Density in this district is not to exceed ten (10) units per acre. Use Regulations: A building or premise shall be used only for the following purposes: 1. Single family attached dwelling units, provided that no more than five (5) dwelling units are attached in one continuous row or group and provided that no dwelling unit is constructed above another unit. 2. Other uses as specified by the Land Use Table Height Regulations: No building shall exceed thirty-five (35) feet. Area Regulations: 1. Size of Yards: a. Front Yard: There shall be a front yard having a required depth of not less than twenty (20) feet as measured from the front property line. b. Side Yard: There is no required side yard between adjacent units within the same building. There is minimum side yard of at least seven and one half (71/2) feet for units at the end of a building, creating a 15-foot separation between adjacent buildings. There is a required side yard of at least twenty (20) feet adjacent to a side street. 2. Size of Lot: a. Lot Area: Each lot shall measure at least two thousand three hundred (2,300) square feet. b. Lot Width: The width of a lot shall be not less than twenty-three (23) feet. C. Lot Depth: The depth of a lot shall be not less than one hundred (100) feet. 18.4 Parking Regulations: Two (2) off-street parking spaces shall be provided per unit. Required parking may not be provided within the required front yard. Off street parking spaces shall be provided in accordance with the requirements set forth in Section 32. RO Residential Office District RO RESIDENTIAL OFFICE DISTRICT General Purpose and Description: The Residential Office District is intended for both single- family residential dwellings, and low intensity business uses that would be harmonious with residential uses. Use Regulations: A building or premise shall be used only for the Hollowing purposes: 1. Single family detached dwelling units. 2. Retail sales of antiques, flowers, hobby materials, apparel, gifts, etc. 3. Personal services such as barber shop or beauty salon, photography, etc. 4. Office, general or professional 5. A combination of any of the above. 6. Prohibited uses include restaurants, convenience stores, veterinarian's offices, pet shops, and funeral homes. 7. Uses per the Land Use Table Height Regulations: No building shall exceed thirty-five (35) feet. Area Regulations: A. Size of Yards: 1. Minimum Front Yard - Twenty-five feet (25'). 2. Minimum Side Yard - eight feet (8'); Twenty feet (20') on corner adjacent to side street. No side yard for allowable nonresidential uses shall be less than twenty-five feet (25'). 3. Minimum Rear Yard - Twenty-five feet (25'). B. Size of Lots: 1. Minimum Lot Area - Six thousand five hundred (6,500) square feet. 2. Minimum Lot Width - Sixty feet (60'). 3. Minimum Lot Depth - One hundred feet (100'). C. Minimum Dwelling Size: One thousand two hundred (1,200) square feet. D. Maximum Lot Coverage: Forty percent (40%) by the main building; Sixty percent (60%) by the main building, accessory buildings, driveways and parking; and any other concrete work, flat work, etc. RO Residential Office District Parking Regulations: Off street parking spaces shall be provided in accordance with the requirements set forth in Section 32. Architectural Standards: All principal structures must conform to the Architectural Standards for single-family residences in Section 3 of the Code of Ordinances. Signage: Business uses are permitted signage under the Business and Agricultural Zoning Districts section of the Sign Regulations. MINUTES: CITY COUNCIL MEETING May 18, 2015 PRESENT: Mayor Thomas Muir, Councilman Bill Boutwell, Councilman Russell Martin, Councilman David Clark, Councilman Gary Bilyeu and Councilman Allen Chick OTHERS PRESENT: Mike Brice City Manager, Tami Taber City Secretary, Joe Falls, Rick Horn, Larry Kish, Wendell Ratliff III, Amanda Kish, Carla Clark, Sam Alexander, Kelli Alexander, Chris Prock, Steve Stone, Kenneth Minhinnett and Don Spaulding 1. Call Meeting to Order, Invocation, Pledge of Allegiance. Mayor Muir called the meeting to order at 7:00 p.m. Councilman Stephens led the Invocation followed by Councilman Ezell leading the Pledge of Allegiance. 2. Consider, Discuss and Approve Ordinance #05-09-15 - Canvassing the Results of Votes for the Purpose of Electing Candidates to the Office of City Council of the City of Sanger, Texas, for the General Election Held on May 9, 2015, Declaring the Results of That Election and Providing for an Effective Date. Councilman Bilyeu made a motion to approve. Seconded by Councilman Martin. Motion carried unanimously. 3. Issue Certificate of Election, Statement of Elected Officer and Oath of Office. 4. Elect Mayor Pro-Tem. Councilman Martin nominated Councilman Bilyeu. Seconded by Councilman Chick. Motion carried 4-0. Councilman Bilyeu abstained. 