MINUTES: BOARD OF ADJUSTMENTS AUGUST 23, 2007 PRESENT: Polly Dwyer, Carroll McNeill, Joe Falls, James Adams, Dorcyle McClure ABSENT: John Looper, Bobbye Robison, Lori Pethtel, Tracy Murphree OTHERS PRESENT: Engineering Coordinator Samantha Renz, Nim Ashley, Nick Neyrey 1. Polly Dwyer Called Meeting to Order. 2. Approve Minutes: July 19, 2007 Dorcyle McClure indicated that on Item #9, James Adams had voted in opposition of the motion. Dorcyle McClure moved to approve the minutes as corrected. Motion carried unanimously. 3. Conduct Public Hearing to Consider a Variance Request Concerning Rear Yard Setbacks on Property Legally Described as Abstract 940 A McKinney & Williams Survey, Tract 6, Being 4 Acres. Property is Located off of Cowling Road. Public Hearing Opened. Nim Ashley, P.O. Bog 102, Sanger, TX, indicated that this was his property. He indicated that he is the owner of A & W Productions, and they manufacture truck parts. He has requested a 10' setback for a new building. He intends to concrete between the building and the property line to help with drainage. He felt that 20' would harbor trash and be a place for kids to hide and get into trouble. Nick Neyrey, 56 Heron Dr., project manager for Sampson Homes, spoke in opposition to the request, he indicated he felt 10' was to close to the residential property. He felt it would be bad for the neighborhood. Nim Ashley indicated this would be the back of his building, and that there is not any noise. He showed a layout of the property and discussed drainage issues. Drainage was discussed. Public Hearing Closed. 4. Consider and Possible Action Regarding a Variance Request Concerning Rear Yard Setbacks on Property Legally Described as Abstract 940 A McKinney & Williams Survey, Tract 6, Being 4 Acres. Property is Located off of Cowling Road. Joe Falls showed an aerial photo of the property. He indicated the drainage issue would not be solved by concreting the area. There is a lot more property owned by A & W Productions that could be used for the new building site. Discussed property and setbacks of adjoining property. Joe Falls indicated his main concern was public safety. Mark McNeal indicated that 10' could make a lot of difference when it comes to hazardous materials. Discussion followed. Box 1729 * 201 Bolivar St* Sanger, TX 76266 * 940-458-7930 September 24, 2007 To: Board of Adjustment Fr: Samantha Renz Re: Appeal of Drainage Study Requirements Attached is the property owners request for an appeal, along with the responses to the property owner letters sent out, and a copy of a letter form the City Manager to Ms. Forrest. This request is for an appeal to the City of Sanger's Ordinances and/or the Engineering Departments requirement of a drainage study on a proposed Plat. Chapter 10, Section 4.03(C) of the City of Sanger's Code of Ordinances states: C . Utilities Two (2) copies of the plat showing the proposed water and sanitary sewer mains and proposed drainage facilities accompanied with information including the total watershed and drainaue areas, location of lines, inlets, culverts, bridges and calculated run-off and points of concentration. This information is contained within the required drainage study. Ms. Forrest was notified that she would have to complete the drainage study and all other requirements before it went to Planning and Zoning. Due to the expense, Ms. Forrest does not want to do the drainage study because she was not required to do a drainage study previously. Ms. Forrest has requested a meeting of the Board of Adjustment to waive the drainage study requirement. Staffs recommendation is not to waive the requirement. It is my understanding that you will submit a combined preliminary and final plat and a drainage study for your property. Enclosed you will find some information and a development application to assist you in the process. As per our conversation. we will only require you to pay for the final plat and drainage review at this time. If the plat is approved by planning and zoning and the Council. I will recommend that the Council waive the preliminary plat fee. The decision to waive the fee lies solely with the Council and if they do not waive the fee you will have to pay it before the plat will be filed. Please be advised that all required materials must be submitted before the review process can begin. This includes the combined preliminary and final plat, the drainage study, development application enclosed and any other required documents. The plat will not be placed on the planning and zoning board's agenda until all required documents have been submitted and reviewed. If I can be of further assistance, please call.
