MINUTES: CITY COUNCIL WORKSESSION July 20, 2015 PRESENT: Councilman Bill Boutwell, Councilman Russell Martin, Councilman David Clark, Mayor Pro Tem Gary Bilyeu and Councilman Allen Chick ABSENT: Mayor Thomas Muir OTHERS PRESENT: Mike Brice City Manager, Tami Taber City Secretary, David McClaren and Lynda McClaren 1. Call Meeting to Order. Mayor Pro Tem Bilyeu called the meeting to order at 6:00 p.m. 2. Budget Workshop. City Manager continued the Power Point presentation covering budget expenses which include radio re -banding in the amount of $110,000, increases in wholesale water costs, electric transmission and congestion costs. Ongoing Capital Projects include: - I-35 water and sewer lines - McReynolds Road - Wastewater treatment plant expansion - Jones, Sims, Kirkland and Smith Street rehabilitation - New water wells - Painting of Acker water tower and ground storage New equipment paid for out of the General Fund: -Police: 1 new patrol vehicle and new radios -Fire: New rescue truck and refurbish ambulance as a lease purchase -Street: Lease purchase payment on a front end loader, backhoe and dump truck -Parks: 90" mower, tow behind blower and a swing set for Switzer Park New equipment paid for out of the Enterprise Fund: -Water: New 1 ton utility truck, new backhoe and painting Acker water tower -Electric: New bucket truck as a lease purchase 3. Mayor Pro Tem Bilyeu called the meeting to order at 7:00 p.m. Councilman Chick led the Invocation followed by Councilman Martin leading the Pledge of Allegiance. 2. Citizens Input: (Citizens are allowed 3 minutes to speak. The City Council is unable to respond or to discuss any issues brought up during this section). Dave McClaren of 132 Shady Grove, recently received a notice regarding permits on structures, accessory buildings and fences after being told he did not have to have a permit. He stated that he has gotten three different answers from the Development Services department and is wanting the information in writing. Mayor Pro Tem Bilyeu advised Mr. McClaren to talk to Joe Iliff. CONSENT AGENDA 3. a) Approval of Minutes: July 6, 2015 - Work session July 6, 2015 - City Council b) Disbursements Councilman Martin made a motion to approve. Seconded by Councilman Clark. Motion carried 4-1, Mayor Pro Tem Bilyeu abstained due to being absent at the last meeting. 4. Consider any Items Removed From Consent Agenda. REGULAR AGENDA 5. Recognition of the Sanger High School Bass Fishing Team for Their Help in the City Fishing Derby. Jim Berman, Parks and Recreation Supervisor presented a plaque for their help. 6. Conduct a Public Hearing on a Proposed Rezoning of Approximately 1 Acre of Land Located on the West Side of Freese Drive, South of David Drive from B-1 Business District to MF-2 Multi -family Residential District. Mayor Pro Tem Bilyeu opened the Public Hearing at 7:10 p.m. Brandon Miller of 125 Pintail, is requesting a zoning change on 1 acre of vacant land near 299-301 Freese Drive, from B-1 Business District to MF-2 Multi -Family Residential District 2, to construct ten 2 story townhomes as rentals and feels this is the best use of the land. There was a petition with 75 signatures opposing this. Jerry Rainey of 1804 Bucklew, attended the Planning and Zoning meeting last week and stated that the majority of residents moved into this area ten to twenty years ago because it was nice and quiet and has easy access to I-35. He wants to see more small businesses, not rentals. He also felt privacy would be an issue and more activity at all hours like the apartment complex located down the street on Austin. Dannie Cockrell of 1002 Hunters Court, advised that he lives directly across the street from the proposed rental site and tenants will be able to see down into his backyard. This location was zoned B-1 when he built his home. He stated that ten years ago, the Council denied a motel at this site. He wants to keep a nice, quiet neighborhood and there is already enough traffic on Freese Drive. Melissa Brown of 1004 Hunters Court, feels the rentals will lower the value of homes in that area. Anita Pursley of 1001 Treys Court, said that the driveway to the rental units will be directly across from her driveway and she doesn't want renters to see into her backyard from the 2 story units. Mayor Pro Tem Bilyeu closed the Public Hearing at 7:24 p.m. 7. Consider, Discuss, and Possibly Approve Rezoning Approximately 1 Acre of Land Located on the West Side of Freese Drive, South of David Drive from B-1 Business District to MF-2 Multi -family Residential District. Joe Iliff spoke and said that the West side of Freese is zoned B-1 and B-2 otherwise it's all single family. The applicant applied for a MF-2 permit for building ten units having 37 parking spaces. Thirty two citizens attended the last Planning and Zoning meeting to oppose and the Board denied the request 4-1. Councilman Clark made a motion to deny. Seconded by Councilman Boutwell. Consider, Discuss and Possibly Approve a Sewer Main Pro-Rata Reimbursement Agreement Between the City of Sanger and Outstretched Arms. Councilman Martin made a motion to approve. Seconded by Councilman Clark. Motion carried unanimously. 9. Conduct a Public Hearing on a Proposed Specific Use Permit for an Accessory Dwelling Unit on the Property Located at 804 North Keaton Road. Mayor Pro Tem Bilyeu opened the Public Hearing at 7:49 p.m. Shelley Ruland of 804 N. Keaton, spoke about wanting to place a 14' x 28' Leland cabin beside her home (a 20+ acre tract) to house her uncle. Mayor Pro Tem Bilyeu closed the Public Hearing at 7:56 p.m. 10. Consider, Discuss and Possibly Approve a Specific Use Permit for an Accessory Dwelling Unit on the Property Located at 804 North Keaton Road. Councilman Chick made a motion to approve. (Second ,in circulation in Denton County only to the Dallas Morning News) This has been my attempt to keep residents informed of events in our Town and also of subjects of general interest in the area — roads, water, gas well drilling, etc. Initiated Annual Denton County Mayors Crime Luncheon (2012-2015) The goal was to coordinate information on area crime between the Mayors, their Police Chiefs, the Denton County Sheriff's Office, the Commissioners Court, our Texas Legislature representatives, and our US