5. Joe Falls of 4489 McReynolds Road thanked his supporters. He advised that he began his political career in 1952 supporting Eisenhower and has supported Sanger for 45 years and will continue to do so. Consider, Discuss and Possibly Approve Lease at Property Located at 311 N. 5th Street Between the City of Sanger and Miriam Calderon DBA Stiletto Kitchen. City Manager advised that this is the former Kings restaurant which will become a catering business by new occupants. Councilman Martin made a motion to approve. Seconded by Councilman Bilyeu. Motion carried unanimously. 9. Consider, Discuss and Possibly Approve Resolution #R05-03-15 - Approving a Change in the Rates of ATMOS Energy as a Result of a Settlement. Motion to approve made by Councilman Bilyeu. Seconded by Councilman Boutwell. Motion carried unanimously. 10. Consider, Discuss and Possibly Approve a Meritorious Exception to the Sign Ordinance for the Traildust Steak House Located at 1200 S. Stemmons. Applicant is requesting to be allowed a larger total permitted sign area and a larger permitted electronic message board. The ordinance sets a maximum of 150 square feet of area on a pole sign along I-35 and message signs are allowed up to 20 square feet and count toward the overall signage allowance. Applicant is requesting to be allowed a larger total permitted sign area and a larger permitted electronic message board. They are requesting a total of 480.4 square feet of total area on the pole sign with 72.4 square feet of electronic message board. He advised that some of the additional permitted area will be used by additional users on the site if the property were subdivided and additional buildings constructed. The ordinance does permit multiple users to combine their allowed signage into a single pole sign, but only up to 200 square feet. Steve Stone is the real estate broker/leasing agent on behalf of Traildust. He advised that the current large sign that says Smokey's will remain, but will be whitened out and not used. In the future, there will be two digital reader boards on the bottom of the current Traildust sign. Councilman Bilyeu made a motion to approve. Seconded by Councilman Martin. Motion carried unanimously. 11. Consider, Discuss and Possibly Approve Ordinance 405-10-15 - Abandoning 0.02 Acres of Street Right -of -Way Located at the Intersection of Windmill Drive and Sanger Circle Road. Councilman Bilyeu made a motion to approve. Seconded by Councilman Clark. Motion carried unanimously. 12. Consider, Discuss and Possibly Approve the Final Plat for Sanger Circle 3, 2 Acres Located on the West of Side Marion Road South of Sanger Circle Drive. Councilman Martin made a motion to approve. Seconded by Councilman Boutwell. Motion carried unanimously. 13. Consider, Discuss and Possibly Approve a Professional Services Agreement Between HRM Land Acquisition Solutions and the City of Sanger for Real Property Services and Work Authorization #1 for the McReynolds Road Project. Joe Falls of 4489 McReynolds stated that he has studied the plans and feels there is a turn lane issue at Indian Lane. He suggests a turn lane from the bridge to the second drainage structure. He also was concerned about drainage easements and slope easements on McReynolds Road. Other concerns was that fences and driveway replacement wasn't offered. Brief discussion between Mayor Muir and Joe Falls. Sam Alexander of 3219 McReynolds advised that he has been at his residence since 1980. He has two pieces of land and uses his driveway where his house is to get to it. His concerns were that this project would cause him and others to lose trees and fences on their properties. Brief discussion between Mayor Muir and Sam Alexander. Councilman Martin made a motion to approve. Seconded by Councilman Clark. Motion carried unanimously. 14. Pursuant to Section 505.159 of the Development Corporation Act, a public hearing was conducted on May 26, 2015. No comments were received. RECITALS This CONTRACT is applicable to the furnishing of landscape architectural/park planning services by the LANDSCAPE ARCHITECT for the City of Sanger for the Hike and Bike Trail Connection between Sanger Sports Park and the East Side of I.H. 35 to Cowling Road. CONTRACTUAL UNDERTAKINGS Section I Employment of LANDSCAPE ARCHITECT I. Employment of the LANDSCAPE ARCHITECT The CITY hereby agrees to retain the LANDSCAPE ARCHITECT to perform professional landscape architectural services in connection with the Project; LANDSCAPE ARCHITECT agrees to perform such services in accordance with the terms and conditions of this CONTRACT. Scope of Services The parties agree that LANDSCAPE ARCHITECT shall perform such services as are set forth and described in Exhibit "A", which is attached hereto and thereby made a part of this CONTRACT. The parties understand and agree that deviations or modifications in the