Gary Bilyeu Called Meeting to Order. 2. Discussion on Zoning Ordinances. Discussed the categories each member will review: Paul Edleman - Parks, AG and Flood Plain Brian Hutcherson - Bl, B2 and B3 Glen Jensen - Il and 12 Russell Martin - Mobile Home, Bed and Breakfast, and Planned Development Gary Bilyeu - Single Family, Multi Family, and SUP Discussed the Historic area Russell Martin and Gary Bilyeu will work together on Planned Developments. Gary Bilyen indicated Russell Martin could work on the Planned Development Ordinance and he will take "Special Districts" Discussed Flood Plain Districts. Discussed Specific Use Permits, including requirements, time limits, and variances. Discussed intent, necessity and details for SUP's. Discussion continued regarding requirements for an SUP. Gary Biilyea indicated he will work up a rough draft of an ordinance and bring it back to the Commission. Paul Edleman asked the Commission what they would like to see in regards to Parks. Cecile indicated one item that should be addressed is the time frame of when the land is dedicated to the City. Current Park and Open Space ordinance was discussed. Some Discussion followed regarding proposed "special districts". Tom Bojanczyk indicated they would have gravel and grass, a 12 a 16 stucco office, 5 to 8 sheds, 2 carports, and 4 to 5 swing sets. Discussed they will use Smokey's parking lot and restroom facilities. Discussed electric and signage. Paul Edelman indicated he did not like it, they are trying to create an additional business by attaching onto another business. They are not bringing anything to Sanger. Discussed placing a time line on the SUP. Gary Bilyeu indicated he was leery about doing this and setting a precedent. Paul Edelman indicated he would like the utilities metered separately from Smokey's. Mr. Bojanczyk indicated that would not be a problem. Discussed Time limits. Mr. Bojanczyk indicated he felt 2 to 3 years would be reasonable. Discussed that any transfer of ownership would require a new SUP. Mr. Bojanczyk indicated that all sheds are built onsite, the ones on the lot are for display only. Gary Bilyeu indicated he was leaning toward a 2 year time limit on the SUP, with possibly an extension w/out re -application, annually up to 3 years. Gary indicated he would like it to state that if the land is voluntary vacated or transferred that the use should go back to it's original zoning unless there is a re- application. Paul Edehnan indicated he would prefer a 3 year time limit with no extension. Discussed the office wig be finished out, on a slab, and will meet all current ordinances. Discussion continued regarding parking, restrooms, vacation of land, and display removal. Glenn Jensen moved to approve the SUP with the following conditions: • 3 year time limt • No more than 8 sheds • No more than 4 swing sets • No more than 2 carports (metal allowed) Palomino Bay will be on the Counciil's agenda for June 18, 2007. Property is located at 1200 S. Stemmons (beside Smokey's) Paul Edelman asked if the SUP is for a specific business only. Staff indicated it was for the use on the particular property. Discussed the details of the ordinance and what can go in it. • If the land is voluntarily vacated it will revert to original zoning. • No restrooms or parking spaces will be required for issuance of a certificate of occupancy. • The office will be finished out and comply with all city ordinances • All structures will be removed upon suspension of SUP. • The business will have separate metering from Smokey's. Conduct Public Hearing to Consider a Zoning Change Request from Ag (Agriculture) to 1-1 (Industrial -1) on property legally described as Abstract 71, Tract 4A being 1324 acres and Abstract 940, Tract 5A, being 3.93 acres. Consider and Possible Action Regarding a Zoning Change Request from Ag (Agriculture) to I-1(Industrial -1) on property legally described as Abstract 71, Tract 4A being 1324 acres and Abstract 940, Tract 5A, being 3.93 acres. Property is Located on Cowling Road Jimmy Frazier moved to approve the Zoning Change. Paul Edelman seconded. Glen Jensen expressed concerns regarding the buffer between this property and the residential property. Discussed current use, noise, and setbacks. Timmy Frazier indicated one of the objectives of the city is to get industry, and create jobs. This is someone trying to do that. Motion carried unanimously. 8. Conduct Public Hearing to Consider Amending the Zoning Ordinance by creating a classification for "outside display and sales" and creating a classification for "Modular Building Sales, Service and Rental Public Hearing Opened. Adam Whitfield, Teague, Nall and Perkins, indicated the intention is to get all 130 acres re zoned to I-1. The back 10 acres is for modular building repairs etc. George Jeeter indicated he wanted to put the modular building business on the back 10 acres, and use the remaining property for other businesses. Discussed the location of the property. Public Hearing Closed. 9. Consider and Possible Action Regarding Amending the Zoning Ordinance by creating a classification for "outside display and sales" and creating a classification for "Modular Building Sales, Service and Rental". Discussed that his item is only creating a category. Gary Bilyeu addressed Mr. Jeeter, he indicated that they required an Sup on the previous request to regulate him and future owners. Discussion followed. Russell Martin moved to create a classification for "outside display and sales" and creating a classification for "Modular Building Sales, Service and Rental" in I-1 and requiring an SUP. Randall Smith, owner of the 130 acres South of Lois Road, indicated he would hike his property zoned Industrial.
