MINUTES: PLANNING AND ZONING DECEMBER 14, 2006 PRESENT: Chairperson Jerry Jenkins, Jimmy Frazier, Thomas Muir, Gary Bilyeu, Brian Hutcheson, Russell Martin, Paul Edleman OTHERS PRESENT: City Manager Jack Smith, City Secretary Rose Chavez, Engineering Coordinator Samantha Renz, Economic Development Director Cecile Carson, City Engineer Rob Woods, John Springer, Adam Whitfield 1. Chairperson Jerry Jenkins Called Meeting to Order. 2. Approve Minutes: November 16, 2006 Paul Edleman indicated his address is 206 Hillcrest. Thomas Muir moved to approve the minutes as presented. Russell Marin seconded. Motion carried unanimously. 3. Conduct Public Hearing to Consider a Replat on property legally described as Willowood Addition Lot 1, Block H. This will Replat Lot 1 into 13 Residential Lots. Public Hearing Opened. No Discussion. Public Hearing Closed. 4. Consider and Possible Action on a Replat for property legally described as Willowood Addition Lot 1, Block H. This will Replat Lot 1 into 13 Residential Lots. Adam Whitfield, Isbell Engineering, addressed the items on the engineer's review letter. He indicated that the Bolivar Water lime will be moved to the new easement, and they are abandoning the drainage easement down the center. They will move the drainage easement to the North of the lot. They added a 10 foot electric easement. They are requesting a variance from 50' to 30' on the front building line. Gary Bilyeu indicated that sidewalks should be put in as per the ordinance. Discussion followed regarding the need for sidewalks. Discussed the building line and additional right of way required. City manager indicated they need to move the building line back for future widening of the road. Discussion continued regarding the future widening of Marion Road and the building line. Jimmy Frazier moved to approve the replat, denying the 50' building line, but requiring a 40' building line, and to deny the variance on the sidewalks. Motion died for lack of second. Paul Edleman moved to request an additional 10' of Right of Way and to decline the variance on sidewalks and that the building line be 30' from the Right of Way and to approve the Replat with all stipulations being met. Gary Bilyeu seconded. Motion carried unanimously. 5. Consider and Possible Action on Review of Zoning, Subdivision and Building Ordinances. Cecile Carson addressed the commission, and indicated she was looking for parameters for the Beer and Wine sales, and fees for the permits. Also wanted to discuss distance requirements and hours for sale of alcoholic beverages. Discussed how distances were measured. Discussed different zoning districts. Commission agreed they would like to allow the Sale of Beer and Wine in B1 and B2, and allow it with a Specific Use Permit in B3, I1 and I2. 6. Meeting Adjourned. Bebee Survey, Abstract No. 29. Property is located within the City of Sanger ETJ. Zoning: Does not apply in this case since it lies within the ETJ of City of Sanger. Right -of -Way Dedication: Union Hill Road is classified as a local street, which requires an ultimate right-of-way width of 60 feet. The developer is dedicating 30 feet right-of-way from the centerline of existing Union Hill Road to accommodate there half of the necessary requirement. Drainage Improvements: The applicant's engineer has submitted a drainage analysis that has been reviewed and accepted by the Engineering Department. STAFF REVIEW COMMENTS: First Baptist Church of Sanger is the applicant for the proposed final plat of First Baptist Church being a 4.336 Acre Tract in the H. Tierwester Survey, located within the City of Sanger. Zoning: The property is currently zoned Single Family Residential (SF-3). Right -of -Way Dedication: Union Hill Road is classified as a local street, which requires an ultimate right-of-way width of 60 feet. The developer is dedicating 30 feet right-of-way from the centerline of existing Union Hill Road to accommodate there half of the necessary requirement. Drainage Improvements: The applicant's engineer has submitted a drainage analysis that has been reviewed and accepted by the Engineering Department. SUMMARY: The proposed Final plat appears to satisfy the platting standards contained within the Code of Ordinances of the City of Sanger. The applicant has requested a variance from a portion of the sidewalk requirements a copy of their request has been provided. Their request has been prepared by Mr. Alan Nelson the applicants Architect for your review and consideration.