form of written change orders may be authorized from time to time by the CITY. Section II Authorization of Services No professional services of any nature shall be undertaken by the LANDSCAPE ARCHITECT pursuant to this CONTRACT until LANDSCAPE ARCHITECT has received written authorization to proceed from the CITY. Section III Period of Service This CONTRACT shall be effective upon execution by the CITY and LANDSCAPE ARCHITECT, and shall remain in force until terminated under the provisions hereinafter provided in Section XIII. Section IV Coordination with the CITY The LANDSCAPE ARCHITECT shall hold periodic conferences with the CITY, or its representa- tive(s), in an effort to benefit from the CITY's experience and knowledge of existing needs and facilities, and so as to make the Project as consistent as is reasonably practicable with the CITY's current policies and standards. To implement this effort, the CITY shall make available to the LANDSCAPE ARCHITECT for use in performing the Project, all existing plans, maps, field notes, statistics, computations and other data in the CITY's possession pertaining to existing facilities which the CITY might believe could have any relation to the Project. The LANDSCAPE ARCHITECT may rely upon the accuracy and completeness of such plans, maps, field notes, statistics, computations and other data provided by the CITY to the LANDSCAPE ARCHITECT. Section V Compensation and Method of Payment The parties agree that the LANDSCAPE ARCHITECT shall be compensated for all services provided pursuant to this CONTRACT in the amount and manner set forth below. The professional services fee for completing the scope of services as outlined in Exhibit "A" which is attached hereto and thereby made a part of this CONTRACT. The LANDSCAPE ARCHITECT shall be reimbursed, at his actual incurred cost, for job -related expenses such as reproduction/printing, courier/delivery charges, data collection, etc. Billing for services will be submitted monthly or after completion of major phases of the work, whichever is most conducive for both parties to the CONTRACT. The LANDSCAPE ARCHITECT further agrees that it will prepare itemized statements for submittal, if requested by the CITY. Section VI Legal Requirements The LANDSCAPE ARCHITECT will advise and assist the CITY in the need and in applying for licenses or permits required by law, and will comply with ordinances, laws, orders, rules and regulations which pertain to its services hereunder. However, nothing contained herein shall alter the fact that the CITY shall be responsible to pay all costs or fees associated with any licenses and permits required by law. The CITY shall also have the sole responsibility to obtain all licenses or permits required by law. Section VII Standard of Care The LANDSCAPE ARCHITECT will perform and complete its work in a good and workmanlike manner. The LANDSCAPE ARCHITECT shall not, either during or after the term of this CONTRACT, disclose to any third party, any confidential information relative to the work or the business of the CITY, without the written consent of the CITY, except to the LANDSCAPE ARCHITECT's subcontractors. The CITY's representative shall at all times have access to the work for the purpose of inspecting the work and determining that the work is being performed in accordance with the terms of this CONTRACT. Section VIII Independent Contractor Relationship In performance of the services hereunder, the LANDSCAPE ARCHITECT shall be an independent contractor with the sole authority to control and direct the performance of the details of the work. The LANDSCAPE ARCHITECT is self-employed, shall not purport to be an employee or an agent of the CITY, and shall not have any right or power to bind the CITY to any obligation not otherwise specifically authorized in writing by the CITY. The LANDSCAPE ARCHITECT shall provide its own premises for performance of its duties hereunder, but shall have free access to the premises of the CITY and any information, records and other material relevant to its work hereunder. Section IX Insurance The LANDSCAPE ARCHITECT shall provide a certificate reflecting its coverage by worker's compensation insurance and public liability insurance to the CITY for bodily injury and property damage in the following amounts: $250,000.00 for each person/ $500,000.00 for each single occurrence for bodily injury or death/ $100,000.00 for each single occurrence for injury to or destruction of property. The LANDSCAPE ARCHITECT agrees and warrants that such coverage shall be maintained during the term of this CONTRACT. In the event that the limits of liability imposed upon municipalities are increased by the Legislature of the State of Texas, the parties agree that the LANDSCAPE ARCHITECT shall increase the coverage and limits of liability required by this CONTRACT to