09-91-Ordinance-Amending Chapter 7, Section 6 Beautification Board-07/15/1991CITY OF SANGER, TEXAS ORDINANCE NO.09-91 AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF SANGER, TEXAS TO ADD SECTION 6 TO CHAPTER 7, ENTITLED BEAUTIFICATION BOARD, PROVIDING FOR A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SANGER, TEXAS: SECTION I THAT CHAPTER 7 OF THE CODE OF ORDINANCES OF THE CITY OF SANGER, TEXAS IS HEREBY AMENDED BY ADDING SECTION 6 ENTITLED BEAUTIFICATION BOARD, APPOINTMENT OF BOARD, WHICH SHALL READ AS FOLLOWS: SECTION 6: BEAUTIFICATION BOARD There is hereby created a Beautification Board to be composed of seven (7) members, appointed by the Mayor and confirmed by the City Council. Members shall serve from July 1 of the year of appointment for staggered terms of two (2) years and may be appointed to three (3) successive terms of office. The members of the Beautification Board shall be identified by place numbers one (1) through (7). The even -numbered places shall expire in even -numbered years and the odd -numbered places shall expire in the odd -numbered years. Newly appointed members shall be installed at the first regular committee meeting after their appointment. Vacancies shall be filled for an unexpired term in the manner in which original appointments are required to be made. Continued absence of any member from regular meetings of the commission shall, at the discretion of the City Council, render any such member liable to immediate removal from office. B. EX OFFICIO MEMBERS The city manager or his designee shall be ex officio members of the board. They shall attend meetings of the board and shall have the right to discuss any matter that is under consideration by the board but shall have no vote. CITY SECRETARY ORIGINAL COPY ORD. #09-91 PAGE 2 Members of the Beautification Board shall be served by the Sanger Post Office for the delivery of regular mail. D. ORGANIZATION AND SELECTION OF OFFICERS The board shall hold an organization meeting in July of each year and shall elect a chair, vice chair, and a secretary from among its own membership. Any four (4) of the regularly appointed members shall constitute a quorum. The board shall determine its own rules and order of business and meet as needed. All meetings shall be open to the public and shall be conducted under the Texas Open Meetings Act, Article 6252-17 and a permanent record of proceedings maintained. E. POWERS AND DUTIES OF THE BEAUTIFICATION BOARD (1) The board shall serve as a consulting, advisory and supervisory body to study and recommend policies relating to the operation and promotion, of beautification efforts as outlined in the Keep Texas Beautiful Program. (2) The board shall submit annually to the city manager, not less than one hundred twenty (120) days prior to the beginning of the budget year, a list of recommended capital improvements, which in the opinion of the board ought to be constructed during the forthcoming five (5) year period. Such list shall be arranged in order of preference, with recommendations as to which projects should be constructed in which year. SECTION II All Ordinances or parts of Ordinances in conflict herewith are, to the extent of such conflict, hereby repealed. SECTION III It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses, and phrases of this Ordinance are severable and, if any phrase, clause, sentence, paragraph, or section of this Ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of CITY SECRETARY ORIGINAi. ropy ORD. #09-91 PAGE 3 this Ordinance, since the same would have been enacted by the City Council without the incorporation in this Ordinance of any such unconstitutional phrase, clause, sentence, paragraph, or section. SECTION IV This Ordinance will take effect immediately from and after its passage and the publication of the caption as the law in such cases provides.
