This would include Second Street, Fifth Street, Tenth Street and Keaton Road. We have monitored parking on these streets both during the daytime and at night over the past week. During the times monitored no cars were found parked on either Fifth Street or Keaton Road, On Tenth Street the average was one during the day and three during late night hours. On Second Street the average was three in the daytime and six at night. No significant issues were noted with traffic flow on any of these streets. We also checked for any complaints or accidents concerning parking on these streets over the last few months. Only one complaint was found involving a car parked facing the wrong way on Keaton Road. In discussion with Chief Amyx he stated that most of the parking complaints come from residential streets and not the thoroughfares. After further discussion with Chief Amyx potential areas were identified where no parking zones might be of some benefit. The first is along the East side of Keaton Road from Fifth Street to Brook Glen. This area was posted no parking previous to Keaton Road being reconstructed but the zone was never codified in the ordinance. In the past some residents of the mobile home park were parking semi -trucks in this area. While it is not a problem at present, designating this area now as no parking would prevent future issues. The second area is along the East side of Second Street from Elm to FM455. This is due to the anticipated increase in truck traffic in this area. No other areas appear to have any major issues either current or anticipated. The proposed ordinance is attached for your consideration. 1 Sec. 12.603 Parking Prohibited in Certain Places (a) It shall be unlawful for the driver of a vehicle to leave, stop, stand, or park such vehicle except in compliance with the directions of a police officer or traffic sign or signal within twenty-five feet (25') of the intersection of the north boundary line of Bolivar Street and the east boundary line of Fifth Street and within twenty-five feet (25') from the intersection of the south boundary line of Elm Street and the east boundary line of Fifth Street. (b) It shall be unlawful for the driver of a vehicle to leave, stop, stand, or park such vehicle, except in compliance with the directions of a police officer or traffic sign or signal, on the east side of Fifth Street between Bolivar Street and Elm Street, except in a diagonal or head -in parking position and within the designated parking lines. (c) It shall be unlawful for the driver of a vehicle to leave, stop, stand, or park such vehicle, except in compliance with the directions of a police officer or traffic sign or signal, on the east and west access roads of Interstate 35 within the corporate limits of the city as presently established and as said corporation lines may be changed or amended. (d) It shall be unlawful for the driver of a vehicle to leave, stop, stand, or park such vehicle, except in compliance with the directions of a police officer or traffic sign or signal, on the north side of Cherry Street from 4th Street west one hundred and ten feet (110'). (e) It shall be unlawful for the driver of a vehicle to leave, stop, stand, or park such vehicle, except in compliance with the directions of a police officer or traffic sign or signal, on the west side of Tejas from Chippewa north to dead end. (f) It shall be unlawfiil for the driver of a vehicle to leave stop, stand, or park such vehicle, except in compliance with the directions of a ponce officer or traffic sign or signal, on the east side of Keaton Road from Fifth Street north to Brook Glen. ORDINANCE# 11-2143 i AN ORDINANCE OF THE CITY OF SANGER, TEXAS, CHAPTER 12 "TRAFFIC AND VEHICLES", ARTICLE 12,600, SECTION 12.603 PARKING PROHIBITED IN CERTAIN PLACES; IN THE CITY OF SANGER CODE OF ORDINANCES IS HEREBY AMENDED; PROVIDING FOR THE REPEAL OF ALL ORDINANCES IN CONFLICT; PROVIDING FOR A SEVERABILITY CLAUSE; PROVIDING FOR A PENALTY, AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SANGER1 TEXAS: Section 1. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses, phrases and words of this Ordinance are severable and, if any word, phrase, clause, sentence, paragraph, or section of this Ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining portions of this Ordinance, since the same would have been enacted by the City Council without the incorporation in this Ordinance of any such unconstitutional word, phrase, clause, sentence, paragraph, or section. Section 4. Any person, firm, or corporation who shall violate any of the provisions of this article shall be guilty of a misdemeanor and upon conviction shall be fined in an amount not to exceed the sum of five hundred dollars ($500.00) for each offense, and each and every day such offense shall continue shall be deemed to constitute a separate offense. Section 5. This ordinance will take effect immediately from and after its passage and the publication of the caption, as the law and Charter in such cases provide. The justification for this ordinance stems from abuse of the service. On average, over two hundred orders are processed monthly with some limb orders consisting of large piles generated by landscapers who are charging citizens for tree trimming service and stacking limbs by the curb for the city to process. This ordinance will restrict landscapers from leaving limbs for the city to process while maintaining the clipping service for citizens as currently provided with an exception of being a time limit for large piles of limbs. Large piles of limbs will have a 30 minute time limit because they restrict the crew from being able to cover the city route in a timely manner, STAFF OPTIONS & RECOMMENDATION The Director of Parks and Recreation recommends approving the brush chipping ordinance. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses, phrases and words of this Ordinance are severable and, if any word, phrase, clause, sentence, paragraph, or section of this Ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining portions of this Ordinance, since the same would have been enacted by the City Council without the incorporation in this Ordinance of any such unconstitutional word, phrase, clause, sentence, paragraph, or section. Section 4. Any person, firm, or corporation who shall violate any of the provisions of this article shall be guilty of a misdemeanor and upon conviction shall be fined in an amount not to exceed the sum of five hundred dollars ($500.00) for each offense, and each and every day such offense shall continue shall be deemed to constitute a separate offense. Section 5. This ordinance will take effect immediately from and after its passage and the publication of the caption, as the law and Charter in such cases provide.
