Chairman Jerry Jenkins Called Meeting to Order. 2. Approve Minutes: February 2, 2006 Thomas Muir made a correction on Item 7 last paragraph. Typo -add a space to word typed as tothe. Motion was made by Andy Garza to approve minutes as corrected. Seconded by Thomas Muir. Motion carried unanimously. 3. Conduct Public Hearing to Consider a Zoning Request Change from AG (Agriculture) 1-1 (Industrial) on Property Legally Described as Abstract 940, McKinney Williams Survey, Tract SA, Being 3.93 Acres and Tract 4A, Being 1.324 Acres. Chairman Jenkins declared Public Hearing opened. No one spoke for or against. Chairman Jenkins declared Public Hearing closed. 4. Consider and Possible Action on Zoning Request Change from AG (Agriculture) 1-1 (Industrial) on said Property Legally Described as Abstract 940, McKinney Williams Survey, Tract SA, Being 3.93 Acres and Tract 4A, Being 1.324 Acres. This item was scheduled from last Planning & Zoning meeting to allow for proper notification to be sent to property owners within 200 feet of said property. Jimmy Frazier made motion to approve a Zoning Request Change from AG (Agriculture) 1-1 (Industrial) on said Property Legally Described as Abstract 940, McKinney Williams Survey, Tract SA, Being 3.93 Acres and Tract 4A, Being 1.324 Acres. Ken Perry seconded. Thomas Muir expressed a concern regarding extendingl-1 zoning right up to residential zoning. Lengthy Discussion followed concerning the Requirements for 1-1 zoning. The concern with some of the members was that residential is all around this property. Voting was as follows: 3 against- 2 For Motion Failed. Consider and Possible Action on a Zoning Request Change from Old SF3 (Old Single Family 3) to 2F (Two Family) on Property Legally Described as the Mary H. Shirley Addn., Block 9, Lot 11 D. The Property is Located in the 600 Block of South Second Street. Merrie Lou Abney addressed the Board concerning the difficulty in marketing this piece of property. She indicated it has been difficult since it is zoned Residential and it fronts two trucking companies. Lengthy discussion following concerning the two-plex zoning. Board members expressed concern that this might be considered spot zoning, however, consideration was taken due to 1-1 zoning being across the street with the two trucking companies. Thomas Muir made motion to recommend to City Council to change zoning from Old SF3 to 2F legally described as the Mary H. Shirley Addn., Block 9, Lot 11 D, property is Located in the 600 Block of South Second Street. Seconded by Andy Garza. Motion carried. 7. Conduct Public Hearing to Consider a Zoning Request Change from AG (Agriculture) to SF 2 (Single Family 2) on Property Legally Described Indian Springs Estates, Block A, Lots 1-6. Property is located on Rising Star Lane. Chairman Jenkins declared Public Hearing opened. No one spoke for or against. Chairman Jenkins declared Public Hearing closed. 8. Consider and Possible Action on a Zoning Request Change from AG (Agriculture) to SF 2 (Single Family 2) on Property Legally Described as Indian Springs Estates, Block A, Lots 1-6. Property is located on Rising Star Lane. Discussion as follows: The zoning classification from Agricultural (AG) to Single Family 2 (SF-2)does not have an impact concerning tax appraisals by the Denton Central Appraisal District. Agricultural Exemption by the Appraisal District have to meet their criteria not the City. Jack and Jane Richardson expressed a concern regarding SF2 zoning category. Mr. & Mrs. Richardson indicated their home was not even 2,000 sq. ft. living area and they expressed this Zoning was on a higher scale. Lengthy Discussion continued on the minimum dwelling size and maximum in these zoning categories. Motion was made by Jimmy Frazier to approve a Zoning Change from AG (Agriculture) to SF2 (Single Family 2) as Property legally described as Indian Springs Estates, Blk A, Lots 1-6 located on Rising Star Lane. 9. The Building Official in reviewing the ordinances believes this is the most appropriate match to the current regulations. Densities in this district will range from 3 to 3.5 units per gross acre. 11.1 Permitted Uses: A building or premise in an "SF-3" District shall be used only for the following purposes: 1. Any use permitted in the "SF-I" District or "SF-2" District. 2. Other uses as listed in Section 26 of this ordinance. The following specific uses shall be permitted in an "SF-3" District, when granted in accordance with Section 27: 1.
