property is Located on the Southwest comer
of 4th and Pecan Streets.
Lengthy Discussion.
Mr. Ken Zollinger, owner of this property, indicated this has been reviewed by the
City Engineer and has been approved.
Ken Wilson inquired as to the setback requirements.
City Manager advised this property is B-3 zoning which requires zero lot lines.
Chairman Jenkins inquired as to how many Replats the Planning & Zoning has
reviewed and how it is instigated.
Rose Chavez, City Secretary explained that the owner comes in and inquires as to the
process. The staff gives them the information and then it is up to them to follow the
guidelines. After the owner complies and City Engineer approves, it is then brought
to Planning & Zoning for approval.
Discussion.
Paul Edelman made motion to approve the replat as presented. Jerry Jenkins
seconded. Motion failed. 4-2. Voting against were Ken Wilson, Jerry Jenkins, Mike
Walker, and Ken Perry.
11. Consider and Possible Action on a Final Plat for Sanger Industrial Park, a S Lot
Subdivision in the Reuben Bebee Survey, Abstract No. 29. Property is Located along
F.M. 45S and along Spur 138.
Lengthy Discussion followed.
Concerns were expressed regarding the road that goes from the loop back into the
property.
City Manager indicated TXDOT cannot give them individual Right of Ways. The 60
ft. easement would be used as a street. TXDOT will not allow two driveways side by
side.
Discussion about entrance to property.
Chairperson Jenkins asked Pat Dunlap what he would recommend. Pat Dunlap
indicated that he had not looked at the plan.
Staff indicated that Lee Allison, City Engineer should be the one recommending
approval of the Final Plat, which he did.
Mike Walker made motion to not accept the plat for Sanger Industrial Park, a S Lot
Subdivision in the Reuben Bebee Survey, Abstract No. 29. Property is Located along
F.M. 45S and along Spur 138 based on the issues discussed.
Seconded by Ken Wilson.
Motion carried unanimously.

Re: Item #3 & #4 -Replat of 4th and Pecan
This property was on the last agenda of the Commission and was not approved; however, they have
met all requirements of the zoning ordinance. The property is currently zoned Business 3, this zoning
category allows a single family residence, as well as a business, it does not have a minimum lot size
nor does it have any setback requirements.
Attached is the City Attorney's opinion regarding this request. The Planning and Zoning Commission
and City Council are required by state law to approve this plat, unless it does not meet a city
regulation. We are unable to determine any area this plat fails to meet our ordinances.

§212.005 of the Texas Local Govt. Code states: "The municipal authority responsible for approving plats
must ap_prove a plat or replat that is required to be prepared under this subchapter and that satisfies all
applicable regulations." The P&Z is the 'municipal authority'.
Unlike in a zoning case, the replat cannot go to City Council for approval until it has been ap_proved by
P&Z. Perhaps the P&Z, as a body, can articulate some reason for not approving it, that is, that it does not
meet th~ applicable regulations in some way. The statutes also say that the Council's approval is "in
addition to that of the municipal planning commission." See §212.006 (a). It is not in lieu of P&Z
approval and it is not on P&Z's recommendation.
Approval of this replat is not discretionary on the part of P&Z, like !l zoning case, if the replat meets all
the rules. The P&Z members are subject to mandamus (order) by a District Court to approve it if they
can't specify reasons they didn't. In the event of mandamus, P&Z members could be held individually
liable to the property owner for court costs.

SECTION24
"8-3" CENTRAL BUSINESS DISTRICT
General Purpose and Description: The "B-3" district is intended to provide a zoning category to
meet the special needs and interests of the historically central commercial area of the community.
A variety of commercial uses are permitted although all permitted activities are conducted within
a building or structure.
24.1 Use Regulations: A building or premise shall be used only for the following purposes:
1. Uses permitted in the B-1 district.
2. Single family residential attached and multi-family dwellings.
3. Other uses as listed in Section 30 of this ordinance.
24.2 Height Regulations: No building shall exceed thirty-five (35) feet in height, except cooling
towers, vent stacks or mechanical ~quipment rooms may project not more than twelve (12) feet
beyond maximum building height.
24.3 Area Regulations:
1. Size of Yard:
a. Front Yard: None required.
b. Side Yard: None required, except where a B-3 district abuts a residential district
in which case a minimum side yard of ten (10) feet shall be provided. The side
yard setback from a side street shall be fifteen (15) feet.
c. Rear Yard: None required, except where a B-3 district abuts a residential district
(whether separated by an alley or not) in which case a minimum back yard of ten
(10) feet shall be provided.
2. Size of Lot:
a. Minimum Lot Size: None.
b. Minimum Lot Width: None.
c. Minimum Lot Death: None.