conform to the liability limits established by the Legislature of the State of Texas. Section X Progress Meetings The LANDSCAPE ARCHITECT or its designee agrees to attend all progress meetings scheduled by the CITY, and at such meetings will endeavor to outline work accomplished and identify any special problems or delays known to the LANDSCAPE ARCHITECT which are encountered in connection with the Project during the previous report period, as well as planned work activities and special problems and delays anticipated for the next report period. Section XI Ownership of Documents All documents, including master plans and drawings, prepared or furnished by the LANDSCAPE ARCHITECT (and LANDSCAPE ARCHITECT's independent professional associates and consultants) pursuant to this CONTRACT are instruments of service with respect to the Project, and the CITY shall retain ownership and property interest therein, whether or not the Project is completed, upon full and complete payment by the CITY to the LANDSCAPE ARCHITECT for the cost of the work as defined in Exhibit "A". The CITY may use the plans, drawings and specifications for information and reference in connection with the use and occupancy of the Project by the CITY and others; however, such documents are not intended or represented to be suitable for reuse by the CITY or others on extensions of the Project or on any other project. Any reuse without written verification or adaptation by the LANDSCAPE ARCHITECT for the specific purpose intended will be at the CITY's sole risk and without liability or legal exposure to the LANDSCAPE ARCHITECT, or to the LANDSCAPE ARCHITECT's independent professional associates and consultants. Section XII Termination Either party to this CONTRACT may terminate the CONTRACT by giving to the other party thirty (30) days' notice in writing. Upon delivery of such notice by the CITY to the LANDSCAPE ARCHITECT, the LANDSCAPE ARCHITECT shall discontinue all services in connection with the performance of this CONTRACT and shall proceed to promptly cancel all existing orders and contracts insofar as such orders or contracts are chargeable to this CONTRACT. As soon as practical after receipt of notice of termination, the LANDSCAPE ARCHITECT shall submit a statement, showing in detail the services performed under this CONTRACT up to the date of termination. The CITY shall then pay the LANDSCAPE ARCHITECT within fifteen (15) days that proportion of the prescribed charges which the services actually performed under this CONTRACT bear to the total services actually performed under this CONTRACT, less such payments on account of the charges as have been previously made. Originals of all completed or partially completed plans, designs and text prepared under this CONTRACT shall be promptly delivered to the CITY upon termination of this CONTRACT. Section XIII Entire Agreement This CONTRACT represents the entire agreement between the parties covering the subject matter. No modifications or amendments shall be valid unless in writing and signed by both of the parties. Section XIV Severability In case any one or more of the provisions contained in this CONTRACT shall, for any reason, be held to be invalid, illegal or unenforceable in any respect, such invalidity, illegality or unenforceability shall not affect any other provision hereof, and this CONTRACT shall be construed as if such invalid, illegal or unenforceable provision had never been contained herein. Section XV Performance This entire CONTRACT is performable in Denton County, Texas, and the venue for any action related, directly or indirectly, to this CONTRACT or in any manner connected therewith shall be Denton County, Texas, and this CONTRACT shall be construed under the laws of the State of Texas. Section XVI Successors and Assignments The CITY and the LANDSCAPE ARCHITECT each binds himself and his successors, executors, administrators and assigns to any other party of this CONTRACT and to the successors, executors, administrators and assigns of such other party, in respect to all covenants of this CONTRACT. Except as above, neither the CITY nor the LANDSCAPE ARCHITECT shall assign, sublet or transfer its interest in this CONTRACT without the written consent of the other party. Nothing herein shall be construed as creating any personal liability on the part of any officer, agent or employee of the CITY or the LANDSCAPE ARCHITECT. Section XVII Preparation of Alternates The LANDSCAPE ARCHITECT's fees are based upon the total dollars allocated for construction of the project. The LANDSCAPE ARCHITECT will prepare an estimate for probable cost of construction. This estimate will be based upon the design development phase of the project. Should the CITY request design alternate(s) be prepared for bidding, the LANDSCAPE ARCHITECT will invoice the CITY, in addition to the original