MINUTES: CITY COUNCIL MEETING April 20, 2015 PRESENT: Mayor Thomas Muir, Councilman Billy Ezell, Councilman Scott Stephens, Councilman Gary Bilyeu and Councilman Allen Chick ABSENT: Councilman Russell Martin OTHERS PRESENT: Mike Brice City Manager, Tami Taber City Secretary, Christy Punches Court Clerk, Brianna Coffman, David Clark, Joe Falls, Bill Boutwell, Micah Larussa and Tom Larussa 1. Call Meeting to Order, Invocation, Pledge of Allegiance. Mayor Muir called the meeting to order at 7:00 p.m. Councilman Stephens led the Invocation followed by Councilman Ezell leading the Pledge of Allegiance. 2. Citizens Input: (Citizens are allowed 3 minutes to speak. The City Council is unable to respond or to discuss any issues brought up during this section). Joe Falls, 4489 McReynolds Road, stated that he sees activity on utility improvements on the east side of the track and also noticed patches put down on McReynolds Road today. Bill Boutwell, 4000 Windmill, spoke about the railroad track crossing on FM 455 just east of the Sportsman, which he said is in terrible condition and has caused him to have front end alignments and tire repairs. He also advised that there was a patch that only lasted a few days and requested that the City make contact with the railroad. City Manager stated that the railroad had been contacted twice regarding this matter and it is unknown when their crews will be here again. The Access easement will allow the city to construct a new water well in the northwest quadrant of the city to provide additional water for the citizens west of I-35 and provide for any needs for future growth. STAFF OPTIONS & RECOMMENDATION Staff recommends these easements for approval. The ordinance sets a maximum of 150 square feet of area on a pole sign along Interstate 35 (Sec. 3.1407 (b) (2) (a)). Also, message signs are allowed up to 20 square feet and count toward the overall signage allowance (Sec. 3.1406 (6)). The applicant is requesting a total of 432 square feet of total area on the pole sign, with 111 square feet of electronic message board. The applicant is proposing that some of the additional permitted area will be used by additional users on the site, for example if the property were subdivided and additional buildings constructed. The sign ordinance does permit multiple users to combine their allowed signage into a single pole sign, but only up to 200 square feet. STAFF OPTIONS & RECOMMENDATION Staff finds that the site does face an unusual visibility challenge compared to others along Interstate 35, as it is in the shadow of the 5th Street overpass (Keaton Road exit). This inhibits visibility from northbound traffic along the interstate. Staff also finds there is a practical challenge in the attempt to use the business's existing signage on the property's existing signage. For these reasons, Staff finds that the Council can justify granting additional signage, if they find it makes "a positive contribution to the visual environment" as described in the sign ordinance. ARTICLE 3.1400 SIGN REGULATIONS* Sec. 3.1401 Purpose and Intent Regulation of the location, size, placement and certain features of signs is necessary to enable the public to locate goods, services and facilities in the corporate limits of the city to encourage the general attractiveness of the community and to protect property values therein.