3. Lot Coverage: The maximum lot coverage by buildings shall be sixty (60) percent of
the lot area.
24.4 Parking Requirements: Off-street parking and loading shall be provided as set forth in
Section 32.

Allison Engineering Group recommends appro11al of the plan submittal. It appears that
all of our previous comments have been addressed. We remain conc.erned about the
ii rtersection geometry. It is not too significant an issue at the moment, but further
development of the industrial park will only serve to exacerbate the traffic conflicts with
I st and 2nd Streets. We may have to worlc with the deYeloper to add signage to the streets.
, Vhen FM 455 is improved, we may also need to work with TxDOT to modify the
i 1tersection, perhaps limiting movement from 1st Street or even eliminating the 1st Street
i 1tersection. Any additional development in the Industrial Parle that utilizes lndus1rial
J ~ venue should be required to address the intersection as a part of their development.
,illison Engineering's review of submittals for land development projects is only
ht.ended t.o establish a reasonable level of confidence that the developer is complying
, nth applicable rules and regulations. Our review is not intended t.o provide quality
control nor assure anyone that the development is fully compliant. The responsibility for
c:ompliance remains solely with the developer throughout the process; from zoning and

Attached are revised copies of the plans. Also attached is a copy of the TxDOT comments
from Tracy Beck and the latest construction plans for F.M. 455 that we obtained from
TxDOT. The revised plans show the planed F.M. 455 expansion at the bridge. Per my
meeting with Dave Hensley and Tracy Beck, it appeared that locating the culvert outside the
existing TxDOT R.O.W. would be the most expedient design. We have also changed the
TxDOT connection from Concrete to Asphalt to match the future expansion ofF.M. 455 and
increased the return radii to 30' to address some TxDOT concerns. Although TxDOT did a
courtesy review for us, Tracy indicated that the City of Sanger must make the official
submission. In your request to connect the proposed street to F.M. 455, Tracy asked that you
indicate your awareness of the separation conditions between Proposed Industrial A venue
and existing 1st and 2nd streets.
Please verify that we have made the appropriate revisions and schedule the Final Plat for
approval. The following is a summary of the revisions we have made to address your
comments.
Plat Sheet
Comment 1. Industrial A venue is not shown on the preliminary plat on file at the City of
Sanger. Please provide a copy of the approved Preliminary Plat that shows Industrial
Avenue. We are concerned about the alignment if Industrial Avenue with regard to the
adjacent intersections of 1st and 2nd streets. A TxDOT Permit is required and we also do not
believe that the location will meet TxDOT's intersection (access) spacing requirements. We
recommend that a meeting be scheduled with City Staff to discuss these issues.

Comment 2. There is confusion on the name of the plat with Indian Country on title strip,
and Industrial Avenue on the Cover Sheet. Please co-ordinate for uniformity.

required and we also do not believe that the location will meet TxDOr s
int.ersection ( access) spacing requirements. We recommend that a meeting be
scheduled with City Staff to discuss these issues.

SECTION2S
"1-1" INDUSTRIAL DISTRICT
General Purpose and Description: The 1-1 District is established to accommodate those uses
which are of a non-nuisance type located in relative proximity to residential areas, and to
preserve and protect lands designated on the comprehensive plan for industrial development and
use from the intrusion of certain incompatible uses which might impede the development and use
of lands for industrial purpose. Development in the 1-1 District is limited primarily to certain
wholesale and jobbing commercial uses and certain industrial uses, such as the fabrication of
materials, and specialized manufacturing and research institutions, all of a non-nuisance type. No
use or types of uses specifically limited to the 1-2 District may be permitted in the 1-1 District.
2S.1 Use Regulations: Uses permitted in the 1-1 District are subject to the following conditions:
1. All business, servicing, or processing, except for off-street parking, off-street loading,
display of merchandise for sale to the public, and establishments of the "drive-in"
type, shall be conducted within completely enclosed areas.
2. All storage within one hundred feet ( 100') of a residence district, except for motor
vehicles in operable condition, shall be within completely enclosed buildings or
effectively screened with screening not less than six feet ( 6') nor more than eight feet
(8') in height, provided no storage located within fifty feet (50) of such screening shall
exceed the maximum height of such screening.
3. Permitted uses in the 1-1 District shall not disseminate dust, fumes, gas, noxious odor,
smoke, glare, or other atmospheric influence.
4. Permitted uses in the 1-1 District shall produce no noise exceeding in intensity, at the
boundary of the property, the average intensity of noise of street traffic.
5. Permitted uses in the 1-1 District shall not create fire hazards on surrounding property.
Permitted uses in the 1-1 District include the following:
1. Advertising products, such as signs and billboards (manufacturing of).
2. Ambulance, bus, train, and taxi stations, truck yards;
3. Awnings, Venetian blinds, and window shades (manufacturing of);
4. Bakery, candy, dairy and other food products, but not including fish and meat

