10-31-17-Ordinance-Amending Weed, Grass, Rubbish, Brush and other Objectionable Matter-10/10/2017ORDINANCE # 10-31-17 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BANGER, TEXAS AMENDING CHAPTER 6, HEALTH AND SANITATION OF THE CODE OF ORDINANCES; ARTICLE 6.100 WEEDS, GRASS, RUBBISH, BRUSH AND OTHER OBJECTIONABLE MATTER, SEC. 6.101 TALL WEEDS GRASSES OR PLANTS UNLAWFUL; PROVIDING FOR THE REPEAL OF ALL ORDINANCES IN CONFLICT; PROVIDING FOR A PENALTY; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BANGER, TEXAS: SECTION 1. That Chapter 6, Article 6.100, Sec. 6101 (b) of the Sanger Code of Ordinances is hereby amended to read as follows: ARTICLE 6.100 WEEDS GRASS RUBBISH BRUSH AND OTHER OBJECTIONABLE MATTER Sec. 6.101 Tall Weeds, Grasses or Plants Unlawful (b) It shall be unlawful for any person, having supervision or control of any lot, tract, parcel of land or portion thereof, occupied or unoccupied, improved or unimproved, within the corporate limits of the city to suffer or permit grass, weeds or any other plant that is not cultivated to grow in rank profusion or otherwise in, along, upon or across the sidewalk or street adjacent to same in the area between the property line and the curb -line and within the area twenty-five feet (25') beyond the property line adjacent to alleys and easements, to a height greater than twelve inches (12") on an average. SECTION 2. All ordinances or parts of ordinances in conflict herewith are, to the extent of such conflict, hereby repealed. SECTION 3. It is hereby declared to be the intention of the City Council that the sections, paragraphsI sentences, clauses, phrases and words of this Ordinance are severable and, if any word, phrase, clause, sentence, paragraph, or section of this Ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining portions of this Ordinance, since the same would have been enacted by the City Council without the incorporation in this Ordinance of any such unconstitutional word, phrase, clause, sentence, paragraph, or section. SECTION 4. Any person, firm or corporation who shall violate any of the provisions of this article shall be guilty of a misdemeanor and upon conviction shall be fined in accordance with the general penalty provision found in The Code of Ordinances, Section 1.109 General Penalty for Violations of Code. SECTION 5. This ordinance will take effect immediately from and after its passage and the publication of the caption, as the law and Charter in such cases provide.