Congressman. _Denton County Emergency Services District #1 Our small Town's dilemma was inability to adequately fund emergency services. The Founding Committee's task was to educate residents on the benefits of an ESD. The ESD would collectively provide fire and emergency medical services to the towns of Argyle, Bartonville, Copper Canyon, Corral City, Northlake, and FWSD #6 and #7 in Lantana. But a specific property tax would be needed to fund it. ESD#1 was created in 2006 by a 62% positive vote in a district -wide election. Drafting Committee: "Best Practices for Municipalities and Gas Pipelines" (Adopted 2010 by most cities and pipeline corporations with gas pipeline operations in Denton County.) This was a collaborative effort of Mayors, Denton County Commissioners, and the Texas Pipeline Association. The goal was to expedite safe pipeline construction, but with a minimal impact on Iandowners, local businesses, and future development plans of each city. Argyle Volunteer Fire District Board (Served 10 years, 2005 to present) Neighborhood Watch and Crime Prevention Copper Canyon does not have a police department. Resident Block Captains were recruited for each street in town. The Town Council then contracted to pay for two Sheriff's Deputies dedicated to Copper Canyon for 80 hours per week. On every shift the Deputy patrols each street in Copper Canyon at least once and sometimes twice. The result has been a virtually crime free community for the past seven years. (It helps that the town is a stable community with neighbors personally knowing each other for years.) (d) Additions to, or reconstruction of, existing structures must have, at a minimum, the same ratio of masonry to other materials as does the existing structure. (e) Detached garages, shops and storage buildings over two hundred (200) square feet must have, at a minimum, the same percentage of masonry facade as the first floor of the main structure. Buildings other than the primary residence on A -Agricultural zoned property are exempt from this requirement. (f) The City Council may approve an alternative to use a different material or design if they find that the material or design meets or exceeds the intent of this article after conducting a public hearing. Dormer: A dormer is a structural element of a building that protrudes from the plane of a sloping roof surface, clad in the same material as the exterior walls below the roof line and containing a window. A dormer within the front fagade scores 4 points. iii. Multiple Materials: The use of a combination of masonry and non - masonry materials in the exterior of a building fagade. For example, an exterior wall with brick veneer from the ground up to the bottom of the windows, with wood siding up the balance of the walls to the eaves. The materials should be visibly different from each other from the public right-of-way, with each covering at least 20% of the fagade. The use of multiple exterior materials scores 4 points. iv. Major Offset to Front Fagade: A fagade with a major offset is one with a section at least 10 feet wide set back at least ten (10) additional feet from the balance of the fagade. Such proposals will be seriously and fairly considered by the City Council." The applicant is requested an meritorious exception to allow a larger than permitted electronic message board. The ordinance sets a maximum of 20 square feet (Sec. 3.1406 (6)). The applicant has an existing sign of approximately 131 square feet, with about half of that being an electronic message board. The proposed sign would be the same total size, with a slightly larger electronic message area of 70.3 square feet. FINANCIAL SUMMARY ®N/A ❑GRANT FUNDS ❑OPERATING EXPENSE [:]REVENUE ❑CIP ❑BUDGETED [:]NON -BUDGETED BACKGROUND/SUMMARY OF ITEM Roadway impact fees are fees collected by cities on new development for the funding of roadway facilities attributable to the increased traffic demanded by their construction. For a city to adopt roadway impact fees, a study must be prepared projecting the amount of increased traffic demand generated by future development, and identifying the cost of future roadway facilities. This study is reviewed by a committee appointed by the City Council, called the Capital Improvement Advisory Committee (CIAC). Several public hearings are conducted prior to the adoption of any roadway impact fee. This resolution will set the dates for the first hearing. The City Council has appointed the Planning & Zoning Commission to serve as the CIAC. Eikon Consulting Group, LLC has prepared the Roadway Impact Fee Study. The Study establishes three things required for the City to collect roadway impact fees. The first is the projection of future traffic demanded by new development, called the land use assumptions (LUA's). The second is the projected costs of the roadway projects to be constructed within 10 years, the capital improvements plan (CIP). And the third is a ratio between the two, calculating the maximum fee per service unit that the city can collect. Most cities collect less than the maximum impact fee calculated by this study, and the actual amount collected will be determined by City Council. The Study, and the comments of the CIAC about it, establish the background information about the fees, and their function in the City's efforts to accommodate growth. (At least 30 days before September 14`h ) September 14, 2015 The Planning & Zoning Commission, serving as the CIAC, conducts a public hearing on the LUA's and CIP. The Commission can make recommendations to the City Council. September 21, 2015 The City Council conducts a public hearing on the LUA's and CIP and can adopt them subsequently. The City Council can also approve a resolution setting the public hearing date for the imposition of roadway impact fees. September 22, 2015 City Staff submits for publication 30 day notice of public hearing roadway impact fees. (At least 30 days before November 2, 2015.) November 2, 2015 The City Council conducts a public hearing on the imposition of a roadway impact fee. The City Council then has 30 days to take action on the fees, and can adopt an ordinance imposing roadway impact fees. This 30-day window would include the November 2°d and November 161h regular meetings of the City Council.