products, sauerkraut, vinegar, yeast, alcohol or alcoholic beverages;
5. Building materials yard, contractor's yard, lumberyard;
6. Cameras and other photographic equipment (manufacturing of);
7. Ceramic products, such as pottery, figurines, and small glazed tiles;
8. Ice plants, cold storage plants;
9. Jewelry;
10. Machine -shops and fabrication of metal not more than ten (10) gauge in thickness;
11. Metal stamping and extrusion of small products, such as costume jewelry, pins and
needles, razor blades, bottle caps, buttons, and kitchen utensils;
12. Milk and ice cream processing.
13. Mobile home sales.
14. Musical instruments;
15. Orthopedic and medical appliances, such as artificial limbs, braces, supports, and
stretchers;
16. Repair of farm, household, office machinery or equipment;
17. Scientific and precision instruments (manufacturing of);
18. Sheet metal shops;
19. Public utility and public service uses as follows:
(a) Bus stations, bus terminals, bus turnaround (off-street), bus garages, and bus
lots;
(b) Electric substations;
( c) Radio and television towers;
( d) Railroad passenger stations;

( e) Telephone exchanges, microwave relay towers, telephone transmission
equipment buildings and service yards;
(f) Privately owned water pumping stations and water reservoirs;
20. Radar installations and towers;
21. Radio and television studios and stations;
22. Schools, trade.
23. Storage and warehousing establishments.
24. Storage yards, but not including junkyards;
25. Swimming pool (manufacturing of).
26. Trailer sales and rental, for use with private passenger motor vehicles;
27. Weighing stations;
28. Wholesaling establishments;
29. Accessory uses, including but not limited to temporary buildings for construction
purpose for a period not to exceed the duration of such construction;
30. Other wholesale, light manufacturing, construction or service uses which are similar
in character to those enumerated in this subsection, and which will not be dangerous
or otherwise detrimental to persons residing or working in the vicinity thereof, or to
the public welfare, and will not impair the use, enjoyment, or value of any property;
31. Factory outlet retail or wholesale store for the sales and servicing of goods or
materials on the same premises as the manufacturing company to which they are
related, including sales and service in a separate building or buildings;
32. Other uses as listed in Section 30 of this ordinance.
The following specific uses shall be permitted in the 1-1 District when granted in accordance with
Section 31:
1. Railroad freight terminals, railroad switching and classification yards, repair shops,

and roundhouses.
2. Stadiums, auditoriums, and arenas.
3. Other uses as listed in Section 30 of this ordinance.
25.2 Height Regulations: Maximum height one hundred (100) feet.
25.3 Area Regulations:
1. Size of Yards:
a. Front Yard: Minimum required, twenty (20) feet.
b. Side Yard: Minimum side yard of ten (10) feet except a comer lot adjacent to a
street shall be twenty (20) feet. When the industrial district is adjacent to any
residential district, a minimum side yard of twenty (20) feet shall be observed
and a six (6) foot solid masonry or wood wall shall be constructed adjacent to
the residential district's property line.
c. Rear Yards: There shall be a rear yard of depth of twenty (20) feet, unless
adjacent to a residential district, in which case a fifty (50) foot rear setback shall
be observed.
2. Size of Lot:
a. Minimum Lot Area: None.
b. Minimum Lot Width: None.
c. Minimum Lot Depth: None.
3. Lot Coverage: In no case shall more than fifty (50%) percent of the lot area be
covered by the aggregate area of all buildings constructed on the lot.
25.4 Parking Regulations: Required off-street parking shall be provided in accordance with the
specific uses set forth in Section 32.

Dear Mr. Smith,
Allison Engineering recommends denial of the final plat. The development is located in
the ETJ. The City has an interlocal agreement regarding such developments where the
City is the prime reviewer but they agree to require that all public works improvements
meet or exceed the county requirements.
Our comments regarding Final Plat are as Follows:
• The ETJ certification in the lower right hand comer is for Plainview Farms
Subdivision within the City of Denton ETJ. This needs to be corrected.
• The P&Z signature block is missing. (The one shown is for Denton).
• An exhibit is needed to indicate the location of water facilities, general
topography (a USGS map is sufficient) and a drainage analysis. This may have
been submitted with preliminary plats or final plats of the previous phases. If so,
then copies of these documents may be acceptable.
• A plan/profile of the borrow ditch along Creekview Road and a schedule of
culvert sizes is needed to provide for the future installation of driveways. A
waiver from the County Engineer is also acceptable.
• A letter from the County Engineer indicating that improvements to Creekview
Road are not required, or an engineering report (and design if applicable)
determining what road improvements, if any, are needed.