contract amount as set forth in Exhibit "A", the agreed upon percentage of construction cost for preparation of plans, construction documents, and specifications for the alternate(s). Any such additional expenses shall be pre - authorized by the CITY in advance of work being performed. Section XVIII Indemnity The LANDSCAPE ARCHITECT agrees to indemnify and hold harmless the CITY and its officers, agents and employees of and from damages, injuries (including death), claims, property damages (including loss of use), losses, demands, suits, judgments and costs, including reasonable attorneys' fees and expenses, which directly arise out of the LANDSCAPE ARCHITECT's breach of any of the terms or provisions of this CONTRACT, or by any other negligent act, error or omission of the LANDSCAPE ARCHITECT, its agents, servants, employees, subcontractors, or any other persons or entities for whose acts the LANDSCAPE ARCHITECT is legally liable. This proposal is being submitted for your review and approval. The Scope of Services is divided into three Phases: Phase I — Basic Design Services, Design Development and Construction Documents; Phase II - Additional Services; and Phase III — Reimbursables. PHASE I - BASIC DESIGN SERVICES, DESIGN DEVELOPMENT & CONSTRUCTION DOCUMENTS Design Development Services An opinion of probable cost for construction will be prepared for the programs elements identified by the City for construction in this phase of the project. It is our understanding the City has budgeted $250,000.00 for the project budget. The project elements included in this scope of services are as follows: 1. Connection to the existing trail at Porter Athletic Complex. 2. Trail design section under 1-35. 3. Two low water crossings under 1-35. 4. Trail loop into East Park. 5. Small ten (10) space parking lot with access road We will prepare a design development plan based on existing site conditions and topography. Dunkin Sims Stoffels, Inc. will perform the following tasks in this section of the project: ■ Grading Plan(s), which will establish grades for all elements of the project. ■ Trail Design / Replacement. ■ Layout Plan(s) locating by dimensions all structures, hike & bike trail and drainage structure. ■ Construction Details providing plans, sections, elevations of the individual elements of the plans. ■ Prepare proposal forms and appropriate add or deduct alternates. ■ Prepare the project manual. ■ Drainage map(s); if required by TxDOT ■ Engineer review of drainage structure; if required by TxDOT. Bidding and Contract Award The Consultant will be responsible for the following tasks in this phase: ■ Distribute plans and specifications from our office to interested contractors. • Answer questions and interpret drawing during the bidding period. ■ Assist the City in receiving bids. ■ Prepare and distribute any required addendum. ■ Attend the bid opening and prepare a bid tabulation sheet for completion at the bid opening. ■ Analyze the bids and make a written recommendation to the City for awarding a contract. Construction Administration We will perform the following tasks during this phase of the project: ■ Consultation and advice to the City. ■ Preparation of elementary and supplementary sketches required to resolve field conditions. ■ Approval of submittals and shop drawings submitted by contractors for conformance with the design concept. ■ The consulting team shall make periodic site visits to determine if the project is proceeding in accordance with the contract documents. The consulting team shall not be responsible or liable for the Contractor's failure to perform the construction work in accordance with the contract documents. ■ Review and approval of all certificates for payment submitted by the Contractor. ■ Prepare Change Orders for the City's approval and execution. ■ Coordinate final site walk through with the City at the conclusion of the construction and provide a punch list to Contractor to complete the project. 2 PHASE II - ADDITIONAL SERVICES The following items set forth below may be required as part of the Basic Design Services. Costs for each item listed have been provided and will only be used if required by TxDOT. Drainage Map(s) for Structures $7,500.00 Engineer Review Seal Required by TxDOT $7,500.00 Additional Services which are not included in this proposal include: ■ Preparation of final or preliminary plats. • Geotechnical surveys. ■ Detail site plans required by the City Planning Department. PHASE III - REIMBURSABLES Plan and Specification Printing The Consultant will invoice the City at cost plus 10% for all out -of -house printing of plans, specifications and plotting of AutoCAD files. Requested mounting or laminating of master plans will also be invoiced at the incurred cost. In-house printing of check prints for use in preparing the construction documents are included in the basic design services. Postage and delivery expenses will not be invoiced during the Design Phase of the contract. Courier, express mail, or overnight delivery charges, as well as, the cost of mailing sets of contract documents to prospective bidders will be charged to the City. We would recommend the City budget $2,500.00 for this task. Topographical Survey It is our understanding the City will provide an on -the -ground topographical survey for the site with spot elevations and locations of existing elements. Texas Department of Licensing and Regulation Fee The City should budget $2,000.00 for plan review and inspection fees for ADA compliance. These are often the land uses that have the greatest potential to impact surrounding properties with traffic, noise, dust, vibration, and other disturbances. Staff is proposing to remove from the allowed land uses anything that might be sensitive to those functions. Also, while sexually oriented businesses are regulated by a separate chapter of the Code of Ordinances, they are not referenced in the Zoning Ordinance. This amendment would add that use to the Land Use Table, permitting it only in the I-2 District. The Land Use Table does not include a business that qualifies as a tavern, but not a restaurant. Staff is proposing to add the land use Tavern to the table, permitting it only in the B-3 Central Business District. Proposed Amendment: Townhome District The Land Use Table permits single family attached dwellings, townhomes, in the MF-1 and MF-2 districts, but those districts are not written to accommodate this development style. Staff is proposing to create a TH Townhome district, which would be the only place attached single family dwellings would be permitted. The Land Use Table would also be updated to remove Single Family Dwelling, Attached from the MF- 1 & MF-2 districts, and permiting them in the new TH district. Proposed Amendment: Residential Office District The B-1 Business District is described as, "intended for office facilities, neighborhood shopping facilities and retail and commercial facilities of a service character. The B-1 District is established to accommodate the daily and frequent needs of the community." The B-1 Business District is found in three areas of the Official Zoning Map. One is on the south side of FM 455 (Chapman Drive) between 1st Street and 8th Street. Another is along 5th Street (Business I-35) between I-35 and Cowling Road. There are two smaller 13-1 districts on the in the southeast quadrant, one at Willow Street and lst Street, and the other at 2nd Street and Church Street. The B-1 Business District permits business of significant intensity that are not always harmonious with residential uses. Permitted within the B-1 district are convenience stores such as Hunter's and Sportsman, restaurants like Sonic and Pellegrinos, veterinarian's offices, pet shops, and funeral homes. Also, the B-I Business District prohibits residential uses. This means homes currently occupied within a B-1 District are non -conforming uses. A non -conforming status can complicate the sale or refinancing of the property, as the continued use of the property cannot be guaranteed. The proposed amendment would create a new commercial district that permits both business and residential uses. The intent is provide the opportunity for low intensity business uses that would be harmonious with residential uses. While many businesses require buildings and improvements of a commercial nature, some businesses can function within buildings of residential scale and character. Examples would include small offices and retail stores. The proposed district would permit these kind of uses within residential -scale buildings, along with single family dwellings. It would prohibit commercial uses and physical improvements that could bother adjacent residential uses. Section 3 It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses, phrases and words of this Ordinance are severable and, if any word, phrase, clause, sentence, paragraph, or section of this Ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining portions of this Ordinance, since the same would have been enacted by the City Council without the incorporation in this Ordinance of any such unconstitutional word, phrase, clause, sentence, paragraph, or section. Section 4 Any person, firm, or corporation who shall violate any of the provisions of this article shall be guilty of a misdemeanor and upon conviction shall be fined in an amount not to exceed the sum of two thousand dollars ($2,000.00) for each offense, and each and every day such offense shall continue shall be deemed to constitute a separate offense. Section 5 This ordinance will take effect immediately fiom and after its passage and the publication of the caption, as the law and Charter in such cases provide.